How H-1B Visa Changes Affect Indian Tech Workers and Their Employers in 2026

The 2026 H-1B changes affect entry, cap selection, wage policy and employer review in different ways. Here is what Indian tech workers and employers should check.

As of October 13, 2026, the most consequential H-1B changes for Indian tech workers are a renewed entry restriction tied to a $100,000 payment for certain petitions, a weighted selection process in effect for the FY 2027 cap season, and a proposed—not final—prevailing-wage rule. A separate executive order also directs agencies to consider certain employer layoffs in H-1B processing. These are H-1B-wide policies, not India-specific rules: the official materials do not quantify how many Indian workers or employers are affected. Whether a particular person is covered depends on factors such as where they are, petition timing and type, travel or entry needs, and the employer’s circumstances.

What changed—and what did not

The White House’s September 18, 2026 proclamation extends the restriction on entry of certain H-1B specialty-occupation workers for 12 months, to 12:00 a.m. EDT on September 21, 2027, absent another extension. For covered petitions, it requires an employer to make a $100,000 payment, unless the Secretary of Homeland Security grants a discretionary national-interest exception subject to the conditions in the proclamation. The same proclamation says a Department of Homeland Security weighted-selection rule, finalized December 29, 2025, was in effect for the FY 2027 cap season. It also describes a Labor Department prevailing-wage measure as a proposal published March 27, 2026, not a final rule. The White House, “Restriction on Entry of Certain Nonimmigrant Workers,” September 18, 2026.

These measures address different points in the process. The payment restriction concerns covered petitions and entry; weighted selection affects which registrations are selected in the annual cap process; the wage proposal concerns prevailing-wage levels; and the executive order on program integrity directs agencies to coordinate and consider specified layoff information. Treating all four as one “H-1B fee” or one lottery change obscures what an employer or worker actually needs to check.

The policies apply to the H-1B program, not specifically to Indian nationals. Indian tech workers are within the population potentially affected when the applicable criteria are met, but the reviewed government documents provide no India-specific count, occupational breakdown, employer analysis, or individual legal determination.

Does the $100,000 H-1B fee apply to me?

The proclamation describes an entry restriction for certain H-1B specialty-occupation workers and requires the $100,000 payment for covered petitions. It says employers must obtain and retain documentation of payment before filing for a worker outside the United States. The proclamation directs the State and Homeland Security departments to verify and implement the requirement. It provides for an exception when the Homeland Security Secretary determines, in their discretion, that the hiring is in the national interest and poses no threat to U.S. security or welfare. That is a discretionary exception, not an automatic waiver based on a worker’s occupation, employer, or personal circumstances. The White House, September 18, 2026 proclamation.

The practical answer cannot be reduced to “every H-1B worker pays” or “only new applicants pay.” The proclamation frames the current restriction in terms of people outside the United States and entry after its effective date, while the earlier White House FAQ described the original payment’s application to new petitions submitted after 12:01 a.m. EDT on September 21, 2025. It said previously issued H-1B visas and petitions submitted before that date were outside the original requirement. Because the 2026 proclamation extends the restriction, rather than supplying a case-by-case ruling, the earlier FAQ should be read together with the extension and current implementation guidance. The White House, “H-1B FAQ,” September 21, 2025; September 18, 2026 proclamation.

  • Whether the worker is inside or outside the United States when the relevant petition is filed and when entry is sought.
  • Whether the case involves a new petition, an extension or renewal, a change in employment, or another filing type, and the dates on which the petition and any prior visa were issued or submitted.
  • Whether the worker needs consular processing or plans to seek entry after the restriction’s effective date.
  • Whether the petition is cap-subject or cap-exempt; that is a distinct question from whether the entry-payment restriction applies.
  • Whether the employer has the required payment documentation or has a basis to request the discretionary national-interest exception.

This is a fact-gathering list, not a substitute for a case-specific determination. The proclamation and FAQ do not resolve every combination of petition type, location, prior filing, visa status, and travel plan.

