Potentially—if enacted. The CLARITY Act would create a federal framework for digital-asset markets, but it is not law. As of October 13, 2026, the Senate had failed to advance it in a September 15 procedural vote. A separate SEC interpretation and CFTC guidance, effective March 23, 2026, address some crypto assets and activities under existing law.
What the CLARITY Act could mean—and what it means today
The Digital Asset Market Clarity Act of 2025, H.R. 3633, proposes a federal market-structure framework that would divide responsibilities between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC). It includes provisions concerning digital-commodity offers and sales, issuers, and intermediaries. The House-reported text is available from the U.S. Government Publishing Office.

That framework is proposed, not current law. As of October 13, 2026, the Senate had not enacted the bill or advanced it in a September 15 procedural vote reported as 49–50; 60 votes were required to advance it. The vote was reported by the Associated Press and Axios. A failed procedural vote does not establish that the proposal can never return or that no later action is possible.
House action and Senate committee work are also not enactment. The Senate Banking Committee released market-structure text on May 12, 2026, as a basis for committee markup, reflecting negotiations and stakeholder input; the release did not make the proposal law. The committee’s announcement and summary describe the committee’s view of the proposal; they should not be confused with enacted statutory duties.

How crypto investors and token holders could be affected
If enacted, the House text would change the federal framework for covered digital-asset activities. It proposes rules concerning digital commodities, investment-contract assets, certain primary offerings and secondary transactions, issuer disclosures, mature blockchain systems, and registration of exchanges, brokers, and dealers. In practical terms, that could affect which regulatory regime applies to a particular offering or intermediary, and what covered participants must disclose or do. It would not automatically give every token one final legal classification.
A token and the transaction involving it are not always the same question
The House text defines an “investment contract asset” as a digital commodity recorded on a blockchain, capable of exclusive possession and person-to-person transfer without necessary reliance on an intermediary, and sold or intended to be sold pursuant to an investment contract. The distinction matters because the analysis can involve both the asset and the circumstances in which it is offered or sold. The definition is not a shortcut for deciding the status of a particular token: the relevant statutory conditions and facts would need to be assessed.

Nor does the proposal mean that every asset described as a digital commodity would be exempt from securities-law concerns in every transaction. The Senate Banking Committee says its proposal preserves SEC enforcement authority over digital-asset securities and primary offerings of ancillary assets, while providing for disclosures, resale restrictions, and anti-evasion rules for covered participants. That is the committee’s description of its proposal, not a substitute for checking the operative text or a legal analysis of a specific asset or sale.

- Do not infer automatic reclassification. The proposal creates categories and rules; it does not establish that every existing token is a commodity, a security, or an investment-contract asset.
- Do not treat the bill as a present change in rights or obligations. Its proposed requirements would matter if enacted and as applicable to covered activities.
- Do distinguish an asset from its offering. A token’s characteristics and the context of an offer or sale can both matter under the proposed framework.
- Do not read committee descriptions as final rule text. Exact duties would depend on the version enacted and any subsequent rules.
How DeFi users, builders, and intermediaries could be affected
The proposal addresses DeFi-related activity, but the available committee description does not establish one uniform rule for every protocol, user, software developer, or governance arrangement. Its scope depends on who performs an activity, whether that person falls within an intermediary definition, and what the operative provisions ultimately say.

The Senate Banking Committee describes risk-management standards for centralized intermediaries that interact with DeFi protocols. It also describes tailored rulemaking for intermediaries that are not truly decentralized, along with sanctions and illicit-finance controls. These are committee characterizations of the bill’s approach. They do not, by themselves, settle when a particular person or project would count as an intermediary or what obligations would apply.
For a DeFi user, the key distinction is between using a protocol and operating or intermediating an activity. The bill’s described intermediary provisions point toward obligations tied to covered roles and conduct, rather than a blanket statement that every user of decentralized software would be regulated in the same way. Builders and operators likewise cannot determine their treatment from the label “DeFi” alone; definitions, facts, final enacted language, and later rulemaking would matter.

