How Copyright Applies to AI Training Data and Generated Answers

AI training and AI-generated answers raise separate copyright questions. Here is how U.S. fair use, EU text-and-data-mining rules, human authorship, and output infringement differ.

There is no blanket yes-or-no answer. Whether using copyrighted works to train or operate an AI system is lawful is a different question from whether an AI-generated answer is copyrightable or infringes someone else’s work. In the United States, the Copyright Office describes training as a fact-specific fair-use question; in the European Union, text-and-data-mining rules, lawful access, and rights-holder reservations matter. This explainer focuses on those two jurisdictions and is general information, not legal advice.

Training and generated answers are separate copyright questions

Copyright analysis can arise at more than one point in an AI system’s life. A developer may copy or process works while assembling data, pretraining a model, or carrying out later training. A service may retrieve material when responding to a user. Then, when the system produces an answer, that answer may raise its own questions: can a person claim copyright in it, and does it reproduce protected expression belonging to someone else?

As an Amazon Associate I earn from qualifying purchases.

Those questions do not determine one another. A finding that a person lacks copyright in purely machine-generated expression does not establish that the training copies were lawful. Conversely, a conclusion that a particular training use was permitted would not automatically make every output copyrightable or free of infringement concerns. Analyze the specific act, stage, work, jurisdiction, and output rather than treating “AI” as one legally uniform activity.

Is it legal to train AI on copyrighted material in the United States?

The U.S. Copyright Office’s answer is contextual, not categorical. Its Part 3 report says that training may implicate copyright owners’ exclusive rights at multiple stages and treats fair use as the key question that may excuse otherwise infringing copying. The Office expects some uses to qualify as fair use and some not to qualify. That is the Office’s analysis, not a court’s ruling in a particular dispute.

The Part 3 report was released as a pre-publication version on May 9, 2025. The Copyright Office’s AI study page described a final version as expected later and said no substantive changes to the analysis or conclusions were expected. The report is not a statute, binding regulation, or judicial holding.

What does fair use turn on?

Fair use is assessed in relation to a particular use and its circumstances. The Office identifies the works used, how they were obtained, the purpose of the use, the controls on outputs, and effects on markets as important facts. It notes that the first and fourth fair-use factors may carry considerable weight in this context, while cautioning that outcomes cannot be prejudged.

  • What was copied? The analysis can differ depending on the material involved and whether it is expressive work such as books, articles, images, or other protected content.
  • Where did it come from? Licensed or otherwise lawfully obtained material is not the same factual situation as expressive works copied from pirate sources. Public availability alone does not mean a work is free to use for training.
  • Why was it used? Noncommercial research or analysis is different from commercial generation of expressive material intended to compete in a marketplace.
  • What can the system produce? Output safeguards matter if they reduce the ability to reproduce portions of the training works. The possibility of reproducing protected material is part of the analysis, not a detail that can be ignored.
  • What are the market effects? Whether outputs substitute for works or affect licensing markets is relevant. The Office specifically identifies the availability of reasonably obtainable licenses as part of its discussion of some scenarios.

Why neither “training is fair use” nor “training is infringement” works

The Copyright Office describes a spectrum. At one end, it says noncommercial research or analysis that does not enable portions of training works to be reproduced in outputs is likely to be fair use. At the other, copying expressive works from pirate sources to generate unrestricted content that competes in the marketplace—particularly when licensing is reasonably available—is unlikely to qualify. Many real situations fall between those examples.

These are guideposts from the Office’s report, not guarantees for a developer, service, or user. A change in the source of the material, the use being made, the output controls, or the market context can change the facts being assessed. Likewise, describing material as “online,” “publicly accessible,” or “used for training” does not answer the legal question by itself.

Different AI stages may need separate analysis

Training is not necessarily one undifferentiated act. The report calls for distinct consideration of initial pretraining, later training, and retrieval-augmented generation (RAG), in which a system retrieves material to help produce a response. The relevant copying and purpose may differ at each stage. A conclusion about a dataset used in pretraining should not simply be carried over to later fine-tuning or to a service that retrieves documents at answer time.

