How to Assess Data-Sharing, Access, and Publication Restrictions Before Joining a Research Network

Before joining a research network, test your exact project against its access, data-sharing, publication, governance, authorship, IP, and termination rules. This checklist shows what to obtain, compare, calendar, and clarify.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before you join a research network, obtain its current agreement, access rules, publication policy, code of conduct, dataset addenda, and transfer or confidentiality terms. Then test your actual project—question, methods, collaborators, linkage plans, outputs, and future uses—against those documents. Membership rarely grants unrestricted access or an automatic right to publish. The practical decision is whether the network’s permissions, controls, review calendar, attribution rules, intellectual-property terms, and exit duties fit your project and your institution’s obligations.

Start with the permissions that govern your specific project

Network rules are usually purpose- and project-specific. A researcher may be eligible to join a community but still need a separate application for a particular dataset, project, or output. Treat “membership,” “data access,” and “permission to publish” as three separate questions until the governing documents say otherwise.

Write a one-page description of the work you want to do before reading the agreement in detail. Include the datasets, samples, metadata, code, materials and derivatives you expect to use; the scientific question; methods; named collaborators; any record linkage; whether a commercial partner is involved; expected presentations and papers; and possible follow-on studies. You can then compare each element with the permitted-use language instead of relying on a general invitation or an informal email.

Documents to obtain and date

Ask the network for the latest versions of every document that could control your work. Record the version or publication date and keep the copies that applied when you joined.

Document What it may control Questions to answer
Membership or institutional agreement Eligibility, signatories, responsibilities, fees, continuing duties Who is bound, and does membership itself confer any data right?
Access policy and application form Approved users, project scope, review authority, renewals Which people and purposes must be named?
Dataset addendum or data-use agreement Specific fields, samples, restrictions, onward transfer, retention Are secondary use, linkage, commercial work, or new collaborators allowed?
Publication policy and code of conduct Notice, pre-publication review, acknowledgements, presentations, media When must a manuscript or abstract be submitted, and what can the network review?
Transfer, confidentiality, or security terms Storage, access controls, incident reporting, deletion Where may data be processed, and what happens after an incident or departure?
Institutional policies Ethics, privacy, information security, contracts, technology transfer Which local approvals and signatories are required before acceptance?

If two documents conflict, do not select the more convenient wording. Ask the network and your institutional contracts or research-governance office which document controls, whether an amendment is required, and whether a written clarification will be attached to the agreement.

1. Define the data, outputs, and permitted purpose

“The network data” is often too broad a description for a contract. Make an inventory of the exact source datasets, samples, variables, images, metadata, software, models, derived tables, and aggregate results that may be covered. Include data you create by linking a network dataset to another source and any trained model or code that could reveal information about the underlying records.

Match your question to the use statement

Compare your proposed question and methods with the agreement’s permitted research-use statement. A permission may cover a named project, disease area, population, or analysis plan rather than all work by a member. NIH’s Data Use Certification model illustrates the point: a Data Access Request identifies the requested data, planned research use, named collaborators, and project scope. A dataset addendum can impose additional limits and identify the responsible Data Access Committee.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask these questions in writing:

  • Does the permission cover exploratory analyses, validation, teaching, or only the named study?
  • Is a new application or amendment required for a secondary question, new method, additional collaborator, record linkage, or follow-on project?
  • Can a contractor, student, or commercial partner see the data or only aggregate outputs?
  • May you retain code, models, summary statistics, or other derivatives after the project ends?
  • Does the permission cover presentations, preprints, press releases, software releases, and regulatory submissions as well as journal articles?

Do not confuse an invitation with project approval

Genomics England’s access sequence is a useful example of why the distinction matters: an institution enters an Access Agreement, applies to a research community, completes information-governance training, and then submits a project proposal or joins an existing project. The sequence is specific to that program, but the decision principle is general. Ask exactly which step you have completed and which approval remains outstanding.

2. Map who can approve access and who can use it

Identify every decision-maker before you promise a start date. Depending on the network, access may require an institutional signatory, a data-access committee, a project board, an ethics body, a privacy officer, or a security review. The agreement should say whether approval is discretionary, what criteria are applied, and whether approval attaches to a person, institution, project, or environment.

