How to Check AI-Generated Game Assets for Copyright and Licensing Risks

AI-assisted game assets need more than a commercial-use checkbox. Review inputs, outputs, human edits, tool terms, and each platform’s disclosure rules before release.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Review each AI-generated game asset before release; there is no blanket rule that makes AI output either copyright-free or safe for commercial use. Check four separate things: what human-authored expression may be protected, whether the input or output implicates someone else’s rights, what the generator’s actual terms allow, and what each storefront or marketplace requires you to disclose. The copyright discussion below is U.S.-focused; platform requirements are specific to the platforms named. This is a practical review process, not legal advice about a particular asset.

What you are checking—and why the questions are different

An asset can involve several distinct questions. A human contribution may qualify for copyright protection while the generated portion does not; that does not establish that the asset is clear of third-party rights. A tool may permit commercial use under its contract without guaranteeing that a particular output is non-infringing. And a storefront disclosure is not permission to use material that violates its rules.

As an Amazon Associate I earn from qualifying purchases.

  • Copyrightability: Which expressive parts, if any, reflect human authorship?
  • Third-party rights: Do the prompt, references, or final asset use protected expression, a brand, a person’s likeness or voice, or material subject to another party’s license?
  • Generator terms: Do the applicable terms cover your inputs, outputs, intended commercial use, and distribution?
  • Platform disclosure: Does the storefront or marketplace require you to identify AI-generated or AI-assisted content?

For U.S. copyright, the Copyright Office says AI assistance or inclusion of AI-generated material in a larger human-created work does not, by itself, bar copyrightability. The human-authored expression must be distinguished from machine-determined material; the Office’s registration guidance also requires applicants to disclose AI-generated material and identify the human contribution. This is not a ruling that every generated output is copyrightable or cleared. See the Copyright Office’s January 29, 2025 Part 2 announcement and its AI initiative and guidance.

How to review an asset before release

Use the process for each final asset, not just once for a project or generator. Include store-page art and promotional material if a platform’s survey asks about them. Keep unused experiments separate from deliverables.

1. Inventory the asset and where it will appear

Give the asset a stable identifier and version; retain a file hash or another reliable reference to the exact file reviewed. Note its type—such as art, audio, text, animation, code, or UI—and every intended use: in-game, marketing, store listing, modding tools, or live generation. The same file may need review in more than one context.

2. Identify the generator and the terms that applied

Record the provider, model or feature and version if shown, generation date, account or plan, and the terms in effect then. Read operative terms rather than relying on a product page or a general claim about the provider. Check provisions covering commercial use, input and output rights, third-party material, sublicensing, attribution, confidentiality, prohibited prompts, indemnity, and termination. Confirm that the permission fits your game’s platforms, monetization, territories, and any redistribution or user-generated-content pipeline.

Adobe illustrates why a provider’s training approach and its output terms are separate issues. Adobe describes Firefly’s use of licensed and public-domain training material, but its Generative AI Product Specific Terms effective April 23, 2026 make the user responsible for inputs and outputs and disclaim warranties that outputs will not violate third-party rights. Adobe also warns that outputs may be non-unique or not protectable. Those are Adobe’s contractual terms, not a rule for every generator. The terms provide a broad license if a user submits input and output to an Adobe-hosted gallery. Adobe’s specified Firefly indemnification is limited to eligible business plans and conditions; do not assume it covers every account, output, or use.

3. Trace every input and reference

List the source of each uploaded image, sketch, photo, sound, text, character, logo, or other reference. Check that your team has permission to use it as model input for the intended purpose, including commercial use where relevant. Preserve the applicable license and any attribution or use restrictions with the asset record.

A prompt does not erase rights in an uploaded reference, and a generated result is not automatically permissible just because a model made it. Avoid prompts deliberately seeking a named living artist’s style, a specific copyrighted character, or a recognizable franchise asset unless counsel has reviewed the situation and applicable rules.

4. Inspect the output in its final context

Have a person examine the actual version players will see, at the relevant resolution and in context. Look for close matches to supplied references or likely source assets, as well as distinctive character designs, logos, text, signature compositions, recognizable people, and voices. Record the reviewer, what was compared, the date, and the decision.

Similarity tools can help flag material for human review; they do not certify non-infringement. A saved prompt log or detector result is not legal clearance.

