If it is denied, ask the dealer for the transaction number and the agency that issued the decision, then request the reason and follow the appropriate appeal or record-correction process. Do not assume that a delay means you can pick up the firearm after three days: federal timing rules, state law, the agency handling the check, and some purchaser-age rules all matter.
First, find out whether the check is delayed or denied
Ask the dealer which agency handled the check—the FBI’s National Instant Criminal Background Check System (NICS) or a state point of contact—and confirm the current status. State arrangements differ, so the agency handling the check affects where to direct questions or a challenge.

A denial does not necessarily mean you were arrested or convicted. NICS uses identifying details to match records, and some prohibitions do not require an arrest or conviction. The denial reason can help distinguish a record or identity problem from another eligibility issue.
If the check is delayed, what should you do?
- Confirm the status and reviewing agency. Ask the dealer whether the response is still delayed and whether the FBI or a state agency is handling it.
- Ask whether anything is needed from you. The dealer may be able to tell you whether the agency needs additional information, but a delay by itself does not identify the underlying record or establish that you are prohibited.
- Wait for the status to change or ask the dealer about the next step. The FBI continues working to resolve delayed checks. Its denial-reason and denial-challenge procedures do not apply while the FBI check is still delayed.
Can you pick up the firearm after three days?
Not automatically. Under the federal baseline, the dealer generally may not transfer the firearm during the initial three-business-day period if NICS has not returned a proceed response. If the check remains unresolved and no denial has been issued by the end of that period, federal law may allow the dealer to transfer it. The dealer is not required to do so, and state law may require a longer wait or impose other conditions.

The check-initiation day is excluded. For this rule, a business day is a day state offices are open. ATF’s regulation illustrates the count this way: if a dealer contacts NICS on Thursday and state offices are closed on weekends, the three business days elapse on Tuesday, so a transfer may occur Wednesday, subject to the rule’s terms. That example is not a universal date calculator; holidays and purchaser-specific rules can affect the result. Some purchasers under 21 are subject to a separate investigative process and timing rules. Ask the dealer which rule applies and check the law for the state where the transfer would take place.
If the check is denied, get the reason and transaction details
Ask the dealer for the NICS or state transaction number and, if applicable, the name and address of the agency that issued the denial. ATF says the dealer should provide those details and appeal information. A dealer may not know the reason for the denial.

You may request the denial reason in writing from the FBI NICS Section or the relevant state point of contact, depending on who handled the check. FBI guidance says a reason request identifies the prohibiting category and does not require fingerprints or supporting documents. The FBI does not accept a denial-reason request for a check that remains delayed.
How to challenge an FBI NICS denial
If the FBI handled the check and you believe the denial is wrong, you may submit a NICS-related challenge. You can provide relevant records, such as documentation that your rights were restored, and learn which agency holds the underlying record. The FBI says it will respond within 60 calendar days with a final status or tell you that the request remains unresolved.

If the problem is an incorrect or incomplete record held by another agency, you may need to contact that record-holding agency to seek a correction. Follow the instructions provided for your specific denial; correcting a record and challenging the NICS result are related but distinct steps. The FBI’s challenge route is for denied checks, not a check that is still delayed.

The FBI’s Voluntary Appeal File (VAF) is an optional, longer-term route for people who believe they may legally receive and possess firearms but repeatedly encounter denials or lengthy delays because of identity matching. The FBI describes it as potentially useful when an underlying record cannot readily be changed or fingerprints have previously helped clarify identity. It is not the immediate appeal for a pending delayed check; consider it when the same match problem recurs.

What to verify before taking action
- Where the transfer will occur: State waiting periods and other requirements can apply even when federal NICS requirements are satisfied.
- Who handled the check: A state point of contact may have a different process from the FBI. Use the dealer’s information to identify the correct agency.
- Your response status: A delayed check is pending; a denial is the status that permits a denial-reason request and, for an FBI check, the FBI denial-challenge process.
- Any age-specific rule: Some purchasers under 21 are subject to additional investigative timing requirements, so do not rely on the general three-business-day baseline without checking what applies.
