Usually, no: a basic hyperlink to a publicly accessible page does not require the destination site’s permission in the sources discussed here. But the answer to “Is deep linking illegal without permission?” depends on where the dispute is governed and what the link actually does. A deep link sends a visitor to a specific page inside another website rather than its homepage; copying that page, embedding it, misleading visitors, or bypassing access controls raises different questions.
What counts as a deep link?
A deep link is a hyperlink that takes someone directly to an internal page on another website—for example, a link to a particular article rather than the site’s home page. A link ordinarily communicates a location. It does not, by itself, reproduce the text, image, video, or other work found at that location.

The World Wide Web Consortium (W3C) says its policy does not require permission to link to its site or other websites. That is useful policy guidance, not a statute or a universal court ruling. What the cited legal sources establish—and what they do not
United States: linking to infringing material
U.S. Copyright Act § 512(d) addresses online location tools, including referrals or links to locations containing infringing material. Its limitation on liability is conditional: the statutory requirements include knowledge-related rules, limits concerning financial benefit and control, and responding appropriately to qualifying notices. It is not blanket permission for every person to post any link. The cited source is the 2024 edition of the statute; check for later amendments before relying on it. South Korea: a jurisdiction-specific deep-link decision
A Republic of Korea Supreme Court decision, available through the National Law Information Center, describes a deep or direct link as information about a location or path. In the circumstances and under the copyright law considered there, the court concluded that linking was not reproduction or transmission. That decision is relevant to the Korean legal context; it does not establish a worldwide rule. Read the National Law Information Center decision.
Limits of these examples
These sources do not decide the law for every country, determine whether a particular website’s terms bind a particular linker, or resolve a specific dispute. Governing law and the link’s technical and factual context matter. The sources below explain why different conduct should not be treated as an ordinary hyperlink.

When a link is different from copying or embedding
Copying the destination’s content
Reproducing protected text, images, video, or other material on your own site is a separate act from linking to the page where it appears. Permission or a copyright defense may be relevant. In the United States, fair use is assessed case by case; the Copyright Office says there is no automatic safe number of words or percentage of a work that can be copied. Embedding or framing
An embedded item or framed page can make another site’s content appear within your own page. That presentation is not the same as a plain hyperlink. A Digital Media Law Project explainer notes that framing can raise questions such as whether visitors could be confused about the source or affiliation. When access controls or the destination raise added risk
Bypassing a paywall or other access control
A normal URL is not automatically circumvention. But a tool or method that avoids or bypasses an effective technological measure controlling access to a protected work raises a separate question under U.S. Copyright Act § 1201. The statute’s scope and exceptions matter, and technical behavior—not simply the presence of a deep URL—needs to be examined. Knowingly linking to clearly infringing material
A link to authorized public material presents a different situation from knowingly directing users to clearly infringing content. Site terms and implied affiliation
A site’s terms may raise contract or access questions, but whether they apply to a particular linker depends on matters such as notice, assent, conduct, and jurisdiction. The cited sources do not establish a general rule that a no-linking clause is always enforceable or never enforceable. Separately, label and present links honestly so readers are not led to believe the destination sponsors or endorses your site.

A practical way to assess a proposed link
- Identify the governing jurisdiction. The U.S. statutes and Korean decision above are examples, not a complete statement of every country’s law.
- Describe exactly what the link does. Distinguish an ordinary text or button link from copying, embedding, or framing content.
- Check the destination. Consider whether the material appears authorized and whether you know it is clearly infringing.
- Check the access path. Determine whether the link merely navigates to a public page or whether it or an associated tool avoids a login, paywall, or other effective access control.
- Review presentation and terms. Avoid implying affiliation or endorsement, and assess any relevant site terms under the applicable law and facts.
- Get jurisdiction-specific advice for a dispute. A lawyer can review the actual link, destination, terms, and access behavior.