Build an access-role map

List the principal investigator, analysts, students, administrators, data stewards, external collaborators, and service providers. For each person, record the permitted role, the data they may see, the training required, and the date access expires. NIH agreements commonly place institutional responsibility on the signing organization for approved users and their compliance; do not assume an individual researcher can transfer access when moving institutions.

Separate technical safeguards from substantive restrictions

A controlled workspace, multifactor authentication, logging, or removal of direct identifiers is a technical safeguard. A ban on commercial use, onward transfer, or a particular research purpose is a substantive restriction. Record them separately because they create different risks and different routes for resolving a problem.

For every access control, ask:

  • Who authorizes access and who can suspend it?
  • What evidence must an applicant provide?
  • How long does review normally take, and is there an appeal or amendment route?
  • Can data be downloaded, or must all analysis occur in a controlled environment?
  • Are derived files, model weights, code, or screenshots treated as exports?
  • What happens if an export or collaborator request is rejected?

Use the network’s environment and export process exactly as written

Genomics England’s Code of Conduct requires projects to be registered and approved before analysis and subjects exports to an Airlock review process. It also allows the organization to halt an export when agreement or conduct requirements are not met. This is an example of a program-specific control, not a universal rule. Confirm whether review covers only disclosure risk or also file format, statistical content, interpretation, or timing.

3. Check privacy, ethics, security, and institutional duties

Network permission does not replace local obligations. Before signing, ask your research-ethics, privacy, information-security, contracts, and technology-transfer offices which reviews apply. Personal or confidential data may require a data-protection assessment, ethics determination, secure-processing plan, or formal data-sharing agreement even when the network has approved the project.

Clarify accountability

Find out who is responsible for staff, collaborators, accounts, devices, and incident reporting. Check training requirements, logging, password and multifactor rules, approved storage locations, encryption, vulnerability reporting, and the deadline for notifying the network of a suspected breach. Confirm whether your institution must approve subcontractors or cloud services before they handle data.

Plan for renewal and monitoring

Some programs require evidence of ongoing activity to maintain membership or access. Genomics England’s example includes information-governance training and continuing project-activity requirements. Ask whether the project expires, how renewal works, whether inactive accounts are disabled, and whether the network may audit logs or inspect compliance records.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Understand data-sharing duties and lawful exceptions

Ask four separate questions: what must be shared, when it must be shared, where it must be deposited, and who may obtain it. Include the underlying data, metadata, code, materials, protocols, and documentation needed to reproduce a reported result. A publication obligation may be broader than the data you can legally release.

Identify the reason for every restriction

The UKRI Medical Research Council states: “Data must be made available with as few restrictions as possible, to maximise the value of the data, improve research reproducibility and for patient and public benefit.” That policy also requires appropriate governance and a data-sharing agreement for personal or confidential data. Ask whether a restriction is required by consent, privacy, security, law, a third-party licence, or a network decision, and whether it is limited to the smallest necessary dataset or period.

Network-science recommendations similarly frame the issue as a choice between sharing data and materials openly or with restrictions. Restrictions can be justified to prevent harm, comply with regulation, protect privacy, or honor third-party terms. A controlled-access repository, request committee, secure analysis environment, or documented application route may provide a lawful alternative to open release.

Make the access statement specific

Ask what your paper must say about data availability. The MRC policy expects a data-access statement that lets readers understand how to obtain the underlying data and that complies with applicable open-access requirements. If direct release is prohibited, the statement should identify the repository or request route, eligibility conditions, and any reason a reader cannot receive unrestricted access.

Calendar the release deadline

For the NIH policy guidance cited in the materials, shared scientific data should be accessible as soon as possible and no later than the associated publication or the end of the performance period, whichever comes first, within that policy’s scope. Treat this as a policy-specific deadline. Consent, law, a dataset addendum, or a network agreement may require a controlled route or impose a different schedule.

5. Read publication review rules before beginning analysis

Publication review can affect both your calendar and your editorial independence. Locate rules for manuscripts, abstracts, posters, talks, preprints, press statements, websites, code releases, and other communications that mention or use network data.

Record the notice and review timetable

Genomics England’s July 2025 Code of Conduct requires manuscripts and other research communications involving or referencing NGRL data to be submitted for review at least 10 working days before external peer review or public presentation. The same code requires members to comply with the organization’s Publication Policy. This is an example-specific lead time; it is not a general deadline for every research network.