For example, a team assessing a model should identify which works were copied, their source, and the stage at which they were used; then consider the purpose, safeguards against reproduction, and likely market effects for that use. If the team changes the system so that it can retrieve or reproduce source passages in response to users, that operational use calls for its own analysis rather than an assumption that the original training review covered it.

How the EU’s text-and-data-mining rules differ

The EU framework does not create a blanket permission to train on any material found online, nor does it prohibit every use of protected works. The Digital Single Market Directive provides text-and-data-mining (TDM) exceptions under conditions. Lawful access and whether a rights holder has reserved the relevant rights are important to whether an exception can apply.

Recital 105 of the EU AI Act recognizes that training may use TDM techniques on protected material. It states that using copyright-protected content requires authorization unless a relevant exception or limitation applies. Where rights have been appropriately reserved, a provider of a general-purpose AI model needs authorization to mine the works. The U.S. Copyright Office’s comparative discussion also emphasizes lawful access and respect for rights-holder opt-outs, while noting controversy about how the exceptions apply to generative AI and continuing uncertainty around implementation and case law.

Questions that matter under the EU framework

  • Was there lawful access? The fact that content can be reached on the internet does not by itself establish that the conditions for a TDM exception are satisfied.
  • Were relevant rights reserved? Rights holders may reserve rights in specified circumstances. If a reservation applies, the provider may need authorization rather than relying on an exception.
  • Which exception and circumstances apply? The directive’s TDM provisions are conditional. The particular use and applicable requirements matter; the framework should not be reduced to a universal opt-in or opt-out slogan.
  • What is the system provider doing? The rules address mining protected works, while a particular output may raise distinct questions. The relevant act should be identified before drawing a conclusion.

Transparency proposals are not the same as enacted duties

On March 10, 2026, the European Parliament adopted a resolution advocating an itemized list of copyrighted material used to train models and additional transparency approaches. The resolution is evidence of an active policy debate, but it did not itself enact the requested itemized-disclosure requirements. Distinguish those proposals from obligations in existing instruments, including the AI Act; do not treat the resolution as if it had amended the law.

Does using copyrighted material for training count as fair use?

In the United States, not automatically. The Copyright Office says the answer depends on the particular use and surrounding facts, and expressly expects some training uses to qualify and some not to. Research or analysis without outputs that reproduce training passages is one example the Office describes as likely fair; unrestricted commercial generation using expressive works copied from pirate sources and competing with them is an example it describes as unlikely to qualify.

In the EU, “fair use” is not the framework described by the sources here. The relevant analysis instead concerns the TDM exceptions and their conditions, including lawful access and rights reservations. A U.S. fair-use conclusion cannot simply be transplanted into an EU analysis, or the reverse.

The practical comparison is therefore not simply “training versus no training.” It is the jurisdiction, the specific stage and act, the source and access conditions, the purpose, the safeguards on outputs, and the effect on relevant markets. No single factor in that list is presented by the cited materials as a universal shortcut.

Can I copyright something AI generated?

Under the U.S. Copyright Office’s current position, copyright does not extend to purely AI-generated material or to material in which human control over expressive elements is insufficient. A person’s use of an AI tool does not, by itself, settle whether any part of the result is protected. The relevant question is what original human-authored expression can be identified in the work.

Human contributions that may be protected

The Office says copyright may cover human-authored expression that is perceptible in an output, creative selection, coordination, or arrangement, and creative modifications made by a person. Whether those contributions are enough is evaluated case by case. In the Office’s words, “Whether human contributions to AI-generated outputs are sufficient to constitute authorship must be analyzed on a case-by-case basis.” That is the Office’s conclusion, not a court’s statement that decides every work.

