Yes, some employment-based green card applicants can change employers while Form I-485 is pending. Under AC21 job portability, the I-485 generally must have been pending for at least 180 days, and the new permanent job offer must be in the same or a similar occupational classification as the job tied to the immigrant petition. Eligibility depends on the case category, the actual duties and offer, and the application’s history; the rule is not permission for every applicant to take any new job.
What AC21 job portability does
AC21 portability is a rule that can let certain employment-based adjustment applicants continue pursuing a green card after changing to a qualifying job. When the requirements are met, the approved employment-based immigrant petition can remain valid for adjustment purposes even though the applicant is moving to a different employer or position. USCIS describes this as portability under INA section 204(j).

Portability concerns the job offer underlying the adjustment application. It does not itself grant work authorization, guarantee approval of the green card, or decide whether a particular change qualifies. Nor does it resolve other questions about the applicant’s immigration status, petition history, visa availability, travel plans, or family members’ cases.
The rule is part of U.S. federal immigration law and applies only to the eligible employment-based adjustment cases described by USCIS. A general explanation cannot determine the result for an individual application.

When the 180-day period is reached
The key clock is the time Form I-485 has been pending—not how long the applicant has worked for the sponsoring employer, held a particular job, or had an I-140 petition pending. USCIS’s general threshold is that the properly filed I-485 has been pending for at least 180 days. USCIS also describes the relevant underlying I-140 as naming the applicant as its principal beneficiary.
That 180-day figure is a legal eligibility threshold, not a statistic, average processing time, or assurance that the application will be decided within six months. The USCIS Policy Manual chapter on transfer of underlying basis explains the threshold in the context of portability. The Supplement J instructions retrieved for the December 23, 2022 edition describe the same minimum period for a portability request. USCIS’s current form page and instructions should be checked before filing because the retrieved instructions are dated.
Do not count from a job change or assume a date based on a receipt notice without checking the case record and applicable guidance. If the I-485 has not reached the threshold, the portability rule described here does not yet provide a basis for moving to a new job. The consequences of a proposed change before that point depend on the case and require individualized advice.

Which cases may use this rule
USCIS identifies certain adjustment applicants in the EB-1, EB-2, and EB-3 categories as potentially eligible for AC21 portability. The general description does not mean that every petition in one of those categories qualifies: the I-485, underlying petition, job offer, and other eligibility conditions still matter.
USCIS distinguishes petitions based on extraordinary ability and national interest waivers from the portability mechanism discussed here. Those categories have different job-offer structures, and their applicants should not assume they need or can use the same portability process. USCIS’s Supplement J instructions state that certain extraordinary-ability and national-interest-waiver applicants do not need Supplement J for portability. The category and basis shown in a particular case should be confirmed before applying general instructions.
How USCIS evaluates whether the new job is similar
The comparison is between occupational classifications and the real work involved, not just employer names or job titles. A different title does not automatically defeat portability, and a similar-sounding title does not establish that a new role qualifies. USCIS guidance addresses how it evaluates whether a new job is in the same or a similar occupational classification; the November 17, 2020 policy alert describes the Policy Manual guidance on that analysis.

In practical terms, the applicant and employer should be prepared to explain the positions with accurate evidence rather than rely on a title match. Relevant material may include the duties and responsibilities of each position, the skills and qualifications required, and how the work is classified. These are comparison points, not a formula that guarantees a result. The available guidance does not make any particular title pair automatically portable.

- Compare the work: Identify the original position tied to the immigrant petition and describe the proposed job’s actual duties.
- Compare occupational classification: Explain why the roles fall within the same or a similar occupational classification, rather than relying only on a shared title, employer, or industry.
- Use consistent evidence: Ensure that job descriptions and supporting documents accurately reflect the work and requirements. A mismatch between the proposed duties and the claimed classification can make the case harder to assess.
- Get case-specific review when the match is uncertain: USCIS makes the determination based on the case record; a close or substantial change in duties should not be treated as automatically qualifying.
The new offer must be bona fide and prospective
Portability is tied to a genuine offer of permanent employment, not merely the applicant’s intention to look for work after receiving a green card. The Supplement J instructions describe a new full-time, permanent job offer that the applicant intends to accept once adjustment is approved. The offer must be bona fide, and the job must satisfy the same-or-similar occupational-classification requirement for portability.
Supplement J is used to confirm a bona fide job offer or to request job portability under INA section 204(j). Whether and how to submit it depends on the case and current USCIS instructions. It is not safe to infer from the existence of Supplement J that every applicant changing employers must file it in exactly the same way.

