EU Cyber Resilience Act: Three Misconceptions That Put Embedded Products at Risk

Embedded and lower-criticality products are not automatically outside the EU Cyber Resilience Act. Scope, ongoing vulnerability duties, update expectations and staged deadlines depend on the product and its use.

“Embedded” and “low risk” do not automatically exempt a product from the EU Cyber Resilience Act (CRA). Whether it applies depends on the product’s legal classification, purpose, connections and any applicable exclusions. For products in scope, manufacturers’ responsibilities reach into the support period and include vulnerability handling and security updates—but neither a single support duration nor automatic updating in every context applies uniformly. The dates are staged: Article 14 reporting duties apply from 11 September 2026, while the CRA generally applies from 11 December 2027.

Misconception 1: Embedded or non-critical products are automatically exempt

The CRA applies to products with digital elements that meet its scope, subject to the regulation’s definitions and exclusions. A device does not fall outside the law simply because it contains embedded software, is not marketed as a computer, or seems less critical than a server or network appliance.

The regulation recognizes that products considered less critical can still contribute to attack paths, including through indirect connections. Its Annex I states: “Products with digital elements shall be designed, developed and produced in such a way that they ensure an appropriate level of cybersecurity based on the risks.” The wording makes risk relevant to the required level of security; it does not create a general exemption for low-risk products.

What to check for a particular product

  • Whether the product meets the CRA definition of a product with digital elements and whether a specific exclusion applies.
  • Its intended purpose, users, interfaces, and physical or logical connections, including indirect connections.
  • The manufacturer’s role and when the product is placed on the EU market.
  • Whether another EU legal act governs relevant cybersecurity requirements.

These factors need to be assessed for the actual product. “Embedded” alone cannot settle the question, and the CRA should not be read as covering every device regardless of its facts.

Misconception 2: Cybersecurity duties end when the product is sold—or every device gets the same support period

For products in scope, manufacturers’ responsibilities do not stop at launch. The CRA requires vulnerability handling during the product’s support period, including addressing and remediating vulnerabilities without delay and providing security updates. It also sets out product-security requirements such as secure-by-default configuration, limiting attack surfaces, and enabling vulnerabilities to be addressed through updates, as applicable to the product.

The support period is not one fixed number for every product. It should reflect how long the product is expected to be used, taking account of reasonable user expectations and the product’s nature and intended purpose. The regulation therefore does not, by itself, establish a universal five-year or ten-year update commitment for all embedded devices.

Vulnerability handling is an ongoing process

Manufacturers must identify and document vulnerabilities and product components, including an SBOM in a commonly used machine-readable format covering at least top-level dependencies. They must conduct effective, regular security testing and review, and disclose information about fixed vulnerabilities after updates, subject to a justified delay where publication risks outweigh the security benefits. These duties make component visibility and a process for receiving, assessing and fixing vulnerability reports part of product support—not just pre-release work.

Misconception 3: The CRA requires every embedded device to install updates automatically

The CRA includes automatic security updates where applicable and provides for an opt-out, but that is not the same as a universal rule that every product must silently install every update. The regulation’s recitals recognize that automatic updating may not be reasonably expected in some contexts or could disrupt professional or industrial operations.

Manufacturers should determine the applicable requirements in light of the product and its use. A consumer device, a component integrated into a larger system, and equipment used in an industrial environment may present different operational expectations. The relevant question is not simply whether the product is embedded, but how the security-update requirement applies to that product while allowing vulnerabilities to be addressed effectively.

When the CRA applies: the dates are staged

The general application date is not the first date on which any CRA provision applies. The following dates distinguish the main milestones in Regulation (EU) 2024/2847:

Date What applies
11 June 2026 Chapter IV provisions concerning notification of conformity assessment bodies apply.
11 September 2026 Article 14 reporting obligations apply. This date has passed as of 4 October 2026.
11 December 2027 The CRA generally applies.

For an actively exploited vulnerability, Article 14 sets three reporting steps. The first two clocks begin when the manufacturer becomes aware; the final-report deadline is tied to a corrective or mitigating measure becoming available.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Report Deadline Clock starts
Early warning Without undue delay and within 24 hours Awareness of the actively exploited vulnerability
Vulnerability notification Within 72 hours Awareness of the actively exploited vulnerability
Final report No later than 14 days Availability of a corrective or mitigating measure

These are statutory deadlines in the EU regulation, not general response-time targets for every vulnerability. The article 14 duties apply from 11 September 2026; the general application date does not postpone them.

How manufacturers can assess an embedded product

  1. Determine scope. Map the product’s functions, software, interfaces, users and physical or logical connections. Assess whether it meets the legal definition and whether an exclusion or another relevant EU legal act changes the analysis.
  2. Identify the responsible manufacturer and market timing. Establish who has the manufacturer role and when the product is placed on the EU market; do not assume that the product’s launch date alone answers every compliance question.
  3. Set a support period based on the product. Document the expected period of use, intended purpose, nature of the product and reasonable user expectations. Avoid adopting a generic number of years as though it were a universal CRA rule.
  4. Map components and vulnerability processes. Maintain the required component and vulnerability documentation, including the machine-readable SBOM with at least top-level dependencies, and define how vulnerabilities are identified, assessed, fixed and disclosed.
  5. Apply the relevant security requirements and update approach. Use a product-specific risk assessment to determine which Annex I requirements apply, including secure defaults, attack-surface limits, security updates and whether automatic installation is appropriate in the context.
  6. Prepare for applicable reporting deadlines. Put a process in place to recognize actively exploited vulnerabilities, escalate awareness promptly and meet Article 14’s separate early-warning, notification and final-report clocks.

Regulation (EU) 2024/2847 is the controlling legal text. Product-specific conclusions should be checked against its definitions, exclusions and applicable requirements, as well as any later implementing measures or guidance.
