Cornell University Police Department records described in the report documented other investigative steps, including witness interviews, anonymous tips and a later Snapchat data return. The reporting does not establish that the DA reviewed all of those materials.
What the report says the DA reviewed
NBC News reported that Van Houten said the initial statement did not allege criminality and that he based his decision not to pursue charges on that statement. NBC also reported that the complainant was not interviewed by the district attorney’s office. Those descriptions are attributed to the reporting and to Van Houten; they do not establish what every member of the office may have seen or considered.

The report says a campus investigator approached the DA’s office about interviews on November 25, 2024. Van Houten later told NBC there was “nothing to review” because the fraternity members whose interviews had been flagged had declined to speak on their attorneys’ advice. That explanation concerns those proposed interviews; it does not by itself resolve whether other police-collected materials were provided to or reviewed by the DA.

What campus police reportedly collected
Police records reviewed by NBC documented investigative steps by Cornell University Police Department (CUPD), including witness interviews and anonymous tips during the initial investigation. The distinction matters: the report describes materials collected or documented by campus police, while Van Houten’s stated basis for the charging decision was the complainant’s initial statement. The reporting does not establish that the DA reviewed every item in CUPD’s records.

The later Snapchat return
According to the records described by NBC, police requested a fuller Snapchat data history on November 26, 2024, and received 1,665 data items from five accounts on December 23. A CUPD investigator later wrote that three Snapchats included or mentioned the incident and that none appeared criminal in nature. These are case-record counts reported by NBC, not findings that the data proved criminal conduct.

The report available here does not establish the outcome of that review. Nor does it establish the current status or resolution of the civil lawsuit.
