Yes, you may be able to use an AI-generated 3D asset in a commercial game, but the answer depends on more than whether the generation tool says “commercial use allowed.” You also need to check the asset’s license, the rights of whoever supplied it, any third-party material it resembles or contains, and the publishing rules of the platform where you sell or distribute it. In the United States, permission to use an asset commercially is separate from whether you own copyright in it.
This guide focuses on U.S. copyright guidance and examples from Unity, Fab, and Epic. It is not a universal statement of law: copyright, contract, and platform rules can differ by country and change over time. This is general information, not legal advice.

Can you use AI-generated 3D models in a commercial game?
Often, potentially—but there is no single permission called “commercial use” that settles every issue. The relevant answer comes from several separate sources of rights and rules:

- The asset license: If you downloaded or bought the model from a marketplace or another creator, does that specific license cover your intended use?
- Underlying rights: Does the person licensing the model have authority to do so, and does the asset include or closely reproduce protected material owned by someone else?
- Publishing requirements: Does the store or platform require you to disclose AI use or meet other submission rules?
A “yes” to one question does not automatically mean “yes” to the others. For example, a generator’s terms might permit commercial use of its outputs, while a marketplace license for a particular downloaded asset might restrict redistribution. Neither permission necessarily clears a recognizable third-party logo or character in the model.

It also matters how you distribute the asset. Shipping a model as part of a playable game is different from selling the model as a separate downloadable file, sharing its source files, or including it in an asset pack. Check the license against the actual distribution plan, not just the fact that the project earns money.
Commercial permission is not the same as copyright ownership
A license is a set of permissions and conditions. Copyright determines whether protected expression exists, who owns it, and what rights that owner can exercise. Those questions can overlap, but they are not interchangeable: permission to use an output does not by itself prove that you own copyright in every part of it.
For the United States, the U.S. Copyright Office said in NewsNet Issue 1060 (2025) that using AI as an aid, or including AI-generated material in a larger human-generated work, does not bar copyrightability. That statement does not establish that every purely machine-generated output is protected, or decide the status of every AI-assisted workflow. For an individual asset, the significance of human-authored expression depends on the facts of how it was created.
What human contribution means in practice
Keep a clear record of the work you or your team actually contributed: for example, original modeling, sculpting, texturing, rigging, animation, or other expressive changes. Note which parts came from a generator and which were authored or modified by people. The relevant question is not simply whether someone touched the file, but what human-authored expression is present and how it relates to the finished work.

Do not assume that a particular number of edits, hours, or percentage of changed geometry guarantees copyright. The available guidance does not set a numeric threshold. If copyright ownership matters to a deal, do not promise that an asset is fully protected or exclusively yours solely because it was edited after generation.
Check the generation terms and the asset’s own license
Start with the terms for the tool that generated the model. Look for the provisions that apply to outputs, commercial use, ownership or licensing, attribution, prohibited uses, and any limits on sharing or sublicensing. Terms may distinguish between account types, output types, or uses, so apply the actual terms for the service and workflow you used.
Next, inspect the license for the particular marketplace asset. A marketplace’s general description is not a substitute for its binding agreement, and one marketplace’s permissions do not establish another’s.
Example: embedding an asset versus reselling it
Fab’s Standard License summary says it permits commercial and private use, modification, and commercial distribution of projects that incorporate licensed assets. It also says standalone resale or free redistribution of the asset is forbidden. The summary directs users to the full EULA, which is binding; check that agreement and the selected license for the actual asset rather than relying on the summary alone.

Fab’s summary also says its Personal and Professional tiers have the same scope of rights, while Reference-Only provides access in referenced form rather than source format. That difference can matter if your production pipeline requires the source model or if collaborators need to edit it. Fab documentation describes the marketplace as offering Unreal Engine, Unity, and other 3D formats, but a supported format is not proof that an individual model is rights-cleared.
Make the license fit the project
Before integrating a model, confirm whether the relevant terms cover the project’s distribution method, platforms, revenue model, modifications, team access, and any source-file access you need. If a license restricts standalone redistribution, consider whether the game or downloadable content would expose the model in a way that effectively distributes it as a separate asset. When the terms do not clearly answer that question, ask the licensor or obtain qualified legal advice rather than assuming.
Save the asset listing and license version, the generation-service terms that applied, any seller representations, and relevant workflow records at the time you acquired or generated the asset. The records help establish what you relied on and what permission you obtained; they do not create rights that the seller or service did not have.
A marketplace license does not clear third-party material
A license from a generator or marketplace is not necessarily a warranty that every right in an output has been cleared. Check who created or generated the asset, whether the seller has authority to license it, and whether the model includes recognizable material that could belong to someone else.