Ask whether the review is advisory or a condition of release, what materials must accompany the submission, whether the clock pauses when revisions are requested, and what happens if the network does not respond. Calendar internal review, committee meetings, holidays, journal deadlines, conference submission dates, and any embargo separately.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Define what the network may review

Determine whether reviewers may check only confidentiality and disclosure risk or may also comment on methods, interpretation, wording, authorship, or timing. Ask whether they can require changes, delay release, or stop publication, and what appeal or dispute process exists. A confidentiality review and a scientific veto are materially different powers; the agreement should make the distinction clear.

Check presentations and public discussion

Some rules apply to a conference abstract or public presentation as well as a paper. Confirm whether you must notify the network before a talk, media interview, preprint, dataset release, or social-media discussion. Ask whether de-identified figures, screenshots, model outputs, or aggregate statistics count as network data.

6. Set authorship, contributor, acknowledgement, and citation terms

Resolve credit before the work is underway. Identify who qualifies for authorship under the relevant journal standard, who must be listed as a group author, and who belongs in a contributor or acknowledgement list. Do not leave these decisions to the final week before submission.

Capture required acknowledgements and identifiers

NIH’s Data Use Certification agreement illustrates a detailed acknowledgement requirement: resulting presentations and publications may need to acknowledge submitting investigators, funders, the NIH-designated repository, and the dataset accession and version. Record the exact names, grant numbers, repository names, accession identifiers, and wording required by your program.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Document contributor arrangements in the application

The ERN-RND policy gives another model: an application can include publication-agreement information such as authorship, with involved healthcare professionals named in a contributor list. This mechanism differs from NIH’s acknowledgement approach. Use the rule that governs your network, and obtain written approval for any change in contributors or author order.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

7. Resolve exclusivity, intellectual property, and follow-on research

Ask whether the network grants an exclusive-use period, who receives it, how long it lasts, and what objective justifies it. The MRC policy recognizes that a limited, defined period can allow a primary team to realize benefits such as publications and patents, but planned exclusivity should be stated and justified. An undefined or renewable “first right” can delay your publication and later sharing, so request a start date, end date, scope, and end condition.

Identify ownership and licensing

Determine who owns new inventions, software, databases, models, protocols, and other intellectual property created with network data. Ask whether the network receives a licence, whether your institution’s standard policy applies, and whether commercialisation requires notice or consent. Clarify whether pre-existing code and materials remain yours and whether network data may be embedded in a product or training set.

Plan follow-on work

Find out whether a new question, new dataset, new institution, or commercial partner requires a fresh application. Ask who controls access to shared data and who resolves competing requests. NIH and National Center for Advancing Translational Sciences consortium guidance recommends written arrangements covering data stewardship, user categories and agreements, publication and authorship, intellectual property, and conflict resolution. Use those topics as a minimum agenda even when your network uses different terminology.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. Know what happens when the project ends or access changes

Exit terms are as important as entry terms. Ask what happens when you leave the institution, the project closes, the agreement expires, the network revokes access, or the dataset is withdrawn.

  • Must source data, copies, backups, exports, and derivatives be returned or deleted?
  • May you retain analysis code, aggregate results, published figures, or an audit record?
  • Does confidentiality continue after deletion or departure?
  • Can an already submitted or accepted paper proceed after access is revoked?
  • Do acknowledgement, citation, incident-reporting, or data-sharing duties continue?
  • Who certifies deletion, and what evidence must be retained?

General policy statements do not establish one universal exit rule. Obtain the actual agreement and ask the network and institutional signatory to explain how the clauses operate in your situation.

9. Compare networks on the same proposed project

If you are choosing between networks, use one project description and one scoring sheet. A network with fewer visible restrictions may still impose longer institutional review or weaker support for secure access. Compare the complete operating model, not just the headline promise of access.

Comparison axis Evidence to record Decision question
Research scope and secondary use Permitted purpose, amendment triggers, linkage and commercial-use clauses Will the permission survive the project’s likely evolution?
Approval authority and time Committees, signatories, criteria, review and appeal timelines Can the project meet its funding and publication deadlines?
Access setting and exportability Workspace, download rules, export review, derived-output treatment Can analysts perform the needed work and release valid outputs?
Sharing and derivative restrictions Repository, licence, controlled-access route, retention and deletion Can you meet funder and journal data-availability requirements?
Publication review Notice period, review scope, approval condition, embargo and appeals Is the process a confidentiality check or a potential publication veto?
Credit and authorship Required acknowledgements, accession versions, group authorship, contributors Can credit be agreed before analysis starts?
Governance and accountability Training, monitoring, incidents, renewals, institutional duties Can your institution operate the controls reliably?
Exclusivity and intellectual property Exclusive-use period, ownership, licences, commercialisation and follow-on rules Are future products and collaborations still possible?
Closure and termination Revocation, deletion, code retention, continuing confidentiality and publication duties What survives when access ends?

