1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsAt a GST roadside check, an e-way bill and the commercial document accompanying the goods serve different purposes: the e-way bill records movement details, while the invoice, bill of supply or delivery challan supports the transaction or movement. Officers may also inspect the conveyance and goods, but that is a separate step governed by authorization and reporting rules. This overview covers the central CGST framework; applicable State or Union Territory notifications and the facts of a movement can affect the result.
What the driver should be ready to show
For covered movements, Rule 138A requires the person in charge of the conveyance to carry the applicable commercial document and an e-way bill copy or number. The commercial document is generally the invoice, bill of supply or delivery challan, depending on the movement. The e-way bill may be carried physically or its number may be mapped to a notified RFID device. Rule 138A also allows a valid Invoice Reference Number to substitute for a tax invoice in the stated circumstances, and a Commissioner may notify cases where specified documents are carried instead of the e-way bill. See the CBIC E-Way Bill Rules.

- Commercial document: invoice, bill of supply or delivery challan, as applicable.
- E-way bill: a copy or number, in the permitted form.
These are not generally interchangeable. An invoice does not by itself stand in for the e-way bill when the rules require one, and an e-way bill does not ordinarily replace the commercial document.

When the e-way bill is generally required
Under Rule 138, a registered person causing movement of goods with a consignment value exceeding ₹50,000 generally must furnish the prescribed information and generate the e-way bill before movement begins. The rule covers movement related to a supply, movement for reasons other than supply, and inward supply from an unregistered person. It permits optional e-way bill generation below the threshold and contains exceptions; applicable notifications can also matter. Check the current rule and notifications for the specific goods and route rather than treating ₹50,000 as a universal trigger in every situation. The rule text is published on the CBIC E-Way Bill Rules page.

How the roadside checks differ
| Check | What is examined | Legal framework |
|---|---|---|
| E-way bill verification | The copy or number and the movement information associated with it. | Rules 138A and 138B of the CGST Rules. |
| Commercial-document check | The applicable invoice, bill of supply or delivery challan, including whether it is present and consistent with the movement. | Rule 138A and section 68 of the CGST Act. |
| Physical inspection | The conveyance and goods in transit, not just the documents. | Section 68 and Rules 138B and 138C of the CGST Rules. |
Section 68 provides for required documents or devices to be carried and says that, after interception, the person in charge must produce them for verification and allow inspection of the goods. Rule 138B permits an authorized proper officer to intercept a conveyance to verify the e-way bill or its number for inter-State and intra-State movement. It separately addresses physical verification of conveyances, including the approval required when an officer acts on specific information about tax evasion. The CBIC-published CGST Act and CGST Rules updated 1 June 2021 set out these provisions.
Inspection records and repeat physical checks
Rule 138C requires the inspecting officer to upload a summary report in Part A of FORM GST EWB-03 within 24 hours and a final report in Part B within three days. For sufficient cause, the final-report period may be extended by up to three more days. The time is counted from midnight of the date of interception. After physical verification at one transit location, another physical verification is not to be carried out unless specific information relating to tax evasion becomes available later. These are procedural rules for the inspection record and repeat checks; they do not make the e-way bill a guarantee against inspection.

Minor errors are not the same as missing documents
CBIC Circular 64/38/2018-GST, dated 14 September 2018, gives examples where section 129 proceedings may not be initiated if the consignment is accompanied by an invoice or other specified document and an e-way bill. Examples include spelling errors in a consignor’s or consignee’s name when the applicable GSTIN is correct; certain PIN-code or locality/address errors; one or two incorrect digits in a document number; specified 4- or 6-digit HSN errors where the first two digits and tax rate are correct; and one or two incorrect characters in a vehicle number. The circular’s examples are limited to the stated conditions. They are not permission to omit required documents or an assurance against action in other circumstances. Read the CBIC circular.

Section 126 of the CGST Act sets general principles for penalties, including treatment of minor breaches and easily rectifiable documentation errors made without fraudulent intent or gross negligence. It also calls for penalties to be commensurate with the breach and an opportunity of hearing. Those principles do not guarantee a particular outcome under section 129, which has its own process and calculations.

What happens if goods are detained
Under section 129 of the CGST Act, goods, the conveyance and related documents may be detained or seized when goods are transported in contravention of the Act or rules. Release is available through the applicable tax and penalty payment or security route. The proper officer must issue an order of detention or seizure, give notice stating the tax and penalty, and provide an opportunity to be heard. If payment is not made within seven days, further proceedings under section 130 may follow; the proper officer may reduce that period for perishable or hazardous goods, or goods likely to depreciate. The amount is not one universal figure: it depends on statutory conditions, including owner participation and whether the goods are taxable or exempt. Consult the Act text at CBIC’s CGST Act page and seek case-specific advice for an actual detention.

If an intercepted vehicle is detained for more than 30 minutes, Rule 138D allows the transporter to upload information about the detention in FORM GST EWB-04 on the common portal. This records the event; it is not an appeal against a detention order and does not itself secure release. The provision appears in the CGST Rules updated 1 June 2021.
