How Landowners Can Protect Wetlands on Their Property

Protecting wetlands on private land starts with understanding the site, checking rules before making changes, and choosing stewardship or conservation options suited to the property.

Landowners can protect wetlands by first understanding what is on the property, avoiding unreviewed drainage or filling, getting agency advice before changing wet areas, and maintaining or restoring wetland functions. For lasting protection, a conservation easement or other local conservation arrangement may be an option. The right steps depend on the parcel, the proposed work, and federal, state, tribal, and local rules.

Why protect the wet areas on your land?

Wetlands do more than provide habitat. The U.S. Environmental Protection Agency says they can help control erosion, limit flooding, moderate groundwater levels and base flow, assimilate nutrients, protect drinking-water sources, and buffer coastal areas from storm surges. Their value depends on the wetland and its setting, so protection starts with keeping its water patterns, soils, and vegetation in good condition. EPA explains the functions and benefits of wetlands.

Start by learning what is on the property

Make a practical record before planning work: note wet areas and drainage features, photograph vegetation and water conditions, and observe how the site changes through wet and dry seasons. This can help you explain the property to conservation or agency staff, but a map, photograph, or informal observation does not establish a legal wetland boundary.

Ask local conservation professionals or relevant agencies for technical assistance. EPA recommends technical help and monitoring as part of wetland stewardship. Share the location, your observations, and the specific activity you are considering; advice is more useful when tied to a proposed action rather than a general question. EPA’s landowner guidance covers protection, technical assistance, and monitoring.

Check before draining, filling, grading, or clearing

Do not assume every activity on wet ground automatically requires a federal permit—or that an activity is exempt just because it is on a farm. Clean Water Act Section 404 applies to discharges of dredged or fill material into waters of the United States, including wetlands covered by federal jurisdiction. The rules include jurisdictional limits and exemptions, and some exemptions for ongoing agricultural, silvicultural, and ranching activities have conditions. Whether a specific project is covered depends on its location and details.

If you are unsure about planned work, contact the local U.S. Army Corps of Engineers district before proceeding. EPA specifically advises landowners to check with their district when uncertain whether ongoing or planned activities in wetlands are regulated under Section 404. EPA’s overview of Section 404 and Swampbuster explains the federal considerations.

If you own or operate agricultural land

Check separately with the Natural Resources Conservation Service (NRCS) before clearing, draining, or manipulating wet areas. USDA’s Swampbuster provisions can affect eligibility for federal farm program benefits when wetlands are converted or modified. A Section 404 permit question and a Swampbuster compliance question are not interchangeable; ask NRCS how the proposed action may affect your farm-program status.

Check state, tribal, and local requirements too

Federal review is not the whole picture. State, tribal, and local wetland programs may supplement or go beyond federal regulation. Ask the relevant local or state wetland office what rules apply to your parcel and activity, including any separate review or approval that may be required. There is no reliable universal answer for permit requirements without the location and work details. EPA provides information on state and tribal wetland programs.

Maintain wetland functions and monitor changes

Stewardship usually means avoiding unnecessary changes to wetland hydrology, soils, and vegetation, while watching for changes in water patterns, erosion, or plant communities. Keep dated notes and photographs so you can track conditions over time and share them with technical advisers.

Where appropriate for the site and advised by local experts, actions may include controlling invasive species, adjusting cultivation practices, or monitoring restoration progress. Do not apply a universal prescription for mowing, herbicides, burning, buffer widths, or planting mixes: the right method depends on local ecology and regulatory requirements. EPA discusses landowner protection and monitoring approaches in its wetland stewardship guidance.

Consider options for longer-term protection

If your goal is to prevent future conversion, ask a land trust or government conservation agency about a conservation easement or other voluntary arrangement. An easement may place lasting restrictions on certain uses while leaving ownership with the landowner, but the specific rights, restrictions, duration, and responsibilities depend on the agreement. Have the terms reviewed carefully before deciding.

Other forms of assistance may be available locally, but programs, eligibility, and terms vary. Ask about current options rather than relying on older program names or assumptions that a particular incentive is still offered. EPA’s wetland protection and buffer guidance and its land-use planning resources provide background; local agencies and land trusts can explain what is available for your property.

Make your next call specific

  • Potential dredging or fill: Contact the local U.S. Army Corps of Engineers district with the property location and a description of the work.
  • Farm activity affecting wet areas: Consult NRCS about Swampbuster and federal farm-program implications before altering the site.
  • Additional local rules: Ask state, tribal, or local wetland authorities what applies to the parcel.
  • Long-term conservation: Ask land trusts or government conservation agencies about current easement or assistance options and their terms.
