The outcome depends on the agreement governing your account, your data flows and settings, and how your organization meets its own obligations as controller.
What SurveySparrow’s public documents establish
SurveySparrow says that when it processes customer data on the customer’s behalf, the customer is the controller and SurveySparrow is the processor. It says it processes that data on documented instructions and points customers to its Data Processing Addendum (DPA) and Terms of Service. This is the vendor’s stated default allocation; legal roles depend on the actual processing relationship. SurveySparrow’s GDPR statement describes that position.

The published DPA, marked effective 27 December 2022, addresses processing instructions, security measures, help with data-subject requests, subprocessors, and international transfers. Its publication does not establish that this version governs your account: check your order form, account terms, and any negotiated documents. The published DPA should be read alongside your actual agreement.

A DPA is therefore an important part of due diligence, but it does not by itself establish that the processor’s guarantees are sufficient for your specific processing or discharge the controller’s obligations. The GDPR text sets out these requirements.

Hosting regions, subprocessors, and transfers
Choose and verify the hosting region
SurveySparrow’s hosting policy lists primary hosting choices in Mumbai, Virginia, Canada Central, Frankfurt, London, Dubai, and Sydney. It says Virginia may be selected by default if a customer does not designate a primary location. Make and document an explicit choice rather than assuming a region was selected for you. The hosting policy describes the choices and default.
A selected region is not proof that every related processing activity remains there. SurveySparrow says customer data may be shared with third-party service providers enabled by the customer. Check how backups and other service data are handled, and trace the data sent to each enabled integration.
Rank #2
Review subprocessors and international transfers
The DPA says SurveySparrow may transfer personal data to the United States and other countries where it or its subprocessors operate, and describes Standard Contractual Clauses (SCCs) and other required measures for restricted transfers. GDPR Chapter V governs international transfers; SCC language in a DPA does not eliminate the need to assess the actual transfer, its parties, destination, and safeguards.

For customers that have executed its standard DPA, it describes a written objection window of ten days after a policy update. Check the current roster and the notice and objection terms in the agreement that applies to your account. The subprocessor policy provides the published details.

What remains your organization’s responsibility
SurveySparrow’s Terms of Service require customers to maintain an appropriate privacy policy and have the rights, permissions, and consents needed to transfer data to the service and enable its processing. The vendor’s own allocation does not determine the legal roles in every situation or transfer all controller duties to the provider. The Terms of Service set out the customer requirements.
Before collecting personal data through the service, your organization should decide and document its lawful basis, explain the processing to people, collect only what it needs, set retention and deletion rules, control access, and plan how it will answer data-subject requests. These are questions about your own use and configuration, not matters settled simply by choosing SurveySparrow.

Due-diligence checks before using it for personal data
- Confirm the governing contract. Identify the DPA and service terms incorporated into your account. Check that they describe the processing, data types, purposes, and assistance your use requires.
- Record the hosting choice. Select and document a primary region, then verify any contractual conditions and how backups or other service data are handled.
- Map providers and integrations. Review the current subprocessor roster, each provider’s purpose and location, and the applicable notice and objection process. Identify integrations you enable and whether they receive personal data.
- Assess transfers. For each international data flow, identify the exporter, importer, destination, and transfer mechanism, then assess whether the applicable GDPR conditions and safeguards are met.
- Document your controller practices. Set your lawful basis, notices, data-minimization rules, retention and deletion schedule, access controls, and data-subject request process.
- Request relevant assurance materials. Ask SurveySparrow for current evidence relevant to your procurement and risk review. Public statements and contract documents are not an independent audit of every control or account configuration.
What the public evidence cannot confirm
The available public materials are primarily SurveySparrow’s own statements and contract documents. They describe a processor framework, hosting options, subprocessors, and transfer provisions, but do not independently verify every account’s settings or data flows. Current policies may change, and an existing customer’s governing DPA or terms may differ from the public versions. An account-specific contract review and technical assessment are needed to determine whether a particular deployment meets your requirements.
