How to Assess Privacy Risks in Cloud and AI Services for Government Contracts

A practical assessment workflow for cloud and AI services used in government work: classify the data, verify the offering, inspect information flows and contract terms, and document ongoing oversight.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assess a cloud or AI service against the specific government work, information, configuration, and contract—not just the provider’s brand or certification. First identify what data the service will handle and what the award requires. Then verify the exact service offering, trace where information goes, confirm who operates each control, inspect the contract’s privacy and incident terms, and document approval and ongoing monitoring. FedRAMP certification can provide reusable security evidence, but it does not authorize every agency to use a service for every purpose.

Start with the information and the contract

Read the solicitation, award, task order, and incorporated clauses before deciding whether a service is suitable. Record the agency and contracting authority, the work being performed, the information involved, and any limits on access, location, or use. “Government data” is not a single risk category: a service handling public information raises different questions from one that processes personally identifiable information (PII), Controlled Unclassified Information (CUI), or covered defense information.

Determine which rules actually apply to the information and contract. NIST SP 800-171 Rev. 3 addresses protection of CUI in applicable nonfederal systems and is intended for agencies to use in agreements with nonfederal organizations. Its requirements apply to system components that process, store, or transmit CUI, or protect those components, subject to the publication’s scope and exceptions. Do not assume that every government contract involves CUI or that every cloud service is subject to the same requirements.

FedRAMP applicability is also use-specific. Agency guidance says agencies must apply FedRAMP when acquiring cloud services to create, collect, process, store, or maintain federal information on the agency’s behalf unless an exclusion applies. Relevant considerations include whether the service handles sensitive federal information, requires an agency-specific tenant or central administration, integrates with agency enterprise security, or could be reused by other agencies. The same provider or product can be in scope for one use and out of scope for another. See FedRAMP’s scope guidance.

Verify the exact cloud offering and authorization

Ask for evidence about the specific service, tier, and environment proposed for the work. A provider’s general FedRAMP status does not establish that every product, feature, deployment, or configuration is covered. Review the offering’s certification scope and package, including inherited controls, provider responsibilities, secure-configuration guidance, and available ongoing monitoring information. Compare those details with the information, mission, integrations, and risk tolerance for the actual use.

FedRAMP describes certifications as reusable security evidence, while leaving agencies responsible for authorizing their own systems. Its 2026 agency guidance puts it directly: “Agencies use FedRAMP Certifications as reusable security evidence, but each agency still authorizes its own federal information systems.” The agency must assess and document its own system and use—including its data, configuration, integrations, and controls—and complete its authorization before use. FedRAMP’s agency-use guidance explains the distinction.

Trace information through cloud and AI components

Map the full information path, from users and endpoints through the cloud service, AI model, plug-ins, retrieval sources, telemetry, support operations, backups, and subcontractors. For each stage, note what is sent, why, who receives it, where it is handled, how long it remains, whether it can be transferred onward, and how it is deleted. Include information created along the way, such as prompts, uploaded files, outputs, feedback, logs, and information derived from customer data.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Questions for AI features

  • Are prompts, files, outputs, feedback, or derived information retained? For what purpose and for how long?
  • Can any of that information be used to train or improve a model? Does the answer differ for the customer’s tenant, the provider, or a third party?
  • How is one customer’s data separated from other customers’ data? Can model information derived from customer data leave the customer environment, and is customer authorization required first?
  • Do plug-ins, retrieval sources, external APIs, analytics, or support tools receive inputs or outputs? What terms and controls apply to those recipients?
  • Can administrators disable or restrict features that send information outside the approved environment?

FedRAMP’s AI criteria address enterprise features and data separation and protection, including whether model information from training on customer data can leave the customer environment without customer authorization. These are useful diligence questions, not proof that an arbitrary AI service or a particular configuration meets them.

Third-party connections deserve explicit attention. NIST’s Generative AI Profile initial public draft warns that third-party generative-AI integrations can increase intellectual-property, privacy, and information-security risks, and calls for clear transparency and risk-management guidelines for collecting and using third-party data as model inputs. That statement is from the NIST AI 600-1 initial public draft; check whether a later final publication has superseded it before treating the draft as current guidance.

Assign control responsibilities instead of assuming them

A provider’s certification package is not the agency’s authorization or control plan. For every relevant security and privacy control, identify who configures it, who operates it, who monitors it, and what evidence the agency receives. FedRAMP directs agencies to document controls they implement, configure, operate, or inherit.

