Crypto payments do not require an NFT, and selling an NFT does not automatically transfer copyright. For U.S. artists, digital assets can also create federal tax reporting obligations.
Crypto payment and NFT sale are different
When you accept cryptocurrency for a commission, digital download or other work, you are receiving a digital asset as payment. You do not need to mint a token or list the artwork on a marketplace to do this.
As an Amazon Associate I earn from qualifying purchases.
An NFT sale is different: a buyer acquires a token associated with a digital work. The token’s sale does not, by itself, settle what the buyer may do with the artwork or who owns its copyright. Make those rights clear in the terms that accompany the sale.
How can artists accept cryptocurrency?
Before offering crypto payments, decide what you will accept, how you will receive it and how you will document the transaction. The exact process depends on the wallet, network and payment service you choose; check their current terms and supported jurisdictions rather than assuming every asset or payment method is available everywhere.

- Choose a payment policy. Specify the accepted digital asset, the price or conversion method, when payment is due, and what happens if a payment is delayed or sent incorrectly. If you quote a price in traditional currency, state how and when you determine its crypto equivalent.
- Choose where payment will arrive. Check that your wallet or service supports the asset and network the customer will use. Confirm the receiving address and network before sharing payment instructions. A transaction sent to the wrong address or network may not be recoverable.
- Confirm the transaction before delivering the work. Check the receipt in the wallet or service you use and match it to the agreed amount and transaction. Do not rely only on a screenshot or a customer’s claim that payment was sent.
- Save records as you go. Keep the date, amount and asset received, fees, wallet or exchange records, and the value you use for your accounting. Preserve the related invoice, contract or commission details as well.
Receiving crypto means the amount you ultimately keep can be affected by transaction costs and by what happens to the asset after receipt. Decide in advance whether you will hold it, convert it or use it for expenses; those choices can have different consequences, and U.S. tax reporting may apply.
Do artists have to pay taxes on crypto payments?
For U.S. federal tax purposes, the IRS treats digital assets—including cryptocurrency, stablecoins and NFTs—as property, not currency. The IRS says income from digital-asset transactions is taxable and may need to be reported. The tax treatment of a particular art payment depends on its facts, so this is not individualized tax advice.

The IRS’s January 28, 2026 reminder says taxpayers must report related income, gains or losses whether or not they receive Form 1099-DA. It also says most Forms 1099-DA for 2025 will not include basis. Keep your own records rather than treating a form, or the absence of one, as a complete account of your tax obligations. Follow the current filing instructions for the relevant tax year and consult a qualified tax professional if you need advice about your situation.
- Record the transaction date, asset and amount received.
- Retain the value used for your accounting and the method or records supporting it.

What does an NFT buyer actually own?
Buying a token does not automatically give the buyer copyright or a license to reproduce, adapt, display commercially or otherwise use the associated artwork. Coinbase’s NFT terms make the distinction explicit: “When you purchase an NFT using our service, you should not assume that you own any copyright or license to the content associated with the NFT.” That statement is specific to Coinbase’s service terms, but the underlying distinction is important for artists selling NFTs generally.
Before listing a work, write down what rights the buyer receives and what rights you retain. For example, clarify whether the buyer may display the work privately, use it commercially, make copies, or create adaptations. Do not imply that token ownership transfers copyright unless that is actually what your agreement says. Also read the marketplace’s terms: they may grant the service a license to handle or display content, separate from the rights granted to the buyer.

Do NFT artists get royalties on resales?
Not necessarily. A creator-earnings setting is not a guarantee that every later sale will pay the artist. OpenSea describes creator earnings as optional or enforced; whether enforcement applies depends on compatible contract standards and configuration. Enforcement may not carry across marketplaces or transactions that do not honor the relevant setup.
Before promising resale income, check the token contract and marketplace settings, understand where enforcement applies, and describe the arrangement accurately to buyers. Treat any expected resale earnings as uncertain unless the specific transaction and compatible systems establish otherwise.

What fees can reduce NFT proceeds?
Marketplace charges and network costs are separate. As a dated example, OpenSea’s fee page, updated May 12, 2026, lists typical fees of 1% for selling NFTs and 10% for primary drops. The same page says fees can change. Gas is a separate blockchain-validator cost, not an OpenSea fee. Check the applicable charges at the time of a transaction; the figures are not a permanent schedule or a ranking of marketplaces.
When comparing a service, look beyond its headline fee. Check primary- and secondary-sale charges, network costs, how creator earnings are handled, wallet custody and recovery responsibilities, content-license terms, and support for your jurisdiction, payment method and network. Features and terms can change, so verify them before minting or accepting payment.
How do I keep crypto in a wallet safely?
With self-custody, you control the wallet and are responsible for its security and recovery. Coinbase’s NFT terms warn: “Because you control your wallet, there is no way for us to help you if you lose control over your wallet.” This is a service-specific statement, but it captures a central self-custody risk: losing access to recovery information can mean losing access to assets.
Quick Recap
- Keep the recovery phrase private and store it securely; never share it in response to an unsolicited request.
- Check the destination address, asset and network before confirming a transfer.
- Use a hardware wallet only if it fits your needs. It is an optional accessory, not a substitute for checking transactions or protecting recovery information.
- Understand whether a service holds assets for you or whether you control the wallet, and read its recovery and support terms before relying on it.
A practical decision checklist
- For a crypto payment: Can you clearly state the accepted asset, network, price basis and payment deadline—and keep the records needed for accounting?
- For an NFT: Are the buyer’s license and your retained rights written down, and have you checked the marketplace’s content license?
- For future resale earnings: Do you know whether creator earnings are optional or enforced and which compatible contracts and marketplaces honor them?
- For custody: Do you understand who controls the wallet, how access is recovered, and what happens if the recovery phrase is lost?
- For costs: Have you checked current service fees and separate network costs before committing to a sale?