A controlled-access genomic resource may require project approvals and export review, while a general repository policy may emphasize broad, nondiscriminatory access. Neither model is automatically better; suitability depends on the sensitivity of the data and the work you need to do.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

10. Use a pre-join decision procedure

  1. Describe the project. List datasets, fields, samples, methods, collaborators, linkage, outputs, future uses, and possible commercial involvement.
  2. Collect the governing documents. Obtain the current membership agreement, access policy, dataset addenda, publication policy, code of conduct, transfer terms, and institutional guidance. Record dates and versions.
  3. Mark permission boundaries. Highlight purpose, approved users, location, onward transfer, export, retention, sharing, and publication clauses. Note every amendment trigger.
  4. Map approvals. Name network committees, institutional signatories, ethics or privacy reviewers, security officers, contracts staff, and technology-transfer contacts.
  5. Build the calendar. Add access review, training, project registration, export review, publication notice, conference deadlines, repository release, renewal, and deletion dates.
  6. Agree credit and rights. Put authorship, contributor lists, acknowledgements, citations, exclusivity, intellectual property, licences, and follow-on use in writing.
  7. Test an output. Ask the network how a representative table, figure, model, code package, abstract, and press statement would be reviewed or released.
  8. Resolve ambiguity before signing. Send unclear or conflicting clauses to the network and your institutional contracts, research-governance, privacy, security, or technology-transfer office. Keep the written answer with the agreement.
  9. Accept only with an exit plan. Confirm deletion, derivative retention, continuing confidentiality, publication after termination, and certification requirements.

Warning signs that require clarification

  • The invitation promises “full access,” but no dataset, project, user, or purpose is named.
  • A publication clause uses “approval” without saying whether review is limited to confidentiality or can alter scientific content.
  • An export process has no stated criteria, response time, appeal route, or treatment of derived data.
  • Secondary research, linkage, commercial involvement, or new collaborators are not addressed.
  • An exclusivity or embargo period has no end date or objective justification.
  • Authorship and acknowledgements are deferred until after analysis.
  • The agreement requires open sharing even though consent, privacy, law, or third-party terms may prevent it, with no controlled-access alternative.
  • Termination requires deletion but does not explain how published results, code, backups, or audit records are handled.
  • Different documents use inconsistent definitions of “data,” “output,” “user,” “publication,” or “confidential information.”

Questions to send the network before you accept

  1. Which exact datasets and derivatives does this agreement cover, and what purposes are permitted?
  2. Is membership separate from project approval, and what step remains for this project?
  3. Who can approve users, amendments, exports, publications, and exceptions?
  4. Where must analysis occur, and which files or outputs require review before release?
  5. What are the notice periods for manuscripts, abstracts, talks, preprints, media, and software?
  6. Is review advisory or mandatory, what can it consider, and how can a disagreement be appealed?
  7. What data, code, materials, and documentation must be shared, through which repository or request route, and by what deadline?
  8. What acknowledgements, accession versions, citations, authorship, and contributor listings are required?
  9. Are there exclusivity, intellectual-property, licensing, commercialisation, or follow-on-use limits?
  10. What happens to data, derivatives, code, confidentiality, and publication rights when a person leaves or the project ends?

Bottom line for a go/no-go decision

Join only when you can explain, in writing, what you may use, who may access it, where analysis must occur, what can leave the environment, how data and code must be shared, when publications must be submitted, who receives credit, and what survives termination. The Genomics England 10-working-day example, NIH’s project-specific access and data-sharing terms, MRC’s preference for minimal restrictions with appropriate governance, and consortium guidance on stewardship and intellectual property all point to the same practical discipline: evaluate the actual agreement against the actual project. If a material term remains ambiguous, pause acceptance and obtain a written interpretation from both the network and the institution that will sign.
