What Sony means by “buying” a digital game
Sony Interactive Entertainment’s U.S. PlayStation Terms of Service say that words such as “own,” “purchase,” “sale,” and “buy” do not imply a transfer of ownership of the content, software, or intellectual-property rights. In other words, you can truthfully say you purchased a game and it appears in your library, while still not owning the software in the sense of having a freely transferable copy. Sony’s March 2026 PlayStation Terms of Service describe a Store transaction as buying “a personal license to use that product for private, non-commercial use.” They say the license is not transferable unless local applicable law requires otherwise, and explain: “This means you can use a product in the ways described in the license, but do not own the product.” Sony’s March 2026 PlayStation Terms of Service.

That is the contractual answer in the terms reviewed, not a universal ruling about every buyer’s legal rights. Contract versions and applicable law vary by region, and the terms alone do not determine what a court would decide in an individual case.

Can you transfer or resell a digital PS5 game?
Under Sony’s terms, generally no: a digital game license is personal and non-transferable, subject to exceptions required by applicable local law. Sony’s U.S. terms also restrict selling or transferring PlayStation Network content except where the agreement or law allows it. What happens if you lose or close your PlayStation account?
Sony’s terms warn that closing or deleting the account used to purchase content may mean losing access to that content. This describes a possible consequence, not a guarantee that every account closure automatically removes every game. Refund and cancellation rights depend on the buyer’s jurisdiction and the transaction. As an example, Sony’s European terms describe a 14-day cancellation period for digital content in the European Economic Area, but consent to immediate delivery may limit that right, and starting a download generally prevents cancellation for a change of mind. Are physical PS5 games different?
Yes, the transaction is different: Sony’s March 2026 terms list boxed games among physical goods and point to separate physical-goods purchase terms. Sony’s PS5 system agreement directs users in the Americas to its Software Product License Agreement, and users in Europe, the Middle East, Africa, Australia, Oceania, India, Russia, and Ukraine to its Software Usage Terms. Both routes characterize the software as licensed rather than sold, but a U.S. agreement should not be treated as the detailed contract for every region.
