The clearest examples are the withdrawal of a proposal for new disruption benefits and temporary pauses in enforcing certain refund and wheelchair-accessibility requirements. Each action has a different legal status and scope.
What airline passenger rights have changed?
As of October 9, 2026, the changes include one withdrawn rulemaking proposal, two temporary enforcement pauses, and one fare-advertising proposal that had not become final. The distinctions matter: withdrawing a proposal means its contemplated protections were never adopted; enforcement discretion delays enforcement of specified rules without repealing them; and a proposed rule is not yet in effect.

| Action | Status and date | Who and what it affects | What remains |
|---|---|---|---|
| New benefits after major disruptions | DOT withdrew its December 2024 advance notice of proposed rulemaking in September 2025. | Passengers affected by significant disruptions. The notice had explored possible cash compensation, free rebooking, meals, overnight lodging and transport to lodging, as well as rebooking for some passengers whose disability-related needs were not met after an itinerary change. | Those benefits were possibilities under consideration, not enacted entitlements. Existing refund rights remain. |
| Refund treatment of a flight-number change | Temporary enforcement pause, extended in July 2026 through July 7, 2027. | Passengers rebooked onto a renumbered flight that operates without a significant change or delay. | DOT says standard refund requirements remain enforceable when the renumbering comes with a significant delay or disruption. |
| Specified wheelchair-related requirements | Enforcement discretion extended in August 2026 through April 30, 2027 for specified provisions. | Wheelchair and scooter handling, certain training duties, advance complaint information, and a specified fare-difference reimbursement requirement. | DOT said the notice did not affect other requirements of the wheelchair rule. |
| Prominence of airfare taxes and fees | Proposed rule issued in July 2026; not a final rule as of October 9, 2026. | Airlines’ display of separately stated airfare components such as taxes and fees. | The proposal retains disclosure of the total fare. Its proposed change should not be treated as an effective repeal. |
Why did DOT withdraw the proposed disruption benefits?
In September 2025, the U.S. Department of Transportation (DOT) withdrew its December 2024 advance notice of proposed rulemaking on Airline Passenger Rights. The notice had invited discussion of possible minimum benefits when a major disruption leaves travelers stranded, including compensation and services such as rebooking, meals, lodging and transport to lodging. Because these were under consideration rather than adopted rules, the withdrawal means that proceeding will not establish those new requirements as proposed.
DOT said it interpreted section 512 of the FAA Reauthorization Act of 2024 as authorizing reimbursement policies for listed meal, lodging and ground-transport expenses, but not broader mandatory compensation and services. The agency also cited the administration’s deregulatory approach and statutory factors favoring competition. That is DOT’s stated legal interpretation and policy rationale, not a court ruling that settled the question of its authority.

The withdrawal notice recorded opposing positions. Airline groups argued that mandates could raise costs, reduce service and exceed DOT’s authority. Consumer advocates and individual commenters supported stronger requirements, arguing voluntary airline commitments could be withdrawn or communicated poorly. The notice reported commenters’ statement that no large U.S. airline guaranteed cash compensation at that time; that is a claim recorded in the 2025 notice, not a verified description of airline policies today.
Can you still get a refund if your flight is canceled or changed?
Yes. DOT’s current consumer guidance continues to describe a refund when an airline cancels a flight or makes a qualifying significant change and the passenger declines to travel or accept a credit, voucher or other alternative. Its examples include:

- Arrival at least three hours later on a domestic itinerary or six hours later on an international itinerary.
- Departure at least three hours earlier domestically or six hours earlier internationally.
- A different origin or destination airport, an additional connection point, or an involuntary downgrade.
- For a passenger with a disability, a change to a connecting airport or a substitute aircraft that lacks needed accessibility features.
For qualifying tickets purchased directly from an airline, DOT guidance says the airline must automatically refund a passenger who rejects the alternative within seven business days for a credit-card purchase or 20 business days for a cash purchase, after the airline learns of that decision. A passenger who travels on the changed flight generally is not entitled to a full ticket refund. If the passenger is involuntarily downgraded, the fare difference is refundable; fees for ancillary services that were unavailable may also be refundable.
The 2024 refund rule established the regulatory framework, while DOT’s consumer-facing guidance explains how the agency describes it for travelers. DOT says its guidance is informational and does not itself have the force and effect of law.

What happens if the airline changes your flight number?
The 2024 refund rule treats an originally ticketed flight assigned a different flight number as a cancellation for refund purposes. DOT temporarily paused enforcement of specified refund and notification requirements in December 2025 when a passenger is rebooked onto that renumbered flight and it operates without a significant change or delay. In July 2026, DOT extended the pause through July 7, 2027 while its Refund III rulemaking remains pending.
This is an enforcement pause for a narrow situation, not a repeal of the general refund rule. According to DOT’s July 2026 notice, the pause does not apply when the flight-number change accompanies a significant delay or disruption. The notice also says other protections remain in place, including free rebooking when a smaller replacement aircraft can no longer accommodate a passenger’s wheelchair or scooter.

What protections remain for passengers who use wheelchairs?
The wheelchair rule issued in December 2024 expanded airline requirements concerning staff training, assistance with boarding and deplaning, movement through terminals, and mishandled wheelchairs and scooters. It took effect January 16, 2025, with different implementation dates for individual provisions.
DOT’s August 2026 notice extended enforcement discretion through April 30, 2027 for specified requirements:

- Airline liability for mishandled wheelchairs.
- The frequency of refresher training.
- Pre-departure notice to passengers checking a wheelchair or scooter about contacting a Complaint Resolution Official and filing a claim.
- Reimbursement of fare differences in a specified wheelchair-related circumstance.
- The annual hands-on flight-attendant training mandate for onboard wheelchair assistance and lavatory accessibility.
The delay is consequential for the requirements listed, but it does not suspend every disability-related rule. DOT said other requirements were unaffected by the August notice, and its July flight-number notice separately said free rebooking remains available when a smaller aircraft cannot accommodate a wheelchair or scooter.
What does DOT’s complaint record show?
A DOT Office of Inspector General audit provides oversight context, not proof that a particular policy change was made for a specific reason. The Inspector General reported more than 139,000 refund complaints in 2020–2022, compared with 1,568 refund complaints among 15,332 total complaints in 2019. The audit, published in 2025, also said that as of April 2025 DOT had not resumed analyzing airline responses to complaints. It found DOT relied on airline self-certification, without verifying refund data, when assessing credits and offsets to civil penalties. The report said DOT had assessed more than $155 million in penalties against 14 airlines without verifying that data.
These figures describe the periods and oversight process identified by the Inspector General. They are not 2026 complaint totals and do not establish a motive for the administration’s later actions.
What does the airfare-advertising proposal do?
In July 2026, DOT proposed relaxing the prominence requirement for separately displayed airfare components, such as taxes and fees, so those components could appear as prominently as the total fare. The proposal retained a requirement to disclose the total fare. DOT extended the comment deadline to August 21, 2026. As of October 9, 2026, the measure was identified as a proposal, not an effective final rule.
How to read the overall change
The strongest supported description is that the administration has reduced the prospect of new federal benefits after disruptions and postponed enforcement of selected refund and accessibility provisions. It has not broadly rescinded the 2024 refund rule: DOT still describes refund rights for cancellations and significant changes, subject to the temporary, narrow renumbered-flight enforcement pause. Nor does the wheelchair enforcement delay mean every accessibility protection has been suspended. The practical effect depends on which rule, passenger circumstance and date are involved.
