In a typical U.S. purchase from a federally licensed firearms dealer (FFL), you complete ATF Form 4473, show acceptable identification, and have the dealer run the required background check before the firearm is transferred. State and local laws, firearm type, and your individual circumstances can add requirements or prohibit a transfer, so verify the rules where you live before you buy.
What to expect when buying from an FFL
The dealer handles the transaction record, checks your identity, and contacts the FBI’s National Instant Criminal Background Check System (NICS) or an applicable state point of contact, unless a lawful exception applies. For a covered over-the-counter sale to an unlicensed buyer, the dealer must obtain ATF Form 4473 before transfer. ATF requires the form to be completed, signed, and dated before delivery.

- Confirm local requirements. Check your state and local rules and ask the dealer whether you need a permit, must observe a waiting period, or must complete any additional state process. Requirements vary by jurisdiction and may change.
- Bring acceptable identification. Take current government-issued identification with your name, residence address, date of birth, and photograph. A valid driver’s license or state ID is commonly used. ATF permits a combination of valid government-issued documents when together they provide the required information.
- Complete Form 4473 yourself. Answer the buyer’s questions accurately and certify your answers. You must be the actual buyer and transferee, not purchasing on behalf of someone else.
- Let the dealer complete the required check. The dealer verifies your identification and contacts NICS or the state point of contact when required. A background-check response does not make a transfer lawful if the dealer knows or reasonably believes you are prohibited.
- Wait for the dealer’s transfer decision. You may receive a proceed, delay, or denial outcome, and state rules or dealer policy can affect whether and when the firearm is transferred.
What a NICS delay, denial, or approval means
Delayed
A delay is not a denial or an approval. The FBI explains: “A ‘Delayed’ message means the FBI needs to do additional research to verify the person’s background.” Under the federal default, an FFL may be able to transfer a firearm after three business days without a determination, but only if state law does not prohibit the transfer. The dealer is not required to transfer it. ATF’s current Form 4473 notice also describes an extended 10-business-day timeline in specified cases involving a potentially disqualifying juvenile record and a buyer under 21. These rules do not guarantee a same-day or later transfer: state law and the dealer’s decision matter.

A denial can reflect a state or federal prohibition. The FBI directs people who believe a denial is wrong to its challenge and Voluntary Appeal File processes. Do not try to work around a denial; use the FBI’s official process to challenge an error.

Proceed
A proceed response addresses the background-check process, not every legal requirement. It does not override a state restriction or a prohibition the dealer knows or reasonably believes applies.
Who may be prohibited under federal law
Federal law bars certain people from receiving or possessing firearms. The FBI’s overview includes people convicted of specified serious crimes; fugitives from justice; unlawful users of or people addicted to controlled substances; people with certain mental-health adjudications or involuntary commitments; people unlawfully present in the United States and certain nonimmigrant-visa holders; people dishonorably discharged from the Armed Forces; people who renounced U.S. citizenship; people subject to qualifying protective orders; and people convicted of qualifying misdemeanor domestic-violence crimes.

Buying from a dealer in another state
For a nonresident purchase, ATF guidance describes the usual route as shipment to an FFL in the buyer’s state of residence. The receiving dealer then handles Form 4473 and the background check before transferring the firearm.

Federal law allows a dealer to sell a rifle or shotgun directly over the counter to a nonresident only when federal law and the laws of both states permit the sale. That limited route should not be generalized to handguns, frames, or receivers; transfer rules differ by firearm type.

This is a federal overview, not a state-by-state checklist. Before visiting a dealer, check your state or local firearms authority for current rules and ask the FFL about the requirements for the specific firearm and transaction. The FBI reports more than 500 million NICS background checks since the system launched in 1998 and more than two million denials; its overview does not state a publication year for those cumulative figures, so they are not annual or 2026 totals.
