Short answer: Patent licensing can affect the costs and legal terms of building phones that use cellular standards, so royalties are one possible input to a phone’s price. The available evidence here does not establish a specific retail-price increase, show that licensing deals set a phone’s software-update schedule, or prove that a license makes a device compatible with 5G networks. Those outcomes depend on different factors.
What a patent licensing deal covers
Mobile standards help equipment from different vendors work together. The European Commission says 2G, 3G, 4G, 5G, and Wi-Fi networks rely on thousands of patented technologies. Some patents are standard-essential patents (SEPs): patents considered necessary to implement a standard. A manufacturer may need permission to use patented technology covered by a license when making devices that implement that standard.

ETSI’s intellectual-property policy uses FRAND commitments—fair, reasonable, and non-discriminatory licensing—to balance patent-holder returns with implementers’ access to standardized technology. FRAND is a framework, not a universal royalty rate or a guarantee that negotiations will be dispute-free. ETSI also says that disclosure of licensing terms or adoption of a technology is not its endorsement of those terms or confirmation that they comply with ETSI directives. ETSI’s IPR policy and the European Commission’s overview of standard-essential patents explain this context.
Licenses can differ in the patents and products they cover, their geographic scope, how royalties are calculated, and whether a cap applies. A headline percentage alone therefore does not describe the whole deal or establish what a consumer pays.

Can patent licensing deals change phone prices?
They can be one input into a manufacturer’s costs, but the sources cited here do not quantify how a particular license changes a phone’s retail price. In a 2013 statement, the U.S. Federal Trade Commission described patent hold-up as a possible route to higher royalties that companies might pass on to consumers. That is a potential mechanism identified by a regulator—not evidence that every licensing deal raises prices, or a measurement of how much a phone costs because of royalties. The FTC’s 2013 account concerns a particular competition matter.
Licensing also provides a route for manufacturers to access patented technology used in standards. The European Commission describes FRAND as intended to give patent holders an adequate return while enabling access to standardized technologies at reasonable cost. That policy aim does not, by itself, show that licensing lowers consumer prices. The materials cited here do not provide an independent estimate of the net effect on retail phone prices.

One company’s published 5G terms
Qualcomm’s published 5G handset licensing program states a royalty of 3.25% of net selling price for its cellular-SEP-only license and 5% for a broader portfolio license, for branded 5G-capable handsets. Qualcomm says all of its 5G handset programs include a per-device cap. These are Qualcomm’s stated program terms; they are not market-wide rates, a complete account of negotiated terms for every licensee, or proof that any royalty is passed through to buyers. Qualcomm’s surfaced program document does not display a publication year. See Qualcomm’s licensing program information.

Do licensing deals determine software updates?
Not on the evidence cited here. A cellular patent license concerns permission to use patented technology; it does not establish how long a manufacturer will provide operating-system or security updates for a particular phone. The cited licensing materials do not connect royalty terms to update duration.

To compare update support, check the phone maker’s stated support policy for the exact model and region. A claim that a particular patent deal changes update commitments would need evidence from the relevant device maker or contract; the licensing announcements cited here do not provide it.
Does a 5G license guarantee that a phone works on 5G?
No. Licensing can help establish the legal conditions for implementing a cellular standard, but a license is not a 5G modem, radio, software stack, or guarantee of carrier compatibility. A phone needs the relevant hardware and software, supported frequency bands, and compatibility with the network in question.

What the Qualcomm–Huawei announcement establishes
On October 5, 2026, Qualcomm announced a multi-year broad patent license agreement with Huawei, covering cross-licenses across areas including 5G, computing, AI, and networking. Qualcomm also announced a purchase of certain Huawei U.S. patents in computing, AI, networking, and other areas. Qualcomm said the transaction would close after required regulatory approvals; the announcement should therefore be treated as an announced deal pending completion, not as confirmation that closing occurred.

- Premium design within reach: Stand out with a stunning look and comfortable feel, including a vegan leather back cover that’s soft to the touch and fingerprint resistant.
The announcement does not quantify an effect on consumer phone prices, update duration, or handset compatibility. Qualcomm executive John Han characterized the agreement as recognition of Qualcomm’s 5G technology leadership and the success of its 5G SEP licensing program; that is the company’s view, not an independent assessment. Why licensing rules and disputes vary
FRAND commitments do not produce one automatic answer for every licensing dispute. The U.S. Department of Justice’s summary of a 2019 joint policy statement by DOJ, the U.S. Patent and Trademark Office, and the National Institute of Standards and Technology says that the particular FRAND commitment, the standards body’s intellectual-property policies, and the circumstances of negotiations may matter when remedies are considered. The summary is not a universal rule for every dispute or jurisdiction. Read the DOJ summary of the 2019 joint policy statement.
The European Commission’s page describes a framework proposal published on April 27, 2023. Its proposed elements included an EUIPO competence centre, SEP registration and essentiality checks, FRAND determination, and possible transparency measures for aggregate royalty rates. These are elements described as proposals on that page, not proof that every element is currently in force; the page does not establish their present legislative status. See the Commission’s SEP page.
