Hemp is a category of cannabis plant; THC and CBD are compounds found in cannabis. THC is associated with marijuana’s intoxicating high, while CBD does not produce that high—but it can still cause side effects and interact with medicines. A hemp label or a product’s advertised CBD content does not establish that it is safe, effective, or approved for a medical use.
Hemp, THC, and CBD are not interchangeable terms
Hemp describes a cannabis category, not a cannabinoid. THC (tetrahydrocannabinol) and CBD (cannabidiol) are compounds that can be present in cannabis. CBD can come from hemp or marijuana, so “hemp” does not mean “CBD,” and a CBD product is not necessarily made from hemp. The CDC’s explanation of CBD and the FDA’s consumer overview describe these distinctions.

How THC and CBD differ in effects—and what labels cannot tell you
The key practical distinction is intoxication: FDA identifies THC as the component that produces the high associated with marijuana use, while CDC says CBD does not produce a high. That distinction does not predict every effect or individual response. The available federal guidance does not provide a complete dose-by-dose comparison, and a product label alone is not enough to predict how it will affect you.

Do not assume that “hemp-derived” means a product contains no THC. The federal hemp definition concerns delta-9 THC concentration in the plant material on a dry-weight basis; it is not a guarantee about the contents, effects, or quality of every consumer product. CDC also warns that CBD can be synthetically converted into delta-8 THC, a psychoactive compound that is not well understood. That warning is not evidence that all CBD products contain delta-8 THC.

CBD and THC risks to consider
CBD can have side effects and interactions
FDA identifies potential CBD risks including liver injury, sleepiness or sedation, and changes in how other medicines work. CBD may increase drowsiness when combined with alcohol or drugs that slow brain activity. If you take medication or are considering CBD, discuss it with a health-care provider; FDA says consumer use of CBD products should always be discussed with one.
Pregnancy and breastfeeding

What U.S. federal rules do—and do not—tell you
The 2018 Farm Bill’s hemp definition, as described by FDA, uses a limit of no more than 0.3% delta-9 THC on a dry-weight basis. That is a legal classification threshold, not a safety test or product approval. FDA retains authority over products subject to the Federal Food, Drug, and Cosmetic Act. Its cannabis and CBD regulation overview says it is currently illegal to market CBD by adding it to food or labeling it as a dietary supplement under the agency’s discussion of applicable law.
FDA has approved Epidiolex, a prescription CBD drug, for specified seizure disorders. That approval does not extend to CBD oils, gummies, or other consumer products, and FDA says other CBD products have not been approved as drugs to treat disease. Do not treat evidence for a prescription medicine as proof that a consumer product will provide the same benefit.

- Identify the cannabinoid and intended effect. Distinguish CBD from THC and do not equate a hemp label with a CBD-only product or a promise of no intoxicating effects.
- Check whether the intended use is approved. FDA’s approval of prescription Epidiolex applies to specified seizure disorders, not to consumer CBD products or other medical claims.
- Consider medicines and sedation risks. Ask a health-care provider about CBD if you take medication, and consider the potential for drowsiness, especially alongside alcohol or medicines that slow brain activity.
- Assess what the label and quality evidence actually establish. A hemp classification or advertised cannabinoid content does not by itself prove product-level safety, effectiveness, or consistent contents. Do not infer FDA review or approval from a product being sold.
- Check the rules for your location. Federal guidance does not resolve state-specific requirements, which may vary and change.
Hemp seed oil is different from CBD oil
Hemp seed oil is made from hemp seeds and should not be confused with cannabinoid CBD oil. FDA says hemp seeds do not naturally contain CBD or THC. The agency identifies hulled hemp seed, hemp seed protein powder, and hemp seed oil as ingredients that can be used in the U.S. food supply subject to applicable food requirements; that is distinct from approval of a CBD product.
