There is no settled nationwide yes-or-no answer. A sports event contract offered on a CFTC-registered exchange may fall under federal commodities law, while states have argued that some such contracts are sports betting prohibited by state law. The CFTC has challenged some state enforcement actions, and litigation remains part of the dispute. Whether a particular contract can be offered or traded depends on its terms, platform, state, and any current court orders.
Why the answer depends on the contract and where you are
“Prediction market” is a description, not a legal classification. A contract’s structure and the venue offering it matter: a platform’s use of the word “contract” does not by itself take a sports wager outside gambling laws or establish that the product is lawful.

The federal framework and state gambling laws can point in different directions. The Commodity Futures Trading Commission (CFTC) says it has exclusive authority over qualifying contracts on CFTC-registered markets. Some states have treated sports event contracts as unlawful betting under their gaming laws. The parties dispute how federal law applies and whether it preempts state enforcement.

The available official sources do not establish a complete, current state-by-state map or the status of every relevant injunction, appeal, or case as of October 9, 2026. It is therefore not accurate to say these contracts are legal in all 50 states, illegal nationwide, or that courts have settled the issue.

How federal commodities law applies
Some event contracts may be swaps or futures
In a March 16, 2026 advance notice, the CFTC described event contracts as derivative contracts—typically with binary payoffs—based on the outcome of an event. It said these contracts can fall within the Commodity Exchange Act’s definitions of swaps or futures. A prediction market offering swaps or futures to the general public must register with the CFTC as a designated contract market (DCM), subject to the federal regime. Depending on the product’s legal classification, some event contracts may instead fall under Securities and Exchange Commission jurisdiction. Read the CFTC’s March 2026 advance notice.
Registration does not settle every question about a sports contract
The CFTC says it has authority under section 5c(c)(5)(C) of the Commodity Exchange Act to prohibit particular event contracts if it determines they are contrary to the public interest. That authority does not mean every sports contract has received final approval or has been prohibited. Nor does registration alone resolve the separate dispute over how state gambling laws apply.

The CFTC reported that about 1,600 event contracts were certified for listing in 2025. That figure covers event contracts across multiple subjects; it is not a count of sports contracts and does not establish their legality in any particular state. The advance notice provides the figure and its federal-law context.

The 2024 proposal was withdrawn, not finalized
On February 4, 2026, the CFTC withdrew its proposed event-contract rule, originally published in June 2024, and said it did not intend to issue final rules from that proposal. The withdrawal notice cited litigation and unresolved questions involving the CFTC’s authority, state-law preemption, the Commodity Exchange Act’s definitions, and the meaning of “gaming” for sports-related contracts. The agency said: “The Commission no longer intends to issue final rules with respect to the proposal.” That withdrawal is not a final rule that makes all sports contracts lawful or unlawful. Staff guidance is not a court judgment
On March 12, 2026, the CFTC’s Division of Market Oversight issued a staff advisory reminding DCMs of their obligations under the Commodity Exchange Act and CFTC regulations. The agency’s announcement says it covered DCM Core Principle 3, product-submission requirements, and issues relevant to sports-related contracts. It is staff guidance—not a final adjudication of any particular contract’s legality or a nationwide ruling on state authority. Read the advisory announcement.
Why states and the CFTC disagree
Some states have argued that sports event contracts offered by prediction markets are unlawful sports betting under state gaming laws. The CFTC has argued that federal law gives it exclusive authority over qualifying contracts on registered markets and has sued states to challenge enforcement efforts. Those are competing legal positions, not a nationwide resolution.

The CFTC reported that in June 2026 New Mexico sued Kalshi in state court, alleging unlawful online sports betting, and that the CFTC then sued New Mexico, seeking declaratory and injunctive relief. A comment submitted to the CFTC by the California Nations Indian Gaming Association takes the position that sports event contracts are prohibited gaming and cites court decisions in support. That is an advocacy submission, not a CFTC determination or a final nationwide rule. Read the organization’s comment.

Both products may be tied to a sports outcome, but the labels alone do not tell you which legal regime applies. Relevant distinctions include the platform’s regulatory status, the legal instrument and contract terms, the state’s rules and current court orders, and which regulator oversees the product.

What to check before trading in your state
Because the legal position may change with new orders or appeals, verify the specific product and jurisdiction rather than relying on a national headline or a platform’s general description.
- Identify the exact contract and platform. Read the contract terms and determine whether the product is a sports event contract, what outcome it covers, and which entity offers it.
- Check the platform’s regulatory status. For a product described as a swap or future offered to the public, verify whether the market is registered as a DCM and whether the particular product has been submitted or listed under the applicable federal process. Registration does not, by itself, settle state-law questions.
- Check the law and current cases in your state. Look for state gaming-regulator notices, enforcement actions, court orders, and appellate decisions that apply to the product or platform. A lawsuit announcement is not a ruling, and an order may have a limited geographic or procedural scope.
- Confirm what is currently available to you. Platform access or the ability to place a trade does not itself establish legality. Review current terms and notices, and do not infer that another state’s treatment applies where you live.
What remains unsettled
The CFTC’s 2026 advance notice sought information about how existing statutory and regulatory principles apply to prediction markets, including sports contracts. It is a request for comment, not a final rule. The withdrawal of the earlier proposal, the staff advisory, and active state-federal litigation all reflect an evolving regulatory dispute; none alone resolves nationwide legality. For an individual contract or a particular state, the answer may turn on current court orders and the product’s precise legal classification.
