How the GST Council Makes Decisions and Resolves Centre–State Disputes

The GST Council generally seeks consensus, but Article 279A sets a weighted-voting threshold. Its recommendations guide policy without binding governments as legislation, while constitutional provisions address certain Centre–State disputes.

The GST Council usually seeks consensus, but the Constitution provides a weighted-voting fallback: the Union has one-third of the votes cast, the States collectively have two-thirds, and a proposal needs at least three-fourths of weighted votes from members present and voting. Council recommendations guide GST policy but are not binding legislation. Article 279A also requires a mechanism for certain Centre–State disputes, although the constitutional clause alone does not establish how that mechanism currently operates.

What is the GST Council, and what does it decide?

The Goods and Services Tax Council is a constitutional joint forum for the Union and the States. Article 279A establishes it and gives it a recommendation-making role on important parts of the GST system. It coordinates policy; it is not itself a legislature that enacts every GST rule.

The Council’s membership brings together the Union and State governments. It includes the Union Finance Minister, the Union minister of state responsible for revenue or finance, and a minister nominated by each State Government. This structure gives both levels of government a formal place in discussions about a tax system that depends on their respective laws and administration.

Article 279A identifies subjects on which the Council may make recommendations. These include which goods and services may be taxed or exempted, model GST laws, principles for levying GST and determining place of supply, thresholds, the rate structure, special rates during natural disasters or calamities, and special provisions for certain States. The breadth of that remit explains why Council decisions matter: its work concerns the framework governments use when making GST policy, even though a recommendation is not itself an enacted law.

The institutional distinction is important. The Council provides a forum for coordination and makes recommendations. Parliament and State legislatures retain legislative powers under the constitutional scheme. A recommendation may guide later government action, but the Council does not turn it into binding legislation simply by adopting it.

How does the GST Council make decisions?

Consensus is the stated general approach

The Council’s official overview says that it generally follows a consensus-based approach. In practical terms, consensus allows the Union and State representatives to seek a policy position they can support together rather than immediately relying on a formal division of votes. The constitutional voting rule remains available if a proposal is put to a vote; a consensus-oriented practice does not replace or change that rule.

Consensus and voting are therefore different parts of the decision framework. Consensus describes the Council’s general approach. The Constitution supplies the arithmetic for a formal vote. The available constitutional rule does not make consensus a legal prerequisite for every recommendation, nor does it say that a proposal becomes a recommendation merely because participants have discussed it.

The fallback vote is weighted

Article 279A(9), inserted by the Constitution (One Hundred and First Amendment) Act, 2016, sets a weighted voting arrangement. The Union has one-third of the votes cast, and the States collectively have two-thirds. A proposal passes only if at least three-fourths of the weighted votes of members present and voting support it. These are constitutional voting weights, not a description of the number of governments or representatives in the room.

Part of the voting rule What it means
Union weighting One-third of the weighted votes cast belongs to the Union.
State weighting The States collectively hold two-thirds of the weighted votes cast.
Passage threshold At least three-fourths of weighted votes of members present and voting must support the proposal.
Source of the rule Article 279A(9), reproduced in the GST Council’s official overview and agenda material.

The denominator matters: the threshold is measured against weighted votes of members present and voting, not against an unweighted headcount of every State. The Council’s official agenda note also sets out a division procedure and a worked voting illustration. The constitutional fractions, rather than the number of hands raised, determine the result under the formal voting rule.

Can the Union or a State block a vote?

Under the stated weighting and threshold, the Union’s support is mathematically necessary for a proposal to pass in a formal vote. Even if all State votes support it, the States’ combined share is only two-thirds, which is less than the three-fourths needed. This follows from the constitutional arithmetic; it is not a claim about the outcome of any particular meeting.

The same rule does not give a single State a separate constitutional veto in the weighted-vote calculation described here. The States vote collectively with two-thirds of the weighted votes. A particular State’s influence in a specific vote depends on the voting arrangement and who is present and voting; the available rule does not establish a special individual-State blocking power. Nor does the arithmetic mean every disagreement results in a formal vote: the Council generally follows consensus.

For example, if a proposal were put to a vote and every State supported it while the Union did not, the maximum State support would still be two-thirds, short of the three-fourths threshold. Conversely, the rule does not mean Union support alone is sufficient: one-third is also below the passage mark. The threshold is a collective test, not a unilateral power to approve a proposal.

Are GST Council recommendations binding on the Union and States?

No. In Union of India v. M/S Mohit Minerals Pvt. Ltd., decided on 19 May 2022, the Supreme Court held that GST Council recommendations are not binding on the Union or the States. The Court described them as having persuasive value, in a constitutional arrangement where Parliament and State legislatures have simultaneous GST legislative powers.