Screen the model and its textures, labels, and presentation images for recognizable characters, logos, brand names, and copied designs. An output that resembles a protected work can raise questions even when it was generated rather than deliberately copied. Resemblance alone does not decide whether infringement occurred; the facts and applicable law matter. But a commercial release is a poor time to discover that a prominent asset evokes a third party’s protected property.
Epic’s marketplace guidelines tell sellers not to use copyrighted or trademark-protected names, branding, or content unless they own it or have adequate permission. Treat that as a practical screening prompt, not as a final legal test for every game asset. If a model contains or depends on third-party material, seek documented permission where needed or replace it with original material.

If you submit an asset to the Unity Asset Store, follow Unity’s publisher guidance as well as the store’s terms. Unity requires publishers to identify the AI tools used and the content generated in an “AI description” field. The description should use plain language, avoid marketing language, and explain modifications that add value beyond the generated result.

Its guidance reserves the right to reject mass-produced AI submissions that lack sufficient differentiation or customer value. These are Unity submission requirements, not a universal legal disclosure rule for every commercial game.
Unity identifies the Asset Store Terms and applicable Asset Store EULA as governing store use. Its terms page notes a revision dated December 4, 2024, clarifying restrictions on using store content to train AI or machine-learning models. That restriction concerns use of store assets for training; do not treat permission to use an asset in a project as permission to use it for model training. Check the current terms and applicable EULA before relying on a past copy.
Epic content licenses are separate from Unreal Engine software terms
Do not assume that using Unreal Engine software gives you a license to every marketplace asset used with it. Epic’s content EULA has distinct content addenda and defines “Generative AI Program”; the applicable content license for the actual asset is the one to examine. Check the content terms and any relevant addendum rather than relying on the engine’s software license to answer an asset-rights question.
This distinction applies broadly: the software used to build a game, the service that generated a model, and the license for a downloaded model can each be governed by different terms. Keep them separate in your review.
A practical clearance workflow before release
- Identify the asset and its origin. Record whether it was generated in-house, obtained from a marketplace, or supplied by a contractor. Keep the listing, creator information, and any seller statements about rights.
- Save the applicable terms. Retain the generation-service terms and the asset license or EULA version that applied when you generated or acquired the model. Note the specific license tier and whether the source format is included.
- Match the license to the intended use. Check game distribution, downloadable content, platforms, collaborators, modifications, revenue model, and whether the model or source file will be made available separately. Resolve any uncertainty about standalone redistribution before release.
- Record human-authored work. Preserve prompts and workflow records where relevant, along with project files or notes that distinguish generated material from human-authored modeling, texturing, rigging, animation, or other changes. Do not treat documentation as a guarantee of copyrightability.
- Screen for third-party material. Review the model and associated textures for recognizable characters, logos, brands, names, or copied designs. Obtain documented permission where needed, or replace the questionable material.
- Check destination-platform rules. For Unity Asset Store submissions, complete the AI description as required and describe tools, generated content, and value-adding modifications accurately. For other destinations, review their own current rules.
- Escalate high-risk cases. Seek qualified legal advice for a high-value release, disputed provenance, unclear license language, or material similarity to third-party content.
Common mistakes that create licensing risk
- Reading “commercial use” as “I own the copyright.” The phrase may grant contractual permission without establishing exclusive copyright ownership.
- Assuming a marketplace listing covers every use. Read the specific asset license and the binding agreement; check for restrictions on source files or standalone distribution.
- Confusing an engine license with a content license. Software and marketplace assets can have separate agreements.
- Treating a seller’s upload as proof of authority. A listing does not by itself verify that the seller controls all relevant rights.
- Assuming edits erase all concerns. Human modifications may matter to copyrightability, but they do not automatically clear third-party material or cure an incompatible license.
- Using outdated terms or incomplete AI disclosures. Platform rules can change, and inaccurate descriptions can create a separate submission problem even where the underlying use is otherwise permitted.
What this means outside the United States
The copyright discussion here is centered on U.S. Copyright Office guidance. It does not resolve copyrightability or infringement under other countries’ laws, the terms of every generation service, the provenance of a particular model, or how a court would decide a specific dispute. Commercial release across multiple countries may require checking the relevant local rules as well as the contracts governing the asset and platform.
