In the United States, a public agency chooses a tunnel contractor under the procurement laws and funding rules that apply to that project—not under one nationwide tunnel-specific procedure. The solicitation determines whether the agency uses sealed bidding, design-build, or another delivery approach, and whether it selects by low bid or best value. The key is to separate how the work is packaged from how competing firms are evaluated.
First, distinguish delivery method from award method
A delivery method defines how design and construction responsibilities are organized. An award method defines how the agency compares offers and selects a contractor. The two choices affect each other, but one does not automatically dictate the other: design-build does not inherently mean best value, and low-bid rules do not govern every procurement.

For a tunnel project, the agency’s authority, jurisdiction, funding, delivery method, and solicitation all matter. The process below describes common U.S. patterns, not a universal rulebook.

- Choose an authorized delivery and procurement approach. The agency decides how to package design and construction and how it will select a firm. Those decisions shape when contractors enter, what they must submit, and how price is established. NJDOT’s overview of alternative delivery
- Prepare and publish the solicitation. For transportation work, the agency develops procurement documents and issues a public letting or solicitation. They may specify the scope, schedule, qualification requirements, submission format, evaluation criteria, and required approvals. - Qualify and shortlist firms if the method calls for it. A common two-phase design-build process starts with a request for qualifications (RFQ) and statements of qualifications (SOQs). The agency assesses the teams and may shortlist eligible firms before requesting detailed proposals. FHWA describes shortlists of three to five teams as common practice among agencies covered by a 2002 survey; that is historical practice, not a required or universal number. FHWA design-build survey
- Receive and evaluate bids or proposals. In the second phase of a two-phase design-build procurement, shortlisted teams submit technical and price proposals. Depending on the solicitation and governing rules, the agency may also hold discussions, consider alternative technical concepts, request revised proposals, or invite best and final offers. - Select the apparent winner using the stated award method. A sealed-bid procurement generally selects the lowest responsive and responsible bidder. A best-value procurement weighs price and performance according to the criteria disclosed in the solicitation. - Document the decision, secure required approvals, and execute the contract. The agency records its evaluation and selection, completes applicable funding or oversight approvals, makes the award as required, and signs the contract. Does the lowest bidder always win?
No. In sealed bidding, the general rule is award to the lowest bidder whose offer is both responsive and whose firm is responsible, subject to the governing rules and solicitation. The Federal Transit Administration’s Best Practices Procurement Manual, reproducing FTA Circular 4220.1E in its discussion of sealed bidding, states: “A firm fixed-price contract award will be made in writing to the lowest responsive and responsible bidder.” FTA Best Practices Procurement Manual

Best value is different: the agency compares price alongside disclosed performance considerations. In Ohio, Rule 153:1-6-02, effective May 19, 2026, requires a two-step best-value process for covered design-build procurements, with qualifications criteria and proposal-phase performance and pricing criteria set and weighted by the authority. The rule allows a one-step design-build process for projects valued below $4 million. These are Ohio requirements and thresholds, not national standards. Ohio Administrative Code Rule 153:1-6-02
What do “responsive” and “responsible” mean?
They are separate checks in a sealed-bid process. A bid is responsive when it meets the material requirements of the solicitation. A bidder is responsible when the agency determines that the firm has the ability and qualifications to perform the contract. Being the apparent low bidder does not, by itself, establish either point. What can an agency evaluate?
The published solicitation is the controlling guide to what is scored, how it is weighted, and what is mandatory. Depending on the procurement, an agency may consider:
- Relevant project experience, staff qualifications, and team capacity
- Technical design, construction approach, and management plans
- Work sequencing, schedule, and ability to meet project milestones
- Past performance and plans for managing procurement difficulties
- Price, and how price is combined with performance factors under a best-value method
- Compliance with mandatory requirements, including the separate responsiveness and responsibility checks where applicable
Ohio’s design-build rule lists schedule, approach, sequencing, performance history, plans for procurement difficulties, technical design, personnel, and management among possible performance factors. How are design-build teams shortlisted?
Where the solicitation uses two phases, firms first submit qualifications rather than a complete technical and price proposal. The agency evaluates those submissions against its published requirements and may invite a shortlist to compete in the proposal phase. FHWA reports that three to five teams was a common shortlist range in practices described by a 2002 survey; the figure is not a current requirement and should not be read as a standard for every agency or tunnel project. Why a tunnel contract may have project-specific rules
Tunnel construction can involve complex technical and delivery choices, but the available official sources do not establish a distinct nationwide “tunnel award” process. A useful example is WSDOT’s SR 99 bored tunnel design-build project: its project page provides the RFQ, a best-value equation, and a contract award notice. - Which entity is procuring the work and what law or funding conditions apply
- Whether the project is design-bid-build, design-build, CMGC, progressive design-build, or another authorized method
- Whether firms must qualify or be shortlisted before submitting proposals
- Which technical and price factors are scored, and their stated weights
- What makes an offer compliant and how contractor responsibility is assessed
- Whether discussions, revised proposals, or best and final offers are permitted
- Submission deadlines, approval requirements, award procedures, and protest rules
