Does Car Insurance Cover Damage from Police Gunfire?

Comprehensive coverage may be relevant when police gunfire damages your car, but payment depends on your specific policy, the incident and state law. Learn what to check and how to preserve a claim.

Sometimes, but it is not automatic. In the United States, comprehensive coverage is generally the first part of your own auto policy to check when gunfire damages your vehicle. Whether your insurer pays depends on your policy’s terms, exclusions and endorsements, your deductible, state law, and the circumstances. A claim against a government agency is a separate question governed by local law.

Which part of your auto policy should you check?

Coverage What it generally addresses How it relates to gunfire damage
Comprehensive Damage to your car not caused by a collision. The NAIC lists theft, hail, windstorm, flood, fire and animal impact as examples. Usually the first coverage to investigate for gunfire damage to your own vehicle. The NAIC examples are not a specific ruling on police gunfire; the contract controls. NAIC auto coverage guidance
Collision Damage covered under the policy’s collision terms. Less obviously applicable when bullets strike a stationary vehicle, but the policy definition and facts determine whether it applies.
Liability Generally, the insured’s legal responsibility for property damage to someone else. Usually not the coverage for repairs to your own car. Massachusetts law provides one state-specific example of liability coverage for property damage caused by an accident arising from ownership, maintenance or use of the insured vehicle. Massachusetts General Laws, c. 90, § 34O

Why the word “comprehensive” does not guarantee payment

Comprehensive describes a category of coverage, not a promise that every non-collision event is covered. Your insurer will apply the policy’s insuring language, exclusions, endorsements and conditions to the specific loss. The Missouri Department of Commerce and Insurance advises policyholders to review provisions and exclusions and ask an agent or broker about unclear terms.

There is no basis here for treating a government-action exclusion as universal—or for assuming such an exclusion can never apply. If the insurer raises one, ask it to identify the exact policy language and explain in writing how it applies to the facts. Your deductible also matters: it is the amount you pay toward a covered loss before the insurer pays under the policy. For a total loss, policy terms and applicable law may also affect how the vehicle’s value is determined.

State law and policy wording can change the result

State-specific provisions illustrate why a rule from one place should not be generalized. Massachusetts law addresses payment for covered comprehensive loss up to actual cash value less a deductible, subject to the statute and policy terms. Massachusetts General Laws, c. 175, § 113O. New York law authorizes insurers to provide physical-damage coverage for loss resulting from an act or threatened act of violence against an insured person. That provision by itself does not decide whether a particular police-gunfire claim is covered. New York Insurance Law § 3450.

A separate example underscores the importance of the exact facts: a 1998 Texas Department of Insurance bulletin discussed a good-faith purchaser whose insured car was confiscated as stolen property. It described a court decision requiring coverage on those facts because the policy did not specifically exclude the loss. That was a confiscation dispute, not a police-shooting decision. Texas Department of Insurance Bulletin B-0042-98.

What to do after your vehicle is damaged

  1. Get to safety. Seek emergency assistance if anyone is injured. Document the scene only when it is safe to do so.
  2. Contact your insurer promptly. Ask whether to open a first-party physical-damage claim and what notice, inspection and documentation steps your policy requires.
  3. Preserve available evidence. Photograph the damage and scene when safe; keep existing video, witness contact details, incident or case numbers, estimates and insurer communications. Request public incident records through the applicable process.
  4. Protect the vehicle and preserve the inspection opportunity. Take reasonable steps to prevent further damage. Before nonessential repairs or disposing of damaged parts, ask the insurer whether it needs to inspect them.
  5. Request a written coverage decision. Ask the insurer to identify the policy provisions, exclusions, endorsements, deductible and facts it relied on. If the claim is denied, follow the policy’s appeal process and contact your state insurance regulator for consumer assistance.
  6. Get local legal advice about a government claim. A claim against a police department or other government entity is separate from an insurance claim. Liability, immunity, notice requirements and deadlines depend on the jurisdiction and circumstances; consult a lawyer licensed where the incident occurred promptly.

What is—and is not—established nationally

The National Association of Insurance Commissioners’ consumer guidance, published June 11, 2026, describes comprehensive coverage as paying for damage not caused by a collision and gives examples such as theft, hail, windstorm, flood, fire and animal impact. It does not specifically rule on damage caused by police gunfire. No named statistic in the available material measures insurance coverage or payment outcomes for vehicles damaged by police gunfire, and no authoritative ruling establishes a nationwide answer for every policy and incident.
