Institutional crypto custody is the system of technical controls, people, procedures, and records that governs who can authorize transfers of crypto assets. The assets are recorded on a blockchain; wallets manage the keys or other access credentials used to authorize transactions. Institutions distribute that authority and reconcile on-chain activity with their own records of each client’s holdings.
What a crypto custodian actually safeguards
A crypto wallet does not hold coins like a physical container. It manages private keys or other credentials that can authorize transactions recorded on a distributed ledger. A private key can authorize a transfer; a public key or address can be used to receive assets and does not, by itself, authorize spending. Losing the necessary access credentials can mean losing access to the assets.

For an institution, custody is therefore broader than storing a key. It includes defining who may request a transfer, who reviews it, what approvals are required, how it is signed and broadcast, and how client positions are recorded. The arrangement depends on the asset, network, custodian, legal agreement, and applicable rules.
How signing authority can be shared
Multisignature
In a multisignature, or multisig, arrangement, a wallet or address is set up to require a threshold of several keys before a transaction is authorized. A common way to describe a threshold is M-of-N: M approvals are required from N possible signers. This can prevent one key holder from moving assets alone, provided the signers and controls are genuinely independent and the arrangement is implemented securely.

Multi-party computation
In multi-party computation, or MPC, key material is distributed among participants, who collectively produce a valid signature when the required threshold is met. The key is not necessarily assembled as one complete private key during ordinary signing. The implementation and operational design matter: the label “MPC” alone does not establish how secure or resilient a particular system is.
Both approaches can distribute transaction authority, but neither guarantees safety. Institutions need to assess signer independence, software and service-provider risks, approval policy, and how access can be recovered if a participant or system becomes unavailable. An SEC-hosted discussion draft describes multisig and MPC as possible components of a safeguarding program, while cautioning that systems differ and that providers require diligence. It is an illustrative discussion draft, not a binding SEC rule, endorsement, or mandatory architecture.
Hot and cold storage: access versus exposure
Hot wallets are connected to the internet, making them convenient for transactions but more exposed to cyberthreats. Cold wallets are typically kept offline, reducing direct online exposure but making transfers less convenient. Cold devices still present physical risks, including loss, damage, theft, or difficulty recovering access.

| Approach | Access and exposure | Operational trade-off |
|---|---|---|
| Hot wallet | Internet-connected; convenient for transactions and more exposed to cyberthreats. | Supports easier access, but institutions must manage online access and transaction controls. |
| Cold wallet | Typically offline; reduces direct cyber exposure. | Less convenient for transfers; devices and recovery materials can be lost, damaged, or stolen. |
The SEC’s investor bulletin explains these broad trade-offs but does not prescribe how an institution should divide assets between hot and cold storage. The right design depends on its transaction needs, risk controls, recovery arrangements, and the assets and networks it supports.
What happens when an institution sends a transfer
There is no single workflow used by every institution. A typical high-level path connects an internal request and approval process to key authorization, a blockchain transaction, and client-account reconciliation:
- Request: An authorized operator submits a proposed transfer, including the asset, network, amount, and destination.
- Review: Institutional policy determines whether the request is valid and whether the destination, amount, and network are approved.
- Approval and signing: The required people or signing system provide the threshold approvals and produce an authorized transaction.
- Broadcast and ledger record: The signed transaction is broadcast to the relevant network, which records the transfer according to that network’s rules.
- Reconciliation: The custodian updates or reconciles its client position records against the transaction and relevant ledger information.
This is an explanatory model based on the role of signing keys and client records, not a universal workflow specified by one regulator. Institutions may differ in their checks, signing arrangements, timing, and account structure.

How custody and settlement fit together
The blockchain records transactions, while a custodian’s books track which clients have claims to which positions. These records serve different purposes: an on-chain transfer changes ledger state, and the custodian’s client records attribute holdings and transactions to individual customers. Accurate client-level records are therefore part of custody, not an administrative detail separate from it.
“Settlement” does not describe one universal process across crypto assets, trading venues, and custody arrangements. A transfer may be recorded on a blockchain, while related client-account updates or other steps take place in the custodian’s systems. The cited regulatory materials establish certain recordkeeping and return obligations in covered contexts, but do not establish a universal settlement time, finality rule, or off-chain workflow for every asset or venue. Check the applicable network, trading arrangement, and custody agreement rather than assuming a single timeline.
Safeguards and provider due diligence
Institutions can use controls such as separated duties, threshold signing, approved destinations, transaction limits, authentication, logging, recovery procedures, and independent review. These controls can reduce the risk of unauthorized or mistaken transfers, but no control makes loss impossible. The actual protection depends on how controls work together and how the institution handles exceptions, failures, and third parties.

Before choosing a custodian, an institution should establish how its legal and operational arrangements work—not just what key technology is used. The SEC’s investor bulletin identifies custody-related due-diligence concerns, and U.S. banking-agency guidance stresses management of third-party risk. Useful questions include:
- Assets and networks: Which assets, networks, and transaction types are supported?
- Authority: Who can initiate, approve, and sign a transfer? Are signing participants and systems independent, and what threshold is required?
- Storage and recovery: How are hot and cold access managed? What happens if a device, signer, system, or account is unavailable?
- Service providers: Does the custodian use a sub-custodian or other critical service provider, and how are those dependencies managed?
- Client property and records: Are client holdings and access means segregated or commingled? How are client positions and transactions recorded and reconciled?
- Use of assets: Can client assets be lent, rehypothecated, or used for another purpose under the agreement?
- Failure and loss: What happens if the provider fails? What losses, if any, does insurance cover, and what exclusions or conditions apply?
- Operations and cost: How do withdrawals and recovery work, what delays or approval steps can apply, and what fees are charged?
Answers should be checked against the service agreement, operational documentation, and applicable law. Insurance terms, segregation practices, withdrawal procedures, and supported assets can vary; a provider’s general description does not establish the protection available to a particular client.

United States: bank custody and safekeeping
In 2020, the Office of the Comptroller of the Currency (OCC) said national banks and federal savings associations could provide crypto custody, including holding unique cryptographic keys, and that custody could extend beyond passively holding keys. On May 7, 2025, the OCC said Interpretive Letter 1184 confirmed that these institutions may buy and sell assets held in custody at a customer’s direction and may outsource bank-permissible crypto activities, including custody and execution, subject to appropriate third-party risk management and applicable law. The OCC also emphasized safe and sound conduct.

On July 14, 2025, materials from the OCC, Federal Reserve, and Federal Deposit Insurance Corporation described risk-management considerations for bank crypto safekeeping. The joint statement said it did not create new supervisory expectations. These statements concern regulated banking activity; they should not be read as a general authorization or legal conclusion for every custodian, customer, asset, or transaction.
Separately, on October 1, 2026, SEC Chairman Paul S. Atkins said the Commission had proposed rules addressing custody of crypto assets under the Investment Advisers Act and Investment Company Act. That statement described a proposal, not a final or effective new rule.
European Union: MiCA Article 75
For crypto-asset service providers covered by the EU’s Markets in Crypto-Assets Regulation (MiCA), ESMA’s text of Article 75 describes obligations that include maintaining client position registers, providing statements at least once every three months and on request, establishing procedures to return assets or access means, and segregating client holdings and access means from the provider’s own. The article addresses both operational and legal segregation and provider liability for loss attributable to the provider, subject to its terms.
