Game Ownership vs. Game Licensing: What Digital Buyers Should Know

A digital game purchase usually grants access under a license or platform entitlement. What you can keep, transfer or play offline depends on the terms, technical requirements and local consumer law.

Buying a digital game usually gives you a license or platform entitlement to use it, not ownership of its copyright or unrestricted control over it. A disc gives you possession of that copy, but does not guarantee the game will install, authenticate, update or keep working indefinitely. The practical answer depends on the game’s terms, its technical requirements and the consumer law that applies where you live.

What does it mean to own a game?

“Owning a game” can describe several different things. They are related, but one does not automatically give you the others.

As an Amazon Associate I earn from qualifying purchases.

What you mean by ownership What it concerns What it does not establish on its own
Copyright or intellectual property Rights in the game’s code, artwork, music and other creative material. A consumer purchase does not ordinarily transfer those rights. A right to copy, modify, distribute or control the game.
Possession of a physical copy Having the particular disc or other physical item you bought. That the game will install or play without downloads, an account, authentication or a publisher’s servers.
A license or digital entitlement Permission or access to use a game under a publisher’s or storefront’s terms. Permanent access, unrestricted use or the right to transfer the entitlement. Those questions depend on the terms and applicable law.
A platform account The account through which a storefront may provide access to games and services. That the account, or access associated with it, can be sold or transferred.

The wording in a specific contract matters. Blizzard’s EULA, last revised 21 March 2024, says: “Your use of the Platform and the Games is licensed, not sold to you,” and says that no title or ownership is transferred. That is Blizzard’s contract language; it is not a universal rule for every publisher, nor does it by itself settle any statutory consumer rights.

How does a digital purchase compare with a subscription or a disc?

The word “buy” does not answer how long access lasts or what is needed to play. Check the terms and technical dependencies for the specific game and platform. The comparison below describes the distinctions buyers should investigate, not a guarantee about every game in a format.

#1 Best Overall
GameStop Physical Gift Card
  • Redeemable at US GameStop, EB Games, Babbage's, Electronic Boutique, EBX, Planet X, and Software Etc. stores. Also redeemable online at and GameStop.com and EBGames.com.
  • Over 6,100 stores located throughout the United States.
  • GameStop. Power to the Players.
  • Redemption: Instore and Online
  • No returns and no refunds on gift cards.
Access type What to establish before paying What the format alone does not promise
Digital purchase Whether access is a license or entitlement; its duration and termination terms; required account, launcher, internet connection or authentication; and whether the store permits a permanent offline download. That the game can be transferred, retained permanently or played after a service ends. Publisher and storefront terms vary.
Subscription How long the game is included, what happens when the subscription ends, whether the game can leave the catalog, and what account or online requirements apply. The cited official materials do not state general subscription rules. That paying for the subscription gives you a separate, permanent entitlement to every included game.
Physical disc Whether the core game is actually on the disc, whether installation needs a download, and whether online authentication or server-based features are needed to play. That the disc alone will keep the game playable indefinitely. A disc preserves possession of the item, not the services or technical systems it may depend on.

Modern games can rely on publisher-operated servers. The European Commission said on 16 June 2026 that “Modern video games often rely on publishers’ servers to function.” So a disc may not be enough for a game whose installation, authentication or essential play depends on online systems.

Can Steam remove a game I bought?

Steam’s stated account rule is narrower than a blanket promise about game availability: Steam Support says a Steam account cannot be transferred, and that buying, selling, trading or gifting an account violates the Steam Subscriber Agreement. This concerns Steam accounts; it does not establish that every game entitlement on every platform is transferable or non-transferable.

Xbox Physical Gift Card | $25

  • GAME AD-ONS: Extend the experience of your favorite games with add-ons and in-game currency.

  • PERFECT GIFT: Great as a gift for a friend or yourself. Xbox Gift Cards are easy to use, never expire, and give the freedom to pick the gift they want. Enjoy more ways to play without a credit card attached to your Microsoft account.

