Human gig workers are already organizing around software-managed work, but collective bargaining rights remain unevenly recognized. There is no established union of AI agents. The distinction matters: software can allocate tasks, assess people and influence their pay without being a legal employer—or a conscious “boss.”
What does “software boss” mean?
In its 2024–2025 work on algorithmic management, the European Commission’s Joint Research Centre describes systems of computer-programmed procedures used to coordinate human work. They may assign shifts or tasks, provide instructions, assess performance, or determine rewards and penalties. They may use AI, but they do not have to.

For a platform worker, those functions can shape the practical terms of a job: what work appears, how performance is judged, and what consequences follow. The JRC also points to information asymmetries that can weaken workers’ bargaining power. That does not make the software a legal employer or a conscious agent; it describes how management functions are carried out.

A European Commission study published on 28 March 2025 examines workplace context, risks, opportunities and policy responses. Its stated research scope runs through September 2023, so it should not be read as a complete account of developments after that date.

Are platform workers already organizing?
Yes. The International Labour Organization’s Working Paper 143, published on 9 July 2025, reviews developments in collective action and bargaining since 2021. It reports progress in some jurisdictions, including recognition for self-employed workers in certain settings, but says progress has not been widespread. Organizing and recognition remain concentrated in delivery and food-delivery work, and most platform workers globally still lack effective recognition of collective-bargaining rights.
“Organizing” can describe more than a recognized union or a signed collective agreement. Workers may take collective action, build worker organizations, or pursue bargaining rights through legal or political channels. The forms and legal protections differ by jurisdiction; the ILO’s global summary does not establish a single rule that applies everywhere.

What makes unionizing difficult?
An ILO study published on 6 February 2024 draws on survey evidence from 14 European countries and identifies several barriers to union membership among platform workers. It highlights algorithmic management, regulatory arbitrage around employment arrangements, and an entrepreneurial framing that presents workers as independent business operators.
- Management through software: Workers may have little visibility into how tasks, evaluations or consequences are determined, making it harder to identify and challenge a decision collectively.
- Unclear or varied work arrangements: Platform workers may be treated as employees, self-employed people, or another category, with consequences for the routes available to organize and bargain. The ILO study identifies employment arrangements as a barrier, but its summary does not establish one legal outcome for every country or worker.
- Different ways of working: Platform workers are not a uniform group. The ILO study cautions that recruitment and organizing strategies need to reflect how people participate in platform work.
The study’s published summary supports these broad barriers, not a verified unionization rate or a detailed ranking of subgroups. Its findings concern people doing platform work, not AI agents.

Who organizes in the AI supply chain?
People do. GIZ’s 2026 report, Invisible Workers, Visible Harms: Perils and Precarities of AI Labour, describes human data annotators, content moderators and other workers involved in AI supply chains. It reports worker-led collectives, including the Data Labellers Association of Kenya, and campaigns connected to ACMU and UNI Global Union. The report describes demands including fair pay, mental-health support, employer accountability, transparency and grievance channels.
This is an important part of the “agent economy” story: AI products rely on human labor, and some of those workers are organizing. The report’s examples, particularly in Global South settings, should not be generalized to every country or AI supply chain. Nor do they show that the AI systems those workers help build are organizing themselves.

Could AI agents unionize in the future?
That remains an open legal and conceptual question, not a development the cited evidence shows has happened. The sources address human employment, management systems and labor law; they do not establish that AI agents are conscious, are legally workers, or can form a legally recognized union.
Any future claim that agents have collective rights would need to answer several distinct questions: whether a legal system recognizes an agent as a rights-bearing entity; whether it can be treated as a worker under that system; who could represent it; and which human or organization would remain accountable for the agent’s decisions. The European Commission’s iMANAGE project explores related accountability issues in algorithmic management, including privacy, discrimination and fundamental rights. It is relevant to the problem of responsibility, not proof of a settled legal answer.

How to read the “first union” framing
The phrase captures a real tension but combines two different stories. Human workers are already organizing against conditions shaped by platforms and software systems. Separately, the idea of AI agents forming a union is speculative. The documented organizing is human-led—in platform work and in the labor that supports AI—not evidence that software itself has become a collective bargaining actor.
