Under section 169 of India’s Central Goods and Services Tax Act, 2017 (CGST Act), a GST communication can be served in several ways: direct delivery, specified post or courier, email, availability on the GST common portal, newspaper publication, or—only when earlier methods are impracticable—affixation at the last known address or on the authority’s notice board. Section 169(2) provides a deemed-service date for communications tendered, published or affixed under section 169(1). The time allowed to reply is not one universal number: it comes from the particular notice and the section or rule cited in it.
This explanation focuses on the central statute and the notice-specific procedure. State GST laws, IGST provisions, departmental instructions and judicial decisions can affect a particular dispute, so a contested service or deadline should be checked against the current law and the case’s facts.

What section 169 of the CGST Act covers
Section 169 is the CGST Act’s service-of-communication provision. It applies to decisions, orders, summonses, notices and other communications issued under the central GST law. The section does not create a single reply period for all of those documents; it mainly describes how the department may serve them and when service is treated as having occurred. The text is available in the CBIC-hosted CGST Act at section 169 of the CGST Act.

Do not treat an email, portal entry or postal event as automatically establishing the same date in every dispute. The document, the recorded mode of service, the applicable rule and the evidence available in the individual case all matter.
How are GST notices served?
1. Direct delivery or tender
An officer may give or tender the communication directly, including through a messenger or courier. The permitted recipient can be the addressee or specified people connected with that person, such as an authorised representative or an employee. For an individual taxable person, an adult family member residing with that person is also listed. Preserve the copy, the date and any acknowledgement or delivery record.
2. Registered post, speed post or courier
The communication may be sent by registered post, speed post or courier with acknowledgement due to the intended person or authorised representative at the last known place of business or residence. Keep the envelope, tracking history, acknowledgement card, returned article and any address records. A change of premises does not by itself answer whether the department used the legally relevant last known address; that question may require examination of registration and departmental records.

3. Email
Section 169 lists sending the communication to the email address furnished at registration or later amended. Businesses should maintain access to that mailbox, preserve the original message and headers where possible, and retain attachments in their received form. An argument that an email was not opened is not automatically decisive; the effect of the recorded sending and the surrounding facts should be assessed under the governing law.
4. Availability on the common portal
Making the communication available on the GST common portal is expressly listed as a service mode. The GST Council’s materials reproduce section 169 and identify email and portal availability among the statutory methods (GST Council, 52nd meeting materials). Regularly check the notices and orders area, download every document and record the date and time shown by the portal. A notice that is unopened or overlooked is not automatically treated as unserved; a disputed portal-service question depends on the record and applicable interpretation.
5. Publication in a local newspaper
The communication may be published in a newspaper circulating in the relevant locality. Retain the full page, publication date, newspaper title and edition. Publication is different from a general press announcement: the statutory method concerns the communication being published in a newspaper serving the relevant locality.

6. Affixation as a fallback
If the preceding methods are not practicable, the communication may be affixed at the person’s last known place of business or residence. If that too is impracticable, it may be affixed on the issuing authority’s notice board. Photographs, an officer’s report, the address used and the notice-board details can become important evidence of what was done and when.

| Registered/speed post or courier with acknowledgement due | Last known business or residence address | Date of tender/service as documented; section 169(2) addresses tender, publication or affixation | Envelope, tracking, acknowledgement, returned article and address records |
| Email address given at registration or later amended | Record the department’s sending details and the notice’s stated service information; a disputed date needs fact-specific review | Original email, headers, attachment metadata and mailbox export | |
| Common portal | GST common portal account | Record the portal availability date and the notice’s stated service information; legal effect can depend on the record | Downloaded PDF, portal timestamp, dashboard screenshot and audit trail |

The statute’s exact deemed-service wording should be read with the particular record. The table distinguishes the statutory event from the evidence a recipient should preserve; it does not replace a review of the notice and the applicable provision.
Is a notice uploaded to the GST portal considered served?
Portal availability is expressly included in section 169(1), so a portal upload is a recognised service channel under the CGST Act. That does not mean every dispute can be resolved merely by asking whether the recipient clicked “open.” Download the notice promptly and preserve the portal’s displayed date, document number, issuing authority and any acknowledgement or activity log.

