GST Audit vs. Assessment vs. Show-Cause Notice: Key Differences

A GST audit examines records, assessment determines tax payable, and a show-cause notice invites a response. Here’s how the processes differ under the CGST Act.

A GST audit examines records and compliance; an assessment determines tax payable; and a show-cause notice (SCN) asks you to respond to proposed action or liability. They are distinct steps or procedures under India’s GST framework, though they can be connected. An audit finding or SCN is not, by itself, necessarily a final tax-demand order.

What is the difference between a GST audit and assessment?

Under the Central Goods and Services Tax (CGST) Act, the terms refer to different functions. The exact provision and officer named in a communication matter; state and Union Territory GST laws may also be relevant.

Process Purpose Who acts Typical document or outcome CGST Act provisions
Audit Examine records and test declared turnover, tax paid, refunds, input tax credit (ITC), and compliance. A tax officer for a section 65 audit; a nominated chartered accountant or cost accountant for a section 66 special audit. Audit notice and findings; further proceedings may follow where applicable. Sections 65 and 66.
Assessment Determine tax payable, through self-assessment or an officer-led statutory route. The registered person for self-assessment; an officer for the relevant officer-led route. A return, assessment order, or procedural outcome, depending on the route. Sections 59–64, with other tax-determination provisions relevant in context.
Show-cause notice Give the recipient an opportunity to answer proposed grounds, liability, or action. The proper officer under the provision cited. A notice seeking a response; it is not itself the final order. Sections 73, 74, or 74A may apply to tax-determination matters.

What does a GST audit involve?

The Act defines audit as examination of records, returns, and other documents to verify declared turnover, taxes paid, refunds claimed, ITC availed, and compliance. A section 65 tax-authority audit may take place at the registered person’s business premises or at the officer’s office. The rules describe FORM GST ADT-01 for an audit notice and FORM GST ADT-02 for communicating findings; the audit period is a financial year or multiples of a financial year.

Section 65 sets out procedural periods: at least 15 working days’ advance notice; completion within three months from commencement, with a reasoned extension of up to six further months; and communication of findings, rights, obligations, and reasons within 30 days of conclusion. These are statutory periods, and the applicable text and any amendments should be checked for the relevant proceeding.

During an audit, the officer may examine books and supporting documents, returns, turnover, exemptions or deductions, tax rates, ITC, refunds, and other relevant matters. The registered person can respond to discrepancies before findings are finalised.

What does “assessment” mean under GST?

Assessment is broader than an audit. Section 59 provides for self-assessment: a registered person assesses taxes payable and furnishes returns. Officer-led routes address particular situations:

  • Provisional assessment (section 60): where the taxable person cannot determine the value of goods or services, or the applicable tax rate.
  • Scrutiny of returns (section 61): the officer checks a return for discrepancies and may seek an explanation. The rules use FORM GST ASMT-10 for a discrepancy notice and provide for taxpayer and officer response forms.
  • Non-filer assessment (section 62): an assessment route for a registered person who has not furnished a required return; the rules identify FORM GST ASMT-13 for the order.
  • Assessment of an unregistered person (section 63): the rules identify FORM GST ASMT-14 for the notice and FORM GST ASMT-15 for the order after the prescribed opportunity to reply.
  • Summary assessment (section 64): for certain urgent circumstances; the rules identify FORM GST ASMT-16.

Use the current rules and the communication itself to verify forms and deadlines. A scrutiny explanation may resolve a discrepancy; an unresolved issue can lead to further action under the applicable provision.

Is a GST audit the same as a show-cause notice?

No. An audit is an examination; an SCN is a procedural notice inviting an answer to a proposed action or liability. Under sections 73 and 74, a proper officer may require a person to show cause why specified tax, interest, and applicable penalty should not be paid. Section 73 addresses cases other than fraud, wilful misstatement, or suppression to evade tax; section 74 addresses cases involving those grounds.

The CGST Act also contains section 74A, a tax-determination route for tax not paid or short paid, erroneous refunds, or wrongly availed or utilised ITC. It distinguishes consequences by circumstances, including fraud or similar conduct. Which section applies depends on the tax period and the law in force for that period; do not assume every matter falls under section 73 or 74.

Does an audit automatically mean I have to pay a GST demand?

No. If a section 65 audit detects tax not paid or short paid, an erroneous refund, or wrongly availed or utilised ITC, section 65(7) allows the proper officer to initiate action under the applicable tax-determination provision. That is a possible next step, not an automatic demand. Audit findings, a later notice, and a determination order are separate procedural events.

What should I check first when I receive a GST notice?

Identify what the document actually is before deciding what it requires. A notice connected to scrutiny, an audit communication, an SCN, and an order can have different purposes and response requirements.

  1. Find the statutory provision. Note the section cited and whether the document is a notice, request for information, findings communication, or order.
  2. Record the tax period and alleged facts. Check which returns, transactions, or conduct the officer refers to.
  3. Review the proposed computation. Identify the tax, interest, penalty, or other action proposed and how the amount is explained.
  4. Check the response date and service details. Record when and how the communication was served; do not infer a deadline from another type of GST proceeding.
  5. Verify the issuing officer and legal route. Read the notice against the current provision and rules applicable to the tax period.

This is a general explanation of the central GST framework, not a determination of a specific notice’s validity, deadline, liability, or response strategy. State or Union Territory legislation and the facts of the proceeding may also matter.
