Confirm that the matching entity is marked Designated, not Pending, and review its date, remarks, and linked filings. A DCM designation is evidence about the exchange’s recorded status—not proof that every contract has separate Commission approval or that the service is available to every customer.
What CFTC regulation means for a prediction market
The CFTC describes event contracts as derivatives whose payouts depend on a specified event, occurrence, or value. They are often structured as yes-or-no outcomes; examples include contracts tied to economic indicators, corporate earnings, snowfall, or hurricane damages. A designated contract market is an exchange under CFTC oversight pursuant to the Commodity Exchange Act. The key distinction is between the exchange and the contracts it lists. A DCM may submit a new contract through self-certification that it complies with the Commodity Exchange Act and regulations, or request Commission approval. Those are product-level processes; the exchange’s designation alone does not establish that every contract received separate Commission approval or is permitted. The CFTC also discusses restrictions under Regulation 40.11 for contracts referencing specified categories, including terrorism, assassination, war, gaming, or unlawful activity. How to verify the operator in CFTC records

Identify the legal entity
Look in the platform’s terms, disclosures, or website footer for the company that operates the service. Note any exchange or trading venue named separately from the consumer-facing brand. Search using the legal entity, not just the product name: CFTC filing records can include legal names, assumed names, and name-change remarks.

Search the CFTC’s DCM records
Start with the CFTC DCM overview and the Industry Filings: Designated Contract Markets page. Search for the operator and inspect its status. Designated and Pending are different states: a pending application is not a designation. The CFTC also provides a filtered view of designated DCMs; use the full filings page as well if you need to check pending applications or other record details.

Check the date, remarks, and filings
Read the record’s status date and remarks, then open linked documents where available. If the brand name differs from the entity in the record, trace the relationship through the platform’s official disclosures and the CFTC filings. Do not assume that a similar name—or an unverified marketing claim—establishes that the brand and listed entity are the same.

Verify the particular contract separately
For a claim about a specific event contract, look for the relevant product filing and current CFTC material. An exchange’s DCM listing answers a different question from whether a particular contract was submitted by self-certification, received Commission approval, or may be restricted.

Record when you checked
Include the date you reviewed the CFTC record. The filings page is a live database, and designations, pending applications, and name-related remarks can change.

Check current developments before making a dated claim
On March 12, 2026, the CFTC announced a Division of Market Oversight advisory about event-contract listing. It highlights DCM responsibilities under the Commodity Exchange Act and regulations, including surveillance and compliance with core principles. Check that you are using the official service