For a particular game, review the current publisher and storefront terms for suspension or termination provisions, then check whether the game requires Steam or another service to install, authenticate or run. The fact that you paid for access does not, by itself, answer what happens if an account or service becomes unavailable. Nor do the cited Steam account rules establish that Steam can remove every purchased game in every circumstance.

Can you keep playing after a game’s servers shut down?

It depends on what the game needs to function. A fully playable offline installation may continue to work, while a game that requires server authentication or uses servers for core gameplay may not. Updates, account checks and online-only features can also affect what remains usable. A saved installer is useful only if its license and technical requirements allow offline use; it cannot restore a discontinued server or remove digital rights management.

As of 16 June 2026, the European Commission said it could not then propose a legal obligation to keep video games playable after they stop being provided commercially. It also described existing consumer protections and possible proportionate refunds. The Commission said it would engage consumers and publishers by the end of 2026 to explore industry standards after the Stop Destroying Videogames European Citizens’ Initiative. That statement records the Commission’s position and plan on that date; it does not establish the outcome of later discussions or decide an individual dispute.

What consumer protections may apply?

European Union

The EU Consumer Rights Directive requires pre-contract information that includes details about digital content’s functionality and interoperability, and regulates online withdrawal rights. Those rules apply to consumer-trader contracts as implemented in the EU; they should not be assumed to apply identically elsewhere.

Fortnite Physical Gift Card
  • An Epic Games account is required to redeem an Epic Games Store Card code
  • If playing on a console platform (PlayStation Network, Xbox Live, Nintendo Switch or Mobile) you need to link your Epic Games account to that gaming platform (one time) to redeem your gift card code
  • The 16 digit code on the back of the card WILL NOT work if redeemed directly through your gaming platform (PlayStation Network, Xbox Live, Nintendo Switch, Mobile, etc.)
  • Note: Nintendo devices do not support Fortnite Shared Wallet, so V-Bucks purchased using your account balance will not show up on your Nintendo device. However, if you purchase items in the web Item Shop — or another platform where you play Fortnite — those items will be available in your Locker across all platforms.
  • Redemption: Online

In a 5 June 2024 answer about delisted or disabled games, the European Commission said EU consumer law requires transparency about material aspects of an offer and provides remedies for lack of conformity. It also said EU law does not set a specific duration for supplying online video games. Whether a particular shutdown amounts to a lack of conformity depends on the facts, the terms, reasonable expectations and applicable national rules; national courts and administrative authorities handle individual cases.

California

California Business and Professions Code § 17500.6, effective 1 January 2025, restricts the use of terms such as “buy” or “purchase” that imply ownership for revocable digital goods unless the seller takes specified disclosure steps. The law covers digital applications and games. It has an exception where the seller makes the good available for permanent offline download to external storage for use without internet access.

This is a disclosure rule, not a general promise that a game will receive long-term support, and it does not transfer copyright or guarantee that online features will continue. It is a California rule, not a general description of digital purchases in other places.

What to check before you pay

  1. Read the relevant terms. Look for the license duration, suspension or termination conditions, account-transfer restrictions and refund procedure in the publisher and storefront terms.
  2. Check the technical requirements. Confirm whether play requires a launcher, account, internet connection, DRM check or publisher server, and whether the game offers offline play.
  3. Find out what you can retain. For a digital purchase, check whether a full playable game or only an installer can be kept, whether the store permits permanent offline downloads, and what limits apply. A portable SSD or USB drive can hold a permitted installer; it cannot make an online-only game playable or change its license.
  4. For a disc, verify what is on the media. Check whether the core game is installed from the disc or must be downloaded, and whether essential play depends on an account or online service.
  5. Use the rules for your location. EU buyers should review the pre-contract information about digital-content functionality and interoperability. California buyers should look for the required disclosure when a revocable digital good is marketed with ownership-implying terms.

No single format settles every question. The useful comparison is whether you can keep access, transfer it, play without a service, retain an offline copy and seek a remedy if the product does not conform to what was offered.
