Do not let an AI-written marketing email go straight from generation to send. Treat it as a draft: define approved uses and data rules, assign a human who can edit or reject it, verify claims and compliance, record approval of the final version, and monitor the campaign after sending. The review should be deeper when an error could cause greater harm or be harder to correct. This practical workflow applies NIST’s voluntary AI risk-management guidance to email production; it is not a legal safe harbor.
1. Set the rules before anyone drafts
Decide which AI tools and marketing tasks are approved, who owns the workflow, what customer or confidential information may be entered, and which questions require specialist review. Write the rules down so employees and contractors know what they may do and where to escalate.

NIST’s Generative Artificial Intelligence Profile identifies governance, data protection and retention, acceptable-use policies, impact assessment, monitoring, and risk-based controls as relevant considerations. The appropriate controls depend on an organization’s context; NIST guidance is voluntary.

- Audience and campaign purpose.
- Offer, eligibility, dates, and other current terms.
- Factual, comparative, or performance claims and the evidence supporting them.
- Required disclosures, destination links, and intended call to action.
Keep the AI tool and version information when available, along with relevant context about how the draft was produced. NIST’s Generative AI Profile recommends documenting system context and output limitations and tracking and documenting AI use.
3. Name the people who can approve or escalate
Assign a marketing reviewer who has authority to edit or reject the copy. Do not treat a tool’s output, an automated score, or a vendor’s delivery service as approval. Route issues to the person qualified to decide them:
- Legal or compliance: questions about advertising claims, disclosures, or applicable email rules.
- Privacy: concerns about audience data, personalization, or information entered into an AI tool.
- Product or subject-matter owner: uncertain specifications, availability, performance, or offer terms.
NIST’s AI Risk Management Framework calls for clear, differentiated responsibilities in human-AI oversight. Its Core also notes that documentation can improve transparency, human review, and accountability. Make the escalation path and decision owner explicit.

4. Review the email in layers
Check the brief, audience, and purpose
Confirm that the message serves the stated campaign goal and is appropriate for its intended recipients. Look for invented context, an unsuitable tone, or copy that promises something outside the offer. Check personalization for relevance and make sure it does not reveal information the recipient should not see.
Substantiate every material claim
Verify factual, comparative, performance, pricing, discount, and deadline claims against approved evidence and current terms. A fluent sentence is not evidence. If a claim cannot be substantiated, remove it, qualify it accurately, or pause the email until the responsible owner resolves it.
Test the links and action
Open the destination links and confirm that the landing page matches the email, the offer is still available, and the call to action leads where it says it will. Check that tracking or personalization has not produced a broken or inappropriate URL.

Apply the relevant email-compliance checks
Rules vary by jurisdiction and message type. For U.S. commercial email, the Federal Trade Commission’s CAN-SPAM Act compliance guide says messages must use accurate routing information and non-deceptive subject lines, identify advertising where required, include a valid physical postal address, and provide a clear way to opt out. Opt-outs must be honored within 10 business days, and the mechanism must be able to process requests for at least 30 days after sending, according to the FTC guide checked October 4, 2026.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesThe FTC says the Act covers commercial messages whose primary purpose is commercial advertising or promotion, including business-to-business messages; it is not limited to bulk email. A message that mixes transactional and promotional content is classified by its primary purpose. The subject line and whether transactional information appears mainly at the beginning can affect that assessment. Do not assume that an existing customer relationship makes a message transactional.
Using an email service provider does not shift all responsibility away from the marketer. The FTC guide says both the company whose product is promoted and the company that sends the message may be responsible. Keep an accountable sender-side approver in the workflow even when another provider handles delivery. 5. Approve and preserve the final version
Record the campaign identifier, final copy, reviewer, approval time, material changes, and linked substantiation or escalation decisions. Make the approved version identifiable in the campaign system, and require renewed review if someone changes it afterward. This prevents a last-minute edit from bypassing the release gate.
NIST’s AI Risk Management Framework describes documentation as a way to support human review and accountability. The framework’s Govern, Map, Measure, and Manage functions are iterative and can be used according to an organization’s resources and needs; it is not a certification or guarantee that an email is accurate or compliant.

6. Choose review depth according to risk
Not every email needs the same level of scrutiny. Use these factors to decide whether a routine marketing review is enough or whether a specialist and additional evidence are needed:
Best Value
- Impact of an error: Could a false claim, disclosure, or personalization mistake materially mislead or harm recipients?
- Evidence burden: Does the email make technical, comparative, health-related, financial, or performance claims that require careful substantiation?
- Audience sensitivity: Could the audience’s circumstances make an error or disclosure especially consequential?
- Data exposure: Does the draft use personal, confidential, or otherwise sensitive information?
- Offer complexity: Are eligibility, exclusions, pricing, or deadlines difficult to communicate accurately?
- Reversibility: Can the send be corrected quickly, or would recipients act on the message before a correction could reach them?
Higher-risk campaigns warrant more evidence checks, specialist escalation, and explicit approval. This is a risk-management approach, not a promise that more review eliminates mistakes.
7. Use this pre-send checklist
- Is one named person accountable for approving the campaign?
- Does the email match the brief, audience, offer, and current product terms?
- Can the reviewer substantiate every material factual or comparative claim?
- Are personalization and data use appropriate for the recipient and permitted by the workflow?
- Are sender details, subject line, disclosures, address, links, and opt-out method correct for the applicable jurisdiction and message type?
- Is the approved final version identifiable, with later changes routed back for review?
- Can the organization trace who reviewed what and when?
- Is there a clear path to report and correct a post-send error?
8. Monitor the campaign after sending
Review operational problems and incidents such as incorrect claims, broken links, unexpected personalization, or opt-out failures. Route reported errors to an owner who can assess the issue and take appropriate corrective action. Feed what happened back into templates, training, risk tiers, and tool-use rules. NIST treats governance and risk management as ongoing and iterative, rather than a one-time approval.
What workflow software should support
Software is optional; it does not replace an accountable reviewer. When evaluating a workflow or campaign platform, consider whether it supports:
- Access controls and appropriate data handling and retention.
- Approval records, audit trails, and version history.
- Integration with the campaign system without allowing unapproved copy to bypass review.
- A usable experience for reviewers and a way to report incidents.
These are selection criteria, not verified features of any particular vendor. Confirm capabilities and data practices directly before relying on a product.