5. Document human creative decisions

Preserve evidence of meaningful human work, such as selection, arrangement, compositing, painting over, modeling, retopology, animation, and editing. Identify generated material separately from human-authored expression in project records and, if relevant, a U.S. copyright registration application. Do not assume that repeated prompt refinement alone establishes copyright in every expressive element.

6. Verify licenses and platform rules

Keep third-party licenses and required notices beside the relevant asset. Check permitted use, attribution, modification, redistribution, territory, platform, and commercial terms. If a source asset or generated work will be delivered to users or another party, verify that the license permits that form of distribution. A marketplace listing or seller assurance is not a substitute for the license itself.

Storefront rules are separate from both copyrightability and generator terms. The following examples apply to their respective services, not to every game or distribution channel:

Service What to disclose or check
Steam Steamworks’ Content Survey distinguishes pre-generated AI content made during development and shipped for players from content generated while the game runs. Its generative-AI section concerns player-consumed shipped content, including artwork, sound, narrative, and localization; efficiency gains from AI tools are not its focus. For live generation, describe safeguards against illegal output. Complete the current survey honestly; standard content and infringement rules still apply. If approved content later changes in a way that affects locked answers, update Steam Support. See the Steamworks Content Survey.
Unity Asset Store Unity’s current Submission Guidelines require an explicit AI description for wholly or partly AI-made submissions: identify the tools and generated material, and explain modifications that add value. Descriptions must not imply human effort for AI-assisted content. The rules also address resemblance to third-party or copyrighted work, plagiarism, usability, value, mass production without differentiation, third-party notices, and license compatibility. Re-check the live guidelines before submitting; this is an Asset Store publisher rule, not a universal disclosure rule for every Unity game.

7. Make and retain a decision

Mark each asset approved, revise, replace, or escalate for rights review. Escalate close resemblance to a protected work, unclear reference rights, named people or brands, contradictory tool terms, or an asset central to the game’s commercial identity. Keep the actual terms and review evidence, not only a checkbox or verbal assurance. If you cannot substantiate the necessary rights, replace the asset or obtain permission before release.

What evidence to keep for each asset

A compact asset-level record makes the review repeatable and helps explain what was used, changed, and shipped. Keep:

  • Asset identifier, version, file hash or stable file reference, type, and final use locations.
  • Generator, model or feature version where available, account or plan, generation date, prompt, and the terms applicable at the time.
  • Every reference input, its source and license, and any required attribution or notice.
  • The generated output and evidence of human edits and creative decisions.
  • Who reviewed the final asset, what they checked, the decision, and any disclosure made to a platform.

This documentation supports an audit trail; it cannot itself establish ownership or guarantee that an asset is cleared.

How to compare generators or workflows

Use the same questions for each option. A provider’s statement about training sources is a provider claim unless independently verified, and it does not resolve the rights status of an individual output.

  • Training and source transparency: Does the provider explain what material it uses and what permissions or licenses it relies on?
  • Input controls: Are references allowed? What uploads or prompts are prohibited? Are inputs retained, shared, or used for training?
  • Output terms and risk: Does the relevant plan permit the intended commercial use? Who bears responsibility? Are outputs potentially non-unique? If indemnity is offered, what plans, outputs, and uses qualify, and what exclusions apply?
  • Provenance: Can your team identify the model version, preserve records, and distinguish generated content from human edits?
  • Disclosure and review: What must be reported to each storefront or marketplace, including for live generation? Can a human inspect the final output before release?

Does one rule apply to every country and platform?

No. The U.S. Copyright Office guidance discussed above concerns U.S. copyrightability and registration; do not treat it as a global rule. Platform disclosure policies also have their own scope.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For the European Union, the Commission says AI Act Article 50 transparency obligations apply from August 2, 2026. Its guidance describes machine-readable marking or detection requirements for providers and disclosure rules for specified deepfakes and certain public-interest text. Applicability depends on the actor, content, and circumstances; that date does not establish that every AI-generated game asset must carry a particular label. Check current jurisdiction-specific requirements and obtain legal advice for a concrete release. See the European Commission transparency page.

When to get legal review

Ask qualified counsel to review an asset when a rights question could materially affect release, investment, or the game’s identity—for example, when it closely resembles a known work, relies on references with uncertain permissions, depicts or imitates a recognizable person or brand, or is covered by conflicting tool terms. A documented internal process is useful, but it is not a substitute for advice on a specific work, territory, or license.
