What’s actually slowing this PC down?

Possibly. Paying an overseas provider does not, by itself, settle whether GST applies or who must pay it. The answer depends on who supplies the service under the contract and invoice, where the supplier and recipient are located, whether the service is OIDAR or another imported service, and whether the creator receives it for business use. A GST-registered creator should check whether recipient-side reverse charge applies; for certain OIDAR supplies to qualifying non-taxable online recipients, the foreign supplier is liable under section 14 of the IGST Act.
Why the subscription’s country of payment is not enough
Under the Integrated Goods and Services Tax Act, 2017, an import of services requires that the supplier be outside India, the recipient be in India, and the place of supply be in India. The general place-of-supply rule for services is the recipient’s location, subject to specified exceptions. Accordingly, the payment destination or the fact that a service is marketed internationally does not alone determine the GST result.

Start with the transaction documents: identify the supplier named on the invoice, the contracting entity, the recipient and registered place of business (if any), and whether an Indian affiliate or intermediary is involved. The legal analysis can differ if the service is contracted from or invoiced by an Indian entity rather than supplied directly by a foreign entity.

OIDAR means online information and database access or retrieval services. The statutory definition covers services delivered through the internet or an electronic network that are essentially automated, involve minimal human intervention, and cannot be supplied without information technology. The IGST Act, section 2(17), lists “providing cloud services;” as an example.

That example does not automatically classify every cloud streaming subscription as OIDAR. Look at how the particular service is delivered, its actual functionality, the contract and the supplier arrangement. If it is not OIDAR, it may still be an imported service; the tax mechanism must then be assessed under the applicable provisions and notifications rather than assumed from the product label.
Which party may have to account for GST?
Foreign supplier providing OIDAR to a qualifying non-taxable online recipient
IGST Act section 14 places liability on a supplier located outside India for OIDAR supplied to a non-taxable online recipient, subject to statutory intermediary rules. Those rules can treat an intermediary as the recipient and supplier unless the relevant conditions are met; the section also provides simplified registration and representative arrangements.

The statutory definition of a non-taxable online recipient concerns both registration and purpose. It includes an unregistered person receiving OIDAR for a purpose other than commerce, industry or another business or profession. An unregistered creator using a subscription to produce monetized content should not assume that non-registration alone settles the treatment.
GST-registered creator receiving a foreign service for business
The IGST Act permits notified reverse-charge categories. CBIC identifies Notification 10/2017-Integrated Tax (Rate) as the reverse-charge notification. A registered creator receiving an imported service for the creator’s business should check the notification’s applicable entry and the transaction facts to determine whether the recipient must account for tax.

CBIC’s official FAQ material describes 18% as the rate for IT services and discusses reverse charge on foreign software used in a GST-registered firm. That is useful context, not proof that every cloud streaming subscription is an IT service or carries that rate. Do not infer a subscription’s rate from the broad description “cloud” or “streaming.”
Can the creator claim input tax credit?
Input tax credit is a separate question from whether GST applies. For a registered person, credit is restricted to the portion attributable to business use and taxable or zero-rated supplies. Non-business or exempt use can restrict the available credit. Whether a creator can claim credit depends on the creator’s activity, use of the service, supplies, records and compliance position; registration alone does not establish entitlement.

Use this fact checklist before deciding
- Who issued the invoice, and is that supplier located outside India?
- Does the contract identify a foreign supplier, an Indian affiliate, or an intermediary? What entity is actually charging for the service?
- Is the recipient GST-registered? If so, which registered place of business receives the subscription?
- How does the service actually work: is it automated OIDAR, another imported service, or a different supply?
- Is it used for the creator’s business or profession, personal purposes, or both?
- If credit is sought, what portion relates to business and taxable or zero-rated supplies, and do the records support the claim?
What this means for a cloud streaming service such as StreamNeo
StreamNeo, made by Yorker Media, is a cloud service that loops uploaded videos to keep a YouTube channel live. That product description alone does not establish its GST classification, invoice issuer, supplier location, applicable tax mechanism or rate for a particular Indian creator. Check the contracting entity and invoice for the subscription you actually buy, then apply the same supplier, recipient, service and business-use questions above. For liability that remains uncertain, ask a qualified Indian GST adviser who can review the documents and your facts.
