Before committing to land, get site-specific, written evidence that the serving system can deliver your requested load at the right point and on a credible schedule. Confirm the study status, required upgrades, cost responsibility, operating conditions and dependencies behind any proposed service date. A nearby transmission line, public capacity map or general utility statement is not a capacity reservation.
This guide focuses on U.S. projects. The applicable utility, transmission owner and regional process vary by location, and national studies cannot establish whether a particular parcel can be served. Treat site selection as a power-delivery diligence process: test each candidate using the same project assumptions, then make land commitments conditional on documented milestones where commercially possible.

What shows that a site has enough power?
“Enough power” means the serving system can deliver the project’s requested capacity at its point of delivery, under stated conditions, by a date the project can use—not simply that generation or a high-voltage line is nearby. Ask for a site-specific capacity and system-impact assessment and record what is preliminary, what remains under study, and what the utility or grid operator has actually approved or committed to provide.
Regional transmission analysis is useful context, not parcel-level proof. The U.S. Department of Energy’s July 2026 draft National Transmission Needs Study identifies transmission needs, congestion and regional differences using public information. DOE says the study is not intended to replace existing planning processes or identify specific transmission solutions. It therefore cannot tell a developer the available MW, upgrade scope or energization date for an individual site.

Which organizations and procedures must you identify?
Before comparing power claims, map who handles each decision. Depending on the location, the serving electric utility, transmission owner, balancing authority and regional transmission organization or independent system operator (RTO/ISO) may have different roles. Confirm which party provides the study, approves service, owns needed facilities, controls the schedule and signs the relevant agreement.
Request the applicable large-load application and tariff, study sequence, queue status if relevant, deposits, decision gates and study deliverables. Ask the utility to explain in writing which statements are indicative and which are binding under the applicable tariff or contract. Do not treat a queue position, preliminary assessment or general statement of available capacity as a firm reservation.
There is no single settled U.S. large-load procedure. FERC’s RM26-4 docket describes an advance notice of proposed rulemaking stage. The docket raises questions about study timing, flexible or curtailable loads, upgrade costs, co-located generation and pending requests; it is not itself a final nationwide rule. FERC describes loads above 20 MW as generally within the large-load category for this proceeding, not as a threshold that every utility or region must use.

A study is only as useful as its assumptions. Provide a credible project definition early, and ask the relevant planners to confirm how they will model it:
- Requested peak MW and point of delivery.
- Commissioning sequence, phases and anticipated ramp to full load.
- Expected operating profile, including when and how demand may vary.
- Demand responsiveness or flexibility the project can actually provide.
- Backup-power transfers and return to utility supply.
- UPS, transfer-switch, generator, variable-frequency-drive, protection and voltage ride-through settings.
Do not present aspirational flexibility as an operating commitment. Describe what the facility can curtail, for how long and under what conditions, then ask how that offer affects study assumptions and service terms.

What grid upgrades might be required, and who pays?
Ask for the identified work at both the site and wider system levels. The assessment should address local substation or transformer work, transmission network upgrades, affected-system dependencies, relevant contingency conditions and any generation or resource-adequacy assumptions. A site may appear close to infrastructure yet still depend on work elsewhere in the network.
For each item, seek the scope, estimate, responsible party, schedule dependency and basis for the estimate. Document customer-funded facilities, deposits, network-upgrade cost allocation, any potential cost sharing or credits, and how costs can change after a restudy or project-scope change. FERC’s active policy proceedings make these questions particularly important, but the applicable tariff and project contracts—not a general policy announcement—govern a particular site.
How long could connection take?
Build a milestone schedule from application through study, permits, procurement, construction, testing, initial energization and ramp to full load. For each milestone, identify the owner, prerequisites, the earliest credible date and the contingency if a dependency slips. Separate utility- or grid-operator-controlled work from developer-controlled work; a target date without those dependencies is not a reliable project schedule.
NERC’s March 2026 assessment reports that data centers can move from conception to operational readiness in one to two years, while new transmission and generation infrastructure can take four or more years. Those are reported contrasts, not standard durations for every project. NERC also notes that utility interconnection may take longer and that a facility may initially energize before reaching full load. Use a site’s actual study and construction milestones—not these broad figures—to set its schedule.
Could flexibility or curtailment change the deal?
Ask whether interruptible service, curtailment, demand response or staged energization is offered or required. Get the conditions in writing: what triggers a reduction, how much load may be affected, how long or how often it may occur, and what commercial or operational consequences apply. A flexible-load option may affect study treatment, but do not count it as a benefit until its terms and operational feasibility are clear.

FERC’s June 18, 2026 announcement said it had issued tailored show-cause orders to six RTOs/ISOs under its jurisdiction. The listed issues included study processes, transmission-cost transparency and cost shifting, co-location and behind-the-meter generation, flexible-load services, and studies of generation serving nearby large loads. The announcement set 60 days for the operators and transmission owners to justify their tariffs or file changes, and separately described a 30-day informational report on generation adequacy. Those announced response periods have passed; check the FERC announcement and current regional materials for subsequent status rather than assuming a uniform rule or outcome.

How should you compare candidate sites?
Use one scorecard for every parcel and date-stamp its evidence. Compare the strength and maturity of written support, not the market reputation of a region or the confidence of a sales presentation.
- Deliverable capacity, point of delivery and the assumptions behind the assessment.
- Study maturity, remaining decision gates and any relevant queue status.
- Upgrade scope, cost exposure and dependencies outside the parcel.
- Earliest credible initial-service date and the path to full-load operation.
- Flexibility, curtailment and other operating conditions.
- Regional transmission constraints and the quality of utility/grid-operator coordination.
DOE’s draft study says the majority of transmission congestion is concentrated in 5% of hours. That is a finding about congestion patterns in the draft, not a measure of an individual site’s connection risk: congestion varies with region and conditions. Use the study to frame questions about regional constraints, then rely on current site-specific analysis for the parcel.
What should be true before you commit to land?
Set land milestones around evidence, not assurances. Where negotiations allow, make closing or other material commitment contingent on defined power milestones, such as completion of a specified study, acceptable upgrade scope and cost treatment, and documented service conditions and schedule. Preserve the assumptions and written responses that support those decisions. Reconfirm them before closing and before major changes to design or load, since network conditions, tariffs and large-load rules can change.
NERC’s March 2026 reliability assessment identifies gaps in comprehensive study, data sharing, planning, operational coordination, protection and performance requirements for large loads. It also discusses coordinating utility-side protection with facility UPS and variable-frequency-drive ride-through settings, and modeling transfers to backup and back to utility after voltage disturbances. Include the facility’s electrical behavior in discussions with grid stakeholders; backup generation does not make those interactions irrelevant.
