How to Check a Game’s AI and Data-Use Policies Before Buying

A practical pre-purchase checklist for finding out what a game collects, how it uses player data, and whether AI features or model training are involved.

Before buying a game, check the exact store listing, the publisher or developer’s privacy policy, the platform’s privacy notice, and any policies for linked services. Look for what information is collected, why it is used, who receives it, how long it is kept, whether it can be reused to train or improve AI models, and what controls you have. A rating or an AI label can be a clue, but neither is a complete account of a game’s data practices.

Start with the exact game, edition, and platform

Open the listing for the version you intend to buy, rather than relying on a general page for the franchise or publisher. Identify the publisher and developer, and look for privacy links, terms, account requirements, online-service requirements, and any AI or generative-AI disclosure. On Epic, publisher information may appear on the product listing, Publisher Index, or Library menu; follow the listing’s links to the underlying policy rather than treating a summary as exhaustive. See Epic Games’ Privacy Policy.

Record the platform and edition too: a game may involve different services depending on where and how you play it. The platform’s notice does not necessarily describe everything the publisher does, and a publisher’s policy may not explain every feature provided by a separate company.

Map the organizations and policies involved

Make a short list of the organizations named in the listing and notices: storefront or platform, publisher, developer, any separate account provider, and any company supplying an embedded feature. Check the providers behind voice or text chat, cloud saves, cross-play, analytics, anti-cheat, user-generated content, and AI assistants when the policies identify them.

The Spanish Data Protection Agency’s 2026 guide distinguishes roles by entity and activity, while Microsoft’s Store policy addresses developers receiving personal data through Xbox Network. Microsoft says such developers must have a privacy statement governing their use of that data. These distinctions are useful for a buyer because one organization’s notice may not cover another’s processing. See the AEPD’s video-game data-protection guide and Microsoft Store Policies.

Search for the data the game may collect

Use the policy’s find function to search for terms such as gameplay, telemetry, device, identifier, IP address, voice, chat, content, crash, analytics, AI, model, training, third party, retain, and delete. Compare policy examples with the features the game actually offers.

Policies from Epic and Electronic Arts illustrate categories to look for, not universal facts about all games. Epic lists examples including gameplay and application usage, progression and results, crash reports, device details, and identifiers. EA describes device identifiers, feature engagement, gameplay and usage statistics, and online gameplay information. See Epic’s policy and EA’s Privacy and Cookie Policy.

Separate AI features from AI training

“Uses AI” can mean several different things. A game might ship with content created using AI, generate content during play, or process player prompts, voice, chat, or other submissions through an AI feature. Those uses do not automatically mean the player’s information is used to train or improve a model.

  • Brand New in box. The product ships with all relevant accessories
  • Is AI used to create pre-made art, writing, audio, or other content included in the game?
  • Does the game generate dialogue, images, quests, or other content live during play?
  • What player inputs or other submitted content does an AI feature process?
  • Does the policy say that inputs, gameplay telemetry, or player-created content may be retained, reused, or used to train, tune, or improve models—including across titles?
  • Which model or hosting providers receive information, and what do the policy and terms say about their retention and use?

Epic’s policy names large language model providers among service-provider categories for AI-powered features. That indicates a possible recipient category in the policy; by itself it does not establish that a particular game sends player inputs to one or uses them for training. The AEPD guide specifically raises cross-title telemetry reuse, asking: “Will you store telemetry in your own environment and reuse it across titles to improve design, balancing or AI models?” See Epic’s policy and the AEPD guide.

Trace purposes, recipients, retention, and controls

For each data category you find, note the stated purpose and recipients, how long it is kept, and what controls or requests are available. Look for service operation, analytics, personalization, advertising, fraud prevention or anti-cheat, cross-game profiling, AI inference, and model improvement. Check whether collection is optional and whether settings or opt-outs are available.

Also check what happens when you play offline. EA says information gathered during offline play may remain on the device and be transmitted after reconnection. Do not assume that offline play means no later data transfer; check the game-specific terms and policy for how that feature works. EA’s policy also describes third-party analytics and advertising technologies. See EA’s Privacy and Cookie Policy.

Microsoft’s Store policy says developers receiving personal data through Xbox Network must have a privacy statement governing their use, and recommends linking it from the game website and Microsoft Store page. This is developer-facing policy language, not individualized legal advice to buyers. See Microsoft Store Policies.

Check dates, regions, and what remains unclear

Look for the policy’s effective or last-updated date and the country or regional version that applies to you. A company-wide policy may describe broad practices while a title’s terms add details for a particular game or feature. If a consequential point—such as voice retention or model training—is not addressed clearly, treat it as unknown rather than assuming the data is not collected. Ask the publisher or choose a game whose disclosures answer the question.

Scope matters for ratings and privacy notices too. ESRB describes its ratings system through Rating Categories, Content Descriptors, and Interactive Elements; those help with content and online-interaction context, not a full account of telemetry or AI practices. Its online privacy statement, last updated November 19, 2025, covers ESRB-operated websites and excludes third-party sites linked from them. See ESRB Ratings and the ESRB Online Privacy Statement.

Compare games using the same questions

When deciding between titles, compare equivalent disclosures rather than relying on a single label. The table is a checklist of questions to answer for each game; it does not assume that any listed practice applies to a particular title.

What to compare Question to answer
Data collected Are account or device identifiers, gameplay telemetry, voice or chat, uploaded content, or generated content covered?
Purpose Is information used to operate the game, analyze use, personalize, serve ads, prevent fraud, provide AI features, or improve models?
Recipients Does the notice name the publisher, platform, developer, analytics or advertising providers, or cloud and model providers?
Retention and reuse Does it explain deletion timing, delayed uploads after offline play, cross-game reuse, or model training and tuning?
Player control Are there collection settings, opt-outs, or routes to request access or deletion?
Disclosure quality Is the notice current, relevant to your region and feature, and consistent with the store listing?

Use ratings as context, not as a privacy answer

ESRB reports that 83% of parents with children who play video games were aware of ESRB ratings and 77% regularly checked them before buying, citing Hart Research Associates’ 2025 findings. Those figures concern awareness and rating checks—not whether parents review privacy policies or whether a game uses player data for AI. ESRB also reports that 65% of ratings assigned to physical and console downloadable games in 2024 were E or E10+; that is a rating mix, not a measure of privacy practices. Its separate 2024 Hart Research Associates finding that more than 67% of parents would be more comfortable allowing children to download and play an ESRB Privacy Certified game measures reported comfort, not proof of a particular game’s data use. See ESRB Ratings.