In paragraph 148(i)(a), the Court reasoned: “The deletion of Article 279B and the inclusion of Article 279(1) by the Constitution Amendment Act 2016 indicates that the Parliament intended for the recommendations of the GST Council to only have a persuasive value, particularly when interpreted along with the objective of the GST regime to foster cooperative federalism and harmony between the constituent units;” The Court’s conclusion distinguishes recommendations from legislation; it does not say that Council recommendations have no practical or political force.

The distinction can be understood by separating three stages:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Recommendation: The Council makes a recommendation on a GST matter within its remit. Its constitutional role is to coordinate and advise, not to enact every rule itself.
  2. Government action: The Union or a State may consider that recommendation when deciding what action to take within its own authority. The recommendation is persuasive rather than legally binding by itself.
  3. Legislation: Where a government acts through legislation, the law derives its legal force from the legislative process and the relevant enactment, not merely from the Council’s recommendation.

This is why “not binding” should not be read as “irrelevant.” A recommendation can be an influential basis for coordinated policy and may underpin later legislative or executive action. But the binding legal effect, where applicable, comes from the subsequent government action or law, not from treating the Council’s recommendation as an enactment.

How are Centre–State disputes over GST addressed?

Article 279A(11) requires a dispute mechanism

Article 279A(11) directs the GST Council to establish a mechanism to adjudicate specified disputes arising out of the Council’s recommendations or their implementation. The constitutional text covers disputes between the Union and one or more States; between the Union and some States on one side and one or more other States on the other; and between two or more States.

The clause establishes a constitutional mandate and identifies the kinds of intergovernmental dispute it concerns. It does not, by itself, tell a reader the mechanism’s current membership, filing requirements, procedure, timetable, or case history. Those operational details cannot be inferred from the mandate alone. Accordingly, it is safer to say that the Constitution requires the Council to establish such a mechanism than to assume a particular body or process is currently available for a specific dispute.

The Supreme Court has a separate original jurisdiction

The Supreme Court separately describes its exclusive original jurisdiction over qualifying disputes between the Union and one or more States, or between States, where the dispute involves a question on which the existence or extent of a legal right depends. Whether a particular GST disagreement meets that description turns on the legal question and facts involved.

This jurisdiction should not be conflated with Article 279A(11). The constitutional dispute-mechanism mandate and the Court’s qualifying original jurisdiction are distinct parts of the framework. The existence of the latter does not, on the information established here, prove that it automatically replaces or displaces the mechanism contemplated by Article 279A(11). Nor does every policy disagreement necessarily amount to a qualifying legal-right dispute for the Court.

What this means when governments disagree

A disagreement can concern policy coordination, the legal effect of a Council recommendation, or the implementation of a measure. Those are not interchangeable questions. The Council’s recommendation-making role addresses coordinated GST policy; Mohit Minerals clarifies that recommendations themselves are persuasive rather than binding; Article 279A(11) addresses a category of disputes arising from recommendations or their implementation; and the Supreme Court’s original jurisdiction applies to qualifying intergovernmental disputes involving legal rights.

  • If the question is whether a proposal passed a Council vote, look to the weighted constitutional rule and the three-fourths threshold, rather than an ordinary headcount.
  • If the question is whether a recommendation alone binds a government, the Supreme Court’s 2022 ruling says it does not; the recommendation has persuasive value.
  • If the question concerns a dispute about a recommendation or its implementation, Article 279A(11) supplies the mandate for an adjudication mechanism, but the clause alone does not establish its operational details.
  • If the question is whether the Supreme Court can hear a Union–State dispute, the relevant issue is whether the dispute falls within its original jurisdiction, including the legal-right condition described by the Court.

These distinctions prevent two common errors: treating a Council recommendation as though it were already a statute, and treating every Centre–State GST disagreement as though one identified dispute process automatically governs it. The legal route depends on what the dispute is actually about and on the authority or law being challenged.

Which sources establish the rules?

The principal legal source for the Council’s composition, remit, voting rule, and dispute mandate is Article 279A of the Constitution of India, inserted through the Constitution (One Hundred and First Amendment) Act, 2016. The GST Council’s official overview and agenda note describe its consensus-oriented approach and voting procedure. The Supreme Court’s judgment in Union of India v. M/S Mohit Minerals Pvt. Ltd., dated 19 May 2022, establishes the non-binding, persuasive character of recommendations. The Supreme Court’s official description of its jurisdiction explains the separate category of qualifying Union–State disputes it can hear.