Do H-1B changes affect renewals and travel?

The September 2025 FAQ said the original $100,000 payment did not change renewal fees and did not prevent current H-1B visa holders from traveling in and out of the United States. It also said the original payment did not apply to previously issued H-1B visas or petitions submitted before September 21, 2025. Those statements describe the original measure and its stated scope at that time; they should not be treated as a guarantee that every renewal, subsequent petition, or trip is unaffected under the 2026 extension. The White House, “H-1B FAQ,” September 21, 2025; September 18, 2026 proclamation.

For a worker already in the United States, the proclamation’s focus on people outside the country and entry makes location and travel plans important facts. It does not justify assuming that every person with current H-1B status must pay the amount, nor does the earlier FAQ justify assuming that all travel is consequence-free under the extended restriction. Before a trip, the worker and employer should confirm the current rule’s implementation for the specific petition and planned return, including whether the person would need a new or amended petition, a visa, or a consular process. The official materials reviewed do not provide a universal answer for these scenarios.

Renewal is also not a single uniform category for purposes of this question. The prior FAQ’s assurance about unchanged renewal fees is relevant, but a later filing may differ from a routine renewal in timing, petition type, or whether it involves a worker outside the country seeking entry. The employer should document which filing is being made and why the payment requirement is or is not considered applicable, rather than inferring the answer from the label “renewal.”

What changed in the H-1B lottery?

For the FY 2027 cap season, the White House says DHS’s weighted-selection final rule, published December 29, 2025, was in effect and prioritized higher-paid, higher-skilled beneficiaries. That is a change in how cap-subject registrations are weighted for selection; it does not mean that a higher wage or degree guarantees selection, and the government figures do not establish an individual worker’s odds. Nor should the cap-selection rule be conflated with the separate entry restriction or the wage proposal.

The White House reported the following FY 2027 outcomes in its September 2026 proclamation. These are figures reported by the administration, not independently verified estimates in the materials reviewed:

Measure Government-reported figure What the figure describes
Registrants with at least a U.S. master’s degree 45.1% FY 2026 registration share, as reported by the White House in 2026.
Registrants with at least a U.S. master’s degree 66.1% FY 2027 registration share, as reported by the White House in 2026.
Selections at the two highest wage levels Approximately 46.3% FY 2027 selections, as reported by the White House in 2026.
Selections at the lowest wage level 17.8% FY 2027 selections, as reported by the White House in 2026.

The degree percentages describe registrants, while the wage percentages describe selections; they are not interchangeable denominators. The figures indicate that the selected pool reportedly shifted toward higher wage levels and that a greater share of registrations came from people with at least a U.S. master’s degree. They do not tell an individual applicant’s probability of selection, isolate the effect of the weighted rule from other changes, or show how the results divide by nationality, occupation, or employer.

The proclamation also reports that combined registrations by the largest IT staffing and outsourcing firms fell from 24,946 to 2,055, a reported 92% decrease, and that consular-processing requests fell nearly 97% between the FY 2025 and FY 2027 cap seasons. The White House attributes these comparisons to the period since the payment restriction and rule change. They should be read as government-reported comparisons, not as independently established causal effects or as measurements of the impact on Indian workers specifically. The cited source does not provide enough detail in the materials reviewed to infer what any one firm or worker experienced.

Is the prevailing-wage change already in force?

Not according to the September 18, 2026 proclamation. It says the Department of Labor published a notice of proposed rulemaking on March 27, 2026, intended to improve wage protections by aligning prevailing-wage levels more closely with wages paid to similarly employed workers in similar locations. A proposed rule is not the same as a finalized rule. The proclamation does not establish that the proposal had taken effect, and the materials reviewed do not establish its status after that date. Employers should verify the current rulemaking status before making compensation or filing decisions.

This proposal is separate from weighted selection. The selection rule gives greater priority to higher-paid beneficiaries; the wage proposal concerns how prevailing-wage levels are set. Employers should not assume that the proposal itself changed a worker’s required wage or that a wage level alone determines eligibility for a petition. The official materials summarized here do not provide the proposal’s full operative terms or a final effective date.