Control area Questions to assign and verify
Identity and access Who provisions users, enforces roles and authentication, reviews privileges, and removes access when it is no longer needed?
Data protection and configuration Which protections and settings are inherited from the provider, and which must the agency or contractor configure and maintain?
Logging and monitoring Who collects and reviews logs, detects suspicious activity, and supplies monitoring or vulnerability information to the agency?
Incident response Who reports an incident, preserves evidence, coordinates investigation, and provides information needed for impact assessment?
Privacy, records, and integrations Who governs permitted data use, retention and deletion, records handling, external connections, and changes to those arrangements?

Use the answers to create a control-responsibility matrix for the proposed deployment. The allocation must reflect the actual service configuration and contract; a label such as “shared responsibility” is not enough to show that a control is covered.

Check whether the contract makes the protections enforceable

Review the actual clauses and service terms that govern the proposed use. Confirm that the provider’s promises cover the government information and service components involved, and that subcontractors are bound where necessary. Resolve gaps before data is sent to the service rather than relying on an informal assurance.

  • Authorized use and disclosure: Is information limited to contract-authorized purposes? Are government-related data and service telemetry barred from unrelated use unless the contract permits it?
  • Retention, return, and deletion: What happens at contract end or on direction from the agency? Do the rules address backups and copies as well as active systems?
  • Location and access: Are there geographic, personnel-access, or other location restrictions? Are exceptions defined?
  • Incident notice and cooperation: What event triggers notice, how quickly must it be reported, by what method, and what information or assistance must follow?
  • Audit, records, and forensics: Can the government inspect relevant evidence or systems and obtain records needed to investigate an incident?
  • Subcontractors and ongoing oversight: Are downstream providers covered by equivalent duties? What monitoring reports, vulnerability information, and remediation commitments must be provided?

Agency clauses can be more specific than general provider terms. For example, the Department of Transportation’s cloud clause on Acquisition.gov limits access to, use of, or disclosure of government data to what the contract authorizes; restricts use of government-related data without prior written approval; calls for continuous monitoring and government audit access; and requires reporting cloud-related cyber incidents within two hours of discovery. It also includes a U.S. data-location term with an exception. Those are terms in a particular DOT clause, not universal federal requirements.

For covered defense information, the cited DFARS clause requires a contractor using an external cloud provider to store, process, or transmit that information to require security requirements equivalent to the FedRAMP Moderate baseline and specified cooperation for reporting, malware, media preservation, forensic access, and damage assessment. Confirm the clause and version incorporated into the actual contract; do not apply it solely because work is government-related.

Compare candidate services on the same evidence

There is no universally best cloud or AI vendor for government work. Compare each candidate using the same use case, data classification, deployment assumptions, and contract requirements so that differences are visible rather than hidden behind broad product claims.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Comparison area What to establish for each candidate
Offering and evidence Exact service, tier, environment, certification scope, inherited controls, and freshness of monitoring evidence.
Information and mission fit Types and sensitivity of information handled, impact of exposure or loss, and whether the proposed use fits the agency’s requirements.
Configuration and integrations Required settings, identity and enterprise-security integrations, AI features, plug-ins, and external data paths.
AI data handling Input and output retention, training use, tenant separation, derived information, and third-party handling.
Control ownership Provider, agency, and contractor duties for access, protection, logging, monitoring, response, records, and privacy.
Contract protections Authorized use, location, deletion, incident cooperation, audit access, subcontractor obligations, and remediation commitments.

Record the decision and keep it current

Keep an auditable assessment record that another reviewer can use to understand why the service was approved or rejected. Include the use case and data inventory, FedRAMP scope decision, provider evidence and review date, AI data-use answers, data-flow diagram, contract-clause matrix, control-responsibility matrix, unresolved issues, compensating controls, approval owner, and monitoring schedule.

Monitoring should match the system’s risk. FedRAMP identifies ongoing certification reports, vulnerability information, quarterly reviews, and other certification data as inputs agencies should monitor at intervals appropriate to that risk. Reassess when the service, configuration, integration, data, contract, or certification evidence changes. General cloud security and privacy context is also covered in NIST SP 800-144, Guidelines on Security and Privacy in Public Cloud Computing.
