DNA evidence eventually identified Frederick Louis Tanzer as the attacker in a 1989 Cincinnati rape. By then, Ohio’s deadline for prosecuting that offense had expired. Tanzer was later convicted in federal court for making false statements to investigators—not for the rape—and sentenced to 15 years.
Why couldn’t Ohio prosecute him for the rape after DNA identified him?
The attack on Dana Beatty took place in her Cincinnati home on August 1, 1989. The U.S. Department of Justice describes it as lasting more than five and a half hours. Investigators did not identify the assailant at the time.

Ohio’s limitation period for rape was six years when the attack happened. The Southern District of Ohio U.S. Attorney’s Office said that period expired around 1995. The DNA identification came much later: in 2024, investigators connected Tanzer to the crime scene using genetic genealogy and DNA from a coffee cup he discarded.
The timing was decisive. DNA could help identify a suspect, but it did not, by itself, restore Ohio’s ability to prosecute an offense whose limitation period had already run.

What changed in Ohio’s law—and why did it not reopen this case?
Ohio later lengthened the time available for some prosecutions. NBC News reports that the state extended the period for rape from six years to 20 years in 1999, then to 25 years in 2015. The Ohio Legislative Service Commission’s 2015 analysis describes an additional five-year period tied to qualifying DNA identification, subject to statutory conditions.
Those changes did not revive a case already barred by the earlier deadline. The Legislative Service Commission analysis explains that the DNA provision depended on when the prior limitation period expired. For Beatty’s 1989 attack, that period had ended around 1995, long before the 2015 amendment.

This is a rule about this offense, in Ohio, under the law and dates relevant to this case—not a rule that every old sexual-assault case is impossible to prosecute. Limitation periods, DNA provisions, and whether a later law applies to a previously expired deadline can differ by jurisdiction and offense.
What Tanzer was prosecuted and sentenced for
In December 2024, federal prosecutors charged Tanzer with making false statements to investigators. The DOJ explained that those federal offenses could be prosecuted even though the limitation period for the underlying Ohio offense had expired. In September 2025, Tanzer pleaded guilty to three false-statement counts.

On January 28, 2026, a federal judge sentenced him to 180 months—the statutory maximum for those convictions, according to the U.S. Attorney’s Office for the Southern District of Ohio. The conviction was for false statements, not rape. U.S. Attorney Dominick S. Gerace II said Tanzer had lied to the FBI before admitting he was the man who committed the rapes; that statement is the prosecutor’s characterization, not a rape conviction.
What the case says about limitation periods
The policy debate is unresolved. Advocates and some legal experts argue that deadlines can deny accountability when survivors need time to report or investigators need time to identify an unknown offender. RAINN vice president of public policy Stefan Turkheimer has argued that survivors should be able to focus on healing rather than racing a legal deadline. Case Western Reserve University law professor and former prosecutor Ayesha Bell Hardaway has raised concern about whether accountability is possible when a deadline blocks prosecution.

Others argue that deadlines press investigators and prosecutors to act while evidence is fresher. University of South Carolina law professor Nathan Rouse has cautioned that eliminating deadlines altogether may weaken incentives for timely prosecutions. These are competing policy arguments, not a settled consensus about what every jurisdiction should do.

That count is NBC’s characterization of the dataset; it should not be read as a state-by-state legal guide. Laws vary, and a complete assessment requires checking the jurisdiction, offense, deadline, any DNA or other tolling rules, and whether a later amendment reaches cases whose earlier deadline already expired.

A separate reported barrier involving a spousal exemption
NBC also reported that authorities could not pursue alleged assaults involving Tanzer’s former wife because Ohio had a spousal exemption at the time, and that Ohio eliminated the exemption in 2024. The report’s account of those allegations and the statutory change is not independently established here; it should be understood as a reported additional issue, separate from the expired limitation period for Beatty’s 1989 attack.