For a creator, this distinction makes a useful record of authorship more informative than a bare statement that AI was or was not used. Identify the parts personally written or drawn, any meaningful creative arrangement or selection, and the edits that add original expression. The Office’s analysis concerns the human contribution to the expression, not merely the fact that a person typed a prompt or chose to use a tool.

Why a prompt alone does not establish authorship

The Office concludes that prompting alone does not provide sufficient control over expressive elements under the functioning of current generally available technology. A detailed prompt may describe the desired result, but the Office does not treat that description alone as enough to establish copyright in the generated expression. This conclusion is tied to its analysis of current generally available technology; it should not be recast as a timeless rule about every possible future system.

AI can also serve as an assistive tool within a larger work. Its use does not prevent protection for human-authored expression in that work. The distinction is between the portions generated without sufficient human control and the original expression, arrangement, or modifications attributable to a human author.

Can AI answers infringe copyright?

Potentially, but a particular answer has to be assessed on its facts. Copyrightability asks whether a person has copyright in the output; infringement asks whether protected expression belonging to someone else has been used in a way that violates their rights. A purely AI-generated answer may lack copyright protection under the U.S. Office’s position and still raise a separate infringement question if it reproduces protected expression.

The materials summarized here do not establish a categorical rule for every generated answer. They do not support assuming that all outputs infringe, or that an answer is automatically safe because it was generated by a model. The relevant inquiry is whether the answer reproduces protected expression and how the applicable jurisdiction treats that situation. Training legality and output infringement should likewise be evaluated separately: one does not settle the other.

Do AI companies have to disclose their training data?

The sources here do not establish a universal obligation for every AI company to publish an itemized list of training works. Existing EU instruments and proposals should be distinguished: the Parliament’s March 10, 2026 resolution advocates itemized disclosure, but the resolution itself is not an enacted source of that new duty. Recital 105 of the AI Act addresses copyright and authorization in the context of protected content; it should not be mistaken for the resolution’s separate requested itemized list.

The U.S. Copyright Office’s reports assess copyright issues raised by training and generated output; the facts provided here do not establish a general U.S. itemized training-data disclosure mandate. Whether a particular provider has a disclosure obligation can depend on other applicable law or circumstances not covered by these sources. Do not infer either that all providers must disclose every work or that no disclosure obligations can apply.

A practical checklist for evaluating a training or output scenario

Before deciding what a specific use means, collect the facts that map to the relevant legal question. For organizations, this is a way to structure a review, not a substitute for jurisdiction-specific legal advice.

  1. Name the jurisdiction. Separate U.S. fair-use analysis from EU TDM exceptions and opt-outs. If a service or dataset spans jurisdictions, do not assume one jurisdiction’s conclusion answers the others.
  2. Identify the exact act and stage. Record whether the issue concerns pretraining, later training or fine-tuning, retrieval-augmented generation, or a particular generated answer.
  3. Trace the source and access conditions. Determine whether works were licensed, lawfully accessible, in the public domain, or obtained from pirate sources. For EU TDM, check whether relevant rights were reserved.
  4. Describe the purpose and setting. Distinguish research or analysis from commercial generation, and explain whether the resulting service competes with works or supports a different use.
  5. Examine output safeguards. Ask whether the system can reproduce portions of training works and what controls are in place to limit that risk. Consider the controls actually used, not merely the intended behavior.
  6. Assess market effects and licensing context. Identify possible substitution for protected works and whether licensing is reasonably available, particularly in the kind of scenario the U.S. Office describes as unlikely to be fair use.
  7. For a generated work, document human expression. Separate AI-generated material from human-authored passages, creative selection or arrangement, and creative modifications. A prompt alone is not treated by the U.S. Office as sufficient authorship under its current-technology analysis.
  8. Keep output infringement distinct. If an answer resembles or reproduces a protected work, assess that answer separately from the legal basis for training the model.

The U.S. Copyright Office’s AI study page reports that it received more than 10,000 comments by December 2023. That number describes submissions received, not public consensus, a legal rule, or a measure of how courts will decide any dispute.