Importantly, Supplement J’s portability analysis does not establish that the applicant currently has authorization to work for the prospective employer. The applicant must separately confirm that they are authorized to work for that employer before starting. The form instructions do not decide that work-authorization question.

These procedures are easy to confuse because both involve a pending adjustment application and an employment-based petition. They are not interchangeable.

|---|---|---|
| What changes? | The applicant seeks to continue adjustment using the existing qualifying basis while moving to a same-or-similar job. | The applicant asks USCIS to adjudicate the pending I-485 using another petition or immigrant category. |
| Is a new basis requested? | USCIS says applicants seeking AC21 portability do not need to request transfer of the adjustment application to a new petition or basis. | Yes. The request is to use another basis, and the new basis must be supported by the relevant petition and evidence. |
| What additional factors matter? | The applicable category, I-485 pendency, qualifying job offer, job similarity, and the case record. | Continuing eligibility, I-485 pendency, evidence for the new basis, visa availability where applicable, and USCIS’s discretionary decision. |
| How does the 180-day timing work? | The general portability threshold is at least 180 days of I-485 pendency. | For a request to transfer to a different employment-based category based on a new I-140, USCIS says portability cannot be used until 180 days or more after making the transfer request, if portability otherwise applies. |
The transfer timing described in the last row is specific to that transfer situation. It is not a universal reset caused by every employer change. USCIS states that “The decision to grant or deny a transfer request is always discretionary.” That statement concerns a request to transfer the I-485 to a different basis; it should not be mistaken for a description of ordinary qualifying AC21 portability. The Policy Manual chapter explains both procedures and their distinction.

A practical check before changing jobs
Before relying on portability, gather the facts that determine which path, if any, applies. An employment change can intersect with issues that the portability rule does not answer, so do not make a decision based only on the 180-day threshold.
- Confirm the case stage. Verify that Form I-485 was properly filed and determine whether it has been pending for at least 180 days.
- Confirm the category and underlying petition. Identify the employment-based category, the petition supporting the application, and whether the applicant is the principal beneficiary. Do not assume the same procedure applies to extraordinary-ability or national-interest-waiver cases.
- Document the job comparison. Preserve accurate descriptions of the original and proposed roles, including duties and qualifications, so the same-or-similar occupational-classification question can be evaluated.
- Review the offer. Confirm that the proposed position is a bona fide, full-time, permanent offer intended to be accepted upon adjustment, as described in the Supplement J instructions.
- Choose the correct procedure. Decide whether the situation is a portability request using the existing basis or a request to transfer the I-485 to a new petition or category. The latter has distinct requirements and a discretionary decision.
- Check the rest of the record. Petition validity, nonimmigrant status, work authorization, travel, visa availability, priority-date circumstances, derivative applications, and case posture can change the practical consequences.
- Check current USCIS materials and obtain individualized guidance. Review the current Policy Manual and current Supplement J edition before filing, and consult a qualified immigration professional about a decision that depends on the individual record.
What this rule does not answer
Meeting the time threshold and having a potentially similar job do not by themselves establish that a particular applicant may safely change employers. The general rule cannot establish that the underlying petition remains valid, that an offer is genuine, that the applicant may work for the new employer now, or that travel or a status change is safe. Nor does it determine the effect on a spouse or other derivative applicant, or whether a visa is available for the case.
USCIS’s 2020 policy alert says the Policy Manual consolidated prior instructions on portability requests and the agency’s same-or-similar job analysis. For a real employer change, use the current USCIS guidance and the documents in the case—not a generic title comparison or this overview alone—to evaluate the next step.