Section 169(2) specifically describes deemed service on the date a communication is tendered, published or affixed in the manner provided in subsection (1). Because the subsection’s wording does not supply a single formula for every email or portal fact pattern, do not invent a universal rule such as “the deadline always starts the day after upload.” Use the notice’s stated service date, the cited procedural rule and the available portal or departmental record. If those conflict, obtain prompt advice from a qualified GST professional.
When does the deadline to reply start?
The deadline is notice-specific. First identify the form or description of the notice and the section, rule or notification it cites. Then read the paragraph that states how long the recipient has to respond and from what event the period is measured. A delivery date under section 169 and a reply period under another provision are related but separate questions.
- Identify the legal provision. Note the section, rule, form number and tax period. Do not rely on the word “notice” alone.
- Record every service indicator. Write down the date shown on the notice, the portal availability date, email transmission details, postal tracking events or direct-delivery acknowledgement.
- Find the stated response period. Check whether it is expressed in calendar days, working days, or another measure, and whether the rule counts from service, receipt, issue or another event.
- Calculate conservatively. If the notice gives a final date, treat it as controlling unless the governing provision or a competent authority establishes a different calculation. Account for the exact day-counting language and any officially recognised extension.
- Escalate uncertainty immediately. If the notice omits a deadline, gives inconsistent dates or was served through a disputed method, ask a qualified GST practitioner to review it rather than guessing.
Example: a seven-working-day registration response
CBIC’s GST registration rules provide an example in which a person receiving a specified registration-cancellation notice must show cause within seven working days from service (CBIC GST registration rules). That is a rule-specific period for that registration procedure. It is not a seven-working-day answer for scrutiny notices, demand notices, summonses, appeal-related communications or every other GST document.

What if you did not receive the GST notice by post?
Non-receipt should be documented, not assumed to cancel the proceeding. Check whether the department used another listed method: portal availability, the registered or amended email address, direct tender, newspaper publication or fallback affixation. Compare the address on the postal record with the last known business or residence address in the relevant records.
An older FAQ hosted by Kerala Taxes and identifying the Institute of Chartered Accountants of India describes a proposition that a postal item may be deemed received when the period normally taken by post expires unless the contrary is proved (Kerala Taxes GST FAQ). That document is not a safe universal answer for every current GST notice. Its proposition must be checked against the notice type, current statutory text, evidence and applicable case law.
Save the returned envelope, tracking page, delivery attempt notes, address-change records and a written chronology of when you actually learned of the notice. File a response or request for appropriate relief as soon as possible; waiting for a definitive answer on service can allow a separate statutory period to expire.

Within the first review
- Download the complete notice, annexures and any linked order from the portal.
- Preserve the original email and all attachments, not only a printed copy.
- Photograph or scan postal envelopes, acknowledgements and affixation material.
- Check the taxpayer’s registration profile for the email and addresses that were active when service allegedly occurred.
Before preparing the reply
- Write a one-page timeline: issue date, each alleged service event, actual discovery date and stated deadline.
- Match every allegation to the cited section, rule, tax period and requested documents.
- Confirm whether the period is in working or calendar days and whether the notice specifies a particular reply channel.
- Use the official portal acknowledgement or other proof of filing and retain the reference number.
If service or time is disputed
- State the factual objection precisely: wrong address, missing annexure, no portal record, incorrect email, or another identifiable defect.
- Attach objective evidence and explain when the notice was first discovered.
- Submit the substantive response as well when feasible; a service objection alone may not protect the merits of the case.
- Seek professional advice promptly where an order, recovery action, registration cancellation or appeal limitation is involved.
Common mistakes that create avoidable risk
- Assuming every GST notice allows the same number of days. The period comes from the notice-specific provision.
- Ignoring the portal because no email arrived. Portal availability is a listed statutory mode.
- Deleting “old” emails or envelopes. Those records may establish the alleged service method and date.
- Counting from the printed issue date without checking service. Many procedures measure time from service or another expressly defined event.
- Treating a postal FAQ as current case law. The older Kerala Taxes FAQ is informative but does not settle every present dispute.
- Arguing only non-receipt. Explain the factual defect while also addressing the notice on its merits and preserving all procedural rights.
What to remember
For the CGST Act, section 169 allows multiple service channels and section 169(2) sets a deemed-service rule for communications tendered, published or affixed in the specified manner. A portal upload can therefore be a valid mode, while a postal non-receipt argument depends on the complete factual record. The reply deadline must be calculated from the particular notice and its governing provision—such as the seven-working-day registration example—not from a universal GST rule. Preserve dated portal, email, postal and delivery evidence and obtain prompt, qualified advice whenever service or timing is contested.
