How AI Chatbots Protect Children’s Privacy—and What Parents Should Check

AI chatbot privacy rules and parental controls vary. Check age and consent terms, prompt data use, deletion, third-party sharing, and what parents can manage.

There is no single privacy standard shared by AI chatbots. Before a child uses one, check its age and consent rules, what it collects and does with prompts, how long it keeps data, who it shares information with, and what a parent can see or manage. In the United States, COPPA gives parents specific rights when a covered service collects personal information from children under 13; those protections do not automatically apply to every chatbot or every situation.

Start with the service’s age and consent rules

Find the chatbot’s current terms for your region rather than relying on an age label in an app store or an old comparison chart. Check the minimum age, whether parental consent is required, and whether the rules differ for teenagers. Age limits and controls can change, so revisit the provider’s terms when setting up an account.

For ChatGPT, OpenAI says the service is not meant for children under 13 and requires parental consent for users ages 13–18. It also cautions that its outputs may not be appropriate for every age. See OpenAI’s Terms of Use.

Check what the chatbot collects and how it uses it

Read the provider’s privacy policy and look for information gathered from prompts, account activity, devices, and connected features. Determine whether it is used to run the service, personalize responses, or improve models, and whether settings let you limit any of those uses. Do not assume that a service’s privacy approach matches another chatbot’s; compare the actual policies and settings for each provider.

Before a child starts, agree that they should not enter sensitive details such as a home address, passwords, school schedule, or private information about another person. A chatbot conversation can include more identifying information than a child realizes.

Understand retention, deletion, and parental rights

Look for separate instructions to delete individual conversations and close an account, and check what the policy says about retention after deletion. Also establish whether a parent can review or request deletion of a child’s information. In the United States, the FTC says parents of children under 13 have rights to review and require deletion of personal information collected by operators covered by COPPA. The law generally requires verifiable parental consent before covered collection, subject to exceptions. See the FTC’s COPPA guidance.

The FTC’s 2025 announcement about amended COPPA requirements says covered third-party disclosures require separate verifiable parental opt-in and that information cannot be retained indefinitely; retention must be limited to what is reasonably necessary for its purpose. Applicability and compliance dates depend on the final rule and the service’s circumstances. These are U.S. protections for covered operators, not a universal chatbot rule.

Find out whether information goes to third parties

Check whether the provider discloses personal information to other companies, including for advertising, analytics, or connected features. Look for what is shared, why, and whether parental consent or an opt-in is required. If the policy does not clearly answer those questions, do not infer that no sharing occurs; ask the provider or choose a service whose terms you can understand.

See what a parent can actually control

Available tools vary by provider. Check whether you can link accounts, set usage limits, manage memory or model-improvement settings, or receive safety notifications. Confirm what linking exposes to a parent: account management does not necessarily mean a parent can read every conversation.

OpenAI describes linked parent and teen ChatGPT accounts with settings parents can manage, additional protections for teen accounts, and limited notifications in rare urgent safety situations. It says only information needed to protect a teen’s safety is shared in those situations. The details are in OpenAI’s parental-controls announcement. Controls are a useful part of a family plan, not a substitute for talking with a child about their use.

Ask how the service handles age

A date-of-birth question is not proof that a service verifies age. Age assurance can involve different approaches: a user stating an age, a service inferring age from signals, estimating it, or verifying it with evidence. The UK Children’s Commissioner explains these distinctions in its guide to AI and children. Its cross-service age information is a December 2025 snapshot, not a live comparison, and may have changed.

OpenAI says ChatGPT uses account and behavioral signals—including account age, typical activity times, usage patterns, and stated age—to predict whether an account belongs to a teen. It says predicted teen accounts receive added protections and that people incorrectly placed in the under-18 experience can confirm their age through Persona. This is OpenAI’s description of its system, not an independent assessment of its accuracy. Details are in OpenAI’s explanation of age prediction.

Make a short family plan

Set expectations before handing over access. A practical plan can cover what not to share, what to do when an answer feels upsetting or confusing, and how to report a troubling interaction. Make sure the child knows they can come to a trusted adult without getting in trouble for asking for help. Common Sense Media’s Robbie Torney, quoted in OpenAI’s parental-controls announcement, likewise describes controls as one part of online safety alongside ongoing conversations, clear family rules, and active involvement.

  • Review the chatbot’s current age and consent terms for your location.
  • Read its privacy policy for prompt use, account data, model improvement, third-party sharing, and retention.
  • Locate the conversation and account deletion options, and understand any parent review rights that apply.
  • Test parent linking and settings so you know what they do—and what they do not reveal.
  • Agree on safe sharing and reporting rules with the child, then revisit them as the service or its settings change.
