Yes, you can use Bitcoin to pay a Virginia merchant that accepts it, but Virginia’s official sources do not provide a current merchant directory or show how common acceptance is. The state’s main recent change is a virtual-currency kiosk law scheduled to take effect July 1, 2027; it governs kiosk operators, not every Bitcoin payment.
What “using Bitcoin to pay” can mean
A merchant payment is different from buying Bitcoin through an exchange or using a virtual-currency kiosk. A merchant must choose to accept Bitcoin, while an exchange or kiosk is a service for acquiring, selling, or transferring virtual currency. Virginia’s official materials reviewed here do not identify businesses that currently accept Bitcoin or establish statewide adoption rates.

- Merchant payment: You send Bitcoin to a seller who agrees to accept it. Confirm the amount, exchange rate, fees, and payment instructions before sending.
- Exchange or custodial platform: A provider may facilitate buying or holding virtual currency. Review its terms, security and recovery arrangements, and any fiat transfers involved.
- Kiosk transaction: A virtual-currency kiosk is subject to a Virginia-specific framework scheduled to take effect in 2027. Those rules are not general rules for ordinary merchant checkout.
What Virginia currently says about virtual currency
The Virginia Bureau of Financial Institutions says it “does not currently regulate virtual currencies.” The Bureau also says that a transaction involving a transfer of fiat currency may fall under Virginia’s money-transmitter law, Chapter 19.1 of Title 6.2. Which provisions apply can depend on the service and transaction structure; the statement should not be read as meaning every related business or transaction is unregulated. See the Virginia SCC’s Notice to Residents Regarding Virtual Currency, revised August 11, 2026.

- BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
- SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
- NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
- 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
- BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.
What changes for Virginia virtual-currency kiosks in 2027
Virginia Code Chapter 22.2 establishes a framework for virtual-currency kiosk operators. Its provisions are scheduled to take effect July 1, 2027, so they should not be presented as requirements already in force as of October 8, 2026. The framework applies to kiosk activity, not to every Bitcoin wallet or merchant payment. Review the Virginia Code, Chapter 22.2 and its Article 1 provisions for the statutory text and effective date.
Disclosures and fraud controls
The future framework calls for clear disclosures of transaction terms, charges, and exchange rates, along with risk and fraud warnings. It also calls for operator fraud-prevention policies, blockchain analytics for relevant fraud detection, identity checks, and specified staff education. Fee refunds are described for qualifying fraud cases, subject to deadlines and documentation requirements.

Limits, holds, and charges
The statutory kiosk limits are scheduled future rules, not current limits for all Bitcoin use in Virginia:

Risks to weigh before paying or buying
The SCC warns that virtual currencies are highly volatile and may lose all value. It also says they are not insured against loss, may be stolen if not stored securely, and that transactions are final and irreversible. These are the agency’s general risk warnings, not a forecast of Bitcoin’s price or a guarantee about a particular wallet or transaction design. Read the notice at Virginia SCC: Virtual Currency.
- Verify the recipient and payment details. With an irreversible transaction, an incorrect address or mistaken payment may be difficult or impossible to recover.
- Check the total cost first. Compare the displayed exchange rate and all charges with the amount the merchant expects to receive.
- Understand who controls access. For a custodial service, review how account access and recovery work. For self-custody, protect the recovery information; losing it can mean losing access.
- Use a kiosk only after reading its terms. A kiosk’s displayed rate, fees, limits, and transfer instructions matter. The new statutory requirements described above are future-effective.
Wallets are for storage, not merchant processing
A hardware wallet is a physical device used to store or protect access to Bitcoin and authorize transactions. It does not, by itself, make a merchant accept Bitcoin or process payments on a seller’s behalf. The SCC’s security warning makes custody an important consideration, but it does not endorse a particular wallet or establish that one device is suitable for every user.

Tax questions need current, case-specific guidance
A 2024 report from Virginia’s Joint Commission on Technology and Science records discussion that the IRS treats digital assets as property for federal tax purposes and that Virginia state tax guidance was limited at that time. That dated report is not a complete or current answer about the tax consequences of an individual Bitcoin purchase or sale. Consult current state and federal tax guidance or a qualified tax professional for your circumstances.