What does the 2026 employer-coordination order require?

A separate executive order issued September 18, 2026, directs the Departments of State, Labor, and Homeland Security to coordinate with Commerce, Education, and the Small Business Administration, drawing on relevant wage, employment, academic, industrial, and economic information. It also directs agencies to take into account whether an employer sponsor directly or indirectly had layoffs during the previous year or plans future layoffs affecting similarly situated U.S. workers. The order directs Labor to begin reviewing prior labor-condition application data within 30 days to determine whether further action is warranted. The White House, “Enhancing Program Integrity and Interagency Coordination in the Administration of the H-1B Nonimmigrant Visa Program,” September 18, 2026.

The order makes layoffs a relevant consideration in agency processing; it does not, in the material summarized here, set out a blanket rule that any layoff automatically bars an employer from sponsoring an H-1B worker. Employers should be prepared to identify relevant workforce actions and understand how the agency evaluates them in a particular filing. The order’s directive to review prior labor-condition application data is also a review instruction, not by itself a finding that a specific employer violated the rules.

The proclamation cites broader labor-market indicators as part of the administration’s policy rationale: 5.7% unemployment among recent college graduates in June 2026 and 42% underemployment in June 2026, compared with 5.8% and 41.8%, respectively, in September 2025. These are figures the proclamation uses to support its rationale; they are not estimates for H-1B workers, Indian graduates, or the technology sector alone.

What Indian tech workers and employers should do next

For workers

  1. Get the case timeline. Ask the employer or counsel to identify the filing type and the dates of the petition, any prior H-1B visa, and any planned new filing. Do not rely on a general statement about “the fee” without knowing which filing and date it concerns.
  2. Confirm location and travel assumptions. Establish whether the worker will be inside or outside the United States when filing and when seeking entry. If travel or consular processing is planned, ask how the current extension applies to that exact itinerary and petition.
  3. Separate cap selection from entry rules. For a cap-subject registration, ask how the FY 2027 weighted selection rule applies to the offered role and wage information. Separately confirm whether any payment or entry restriction is relevant to the petition.
  4. Request the current official basis for a conclusion. Because the 2025 FAQ and 2026 extension address different points in time, ask the employer or qualified counsel to confirm the present implementation and legal status rather than relying solely on an older summary.

For employers

  • Before filing for a worker outside the United States, determine whether the petition is covered by the extended restriction, retain any required payment documentation, and assess whether a discretionary exception is being sought.
  • For cap-subject cases, ensure that the registration and wage information are accurate under the FY 2027 weighted-selection process; do not represent a wage level or U.S. degree as a selection guarantee.
  • Track the prevailing-wage proposal separately from rules already in force, and verify whether there has been a later final rule or other agency guidance before changing compensation practices.
  • Review relevant direct and indirect layoffs in the prior year and planned layoffs affecting similarly situated U.S. workers, since the executive order directs agencies to take such information into account.
  • Keep case records that distinguish the employee’s status and location, filing category, travel needs, wage and role details, and the employer’s rationale. Those facts help counsel assess the case without turning a program-wide policy statement into an assumed individual outcome.

What the official figures can—and cannot—say about India

The White House materials describe H-1B-wide policy and report aggregate program figures. They do not estimate the number or share of Indian workers affected by the payment restriction, show outcomes by Indian occupation or employer, or establish how many Indian candidates gained or lost selection opportunities. An Indian worker may be affected when the same petition, location, entry, wage, cap, or employer criteria apply, but nationality alone does not answer the case-specific questions.

Likewise, the government-reported changes in registration shares, wage-level selections, large-firm registrations, or consular-processing requests should not be recast as India-specific trends. They may matter to an Indian applicant or an employer with Indian employees as context, but they do not provide a reliable individual forecast. The sources are primary records of what the administration announced and reported; the figures and policy rationale have not been independently validated in the materials summarized here, and they do not resolve litigation or every implementation question.