The committee’s bill summary is a useful account of the committee’s stated policy and intended treatment, while the House-reported bill text is the place to examine proposed statutory language. Neither supports a definitive prediction about every protocol or user absent the relevant facts and applicable final law.

A separate agency action is already in effect. On March 23, 2026, an SEC interpretation took effect alongside CFTC guidance. The SEC says the interpretation addresses categories including digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. It also discusses how a non-security crypto asset may become subject to, or cease to be subject to, an investment contract, and covers airdrops, protocol mining, protocol staking, staking receipt tokens, and wrapping. See the SEC interpretation page and the SEC/CFTC interpretation and guidance published by the CFTC.

The CFTC says it will administer the Commodity Exchange Act consistently with the SEC interpretation and notes that some non-security crypto assets could meet the Act’s definition of a commodity. These materials concern agency interpretation of existing federal laws. They are not provisions of H.R. 3633 and do not show that the CLARITY Act passed.
| Question | SEC/CFTC interpretation and guidance | CLARITY Act |
|---|---|---|
| What kind of action is it? | Agency interpretation and CFTC guidance | Proposed legislation, H.R. 3633 |
| When does it apply? | Effective March 23, 2026 | Not enacted as of October 13, 2026; failed to advance in a September 15 procedural vote |
| What does it address? | How existing securities and commodity laws apply to specified crypto categories and activities | A proposed market-structure framework for digital-commodity offers, sales, and intermediaries |
| Does it decide every token’s status? | No; categories and transaction context still matter | No; the proposed statutory conditions and facts would matter |
| What does it say about DeFi-related activity? | It discusses specified activities such as staking and wrapping | Committee materials describe obligations for certain intermediaries interacting with DeFi; scope depends on text and activity |
The SEC and CFTC materials therefore may be relevant to understanding current agency positions, while the CLARITY Act remains a separate legislative proposal. For activity involving a specific asset or protocol, neither a broad category label nor the bill’s title alone resolves the legal question.
How to follow the bill without confusing a proposal for current law
- Check the date and legislative status. The status stated here is as of October 13, 2026. The reported September 15 vote was a failed procedural vote, not evidence that the bill can never be reconsidered.
- Identify which text is being discussed. The House-reported text and the Senate committee’s May 2026 market-structure text are separate legislative materials. Committee discussion or a release of draft text is not enactment.
- Separate existing guidance from the bill. The March 23, 2026 SEC interpretation and CFTC guidance concern existing law; the proposed act would create a statutory market-structure framework if enacted.
- For a token or protocol, focus on the activity and facts. The asset, the offer or sale, and any intermediary role may raise distinct questions. Avoid treating an informal label as a legal determination.
Officials have framed the legislation and agency action as efforts to provide clarity. For example, CFTC Chairman Michael S. Selig said in a March 17, 2026 press release, “For far too long, American builders, innovators, and entrepreneurs have awaited clear guidance on the status of crypto assets under the federal securities and commodity laws.” SEC Chairman Paul S. Atkins said, as reported in that CFTC release, “This is what regulatory agencies are supposed to do: draw clear lines in clear terms.” House Financial Services Committee Chairman French Hill said in the committee’s July 17, 2026 account, “Our leadership in finance and technology depends on clear, predictable rules.” These are officials’ views about policy, not a substitute for statutory text or a determination about an individual asset. The House committee account is available here.
What the answer means for readers now
For investors and token holders, the CLARITY Act has no enacted effect as of October 13, 2026; its potential impact would depend on passage, final text, and the facts of a covered asset or transaction. For DeFi users and builders, the proposal addresses some intermediary activity, but does not establish identical obligations for everyone who uses or contributes to a protocol. Meanwhile, the SEC/CFTC interpretation effective March 23, 2026 is a distinct, current source of agency guidance under existing law.
