Judge Todd E. Edelman dismissed the charge against David Hearn with prejudice because prosecutors said new information pointed to a botched installation—not Hearn—as the cause of the Reflecting Pool damage, and that Hearn’s actions had not reduced the pool’s economic value. The judge also barred the government from bringing the same charge again, citing the lack of a realistic prospect of new evidence and the risk that political pressure could prompt a meritless prosecution.
Why prosecutors moved to drop the case
U.S. Park Police arrested Hearn at the Lincoln Memorial Reflecting Pool on June 19, 2026. An employee alleged that he pulled at the pool’s blue coating. Hearn maintained that he touched a section that was already peeling and did not tear or remove it. A grand jury indicted him on July 2, alleging felony destruction of property involving at least $1,000 in damage.
On July 31, prosecutors asked the court to dismiss the indictment after receiving information from the Department of the Interior and the National Park Service. That information strongly suggested the widespread damage resulted from a rushed, botched contractor installation, making it difficult to attribute the damage to vandalism. The government also concluded that Hearn’s actions did not diminish the pool’s economic value. As Judge Edelman explained, economic loss or loss in value was necessary for the charged property-destruction offense.
That distinction matters: the case did not collapse because the judge found prosecutors had identified the wrong person who touched the lining. The government’s later position was that the damage constituting the alleged crime had not been caused by Hearn and that his conduct had no effect on the property’s value.

What “with prejudice” means in this case
The government initially obtained dismissal, but the judge deferred deciding whether it should be with or without prejudice. At a September 4 hearing, prosecutors argued that a future grand jury should be able to consider the case if new evidence emerged. Hearn’s lawyers argued that keeping the possibility of prosecution open would impose an unjustified threat. On October 1, Edelman ordered dismissal with prejudice: the government cannot bring this same charge against Hearn again.

D.C. Superior Court Rule of Criminal Procedure 48(a)(2) says a dismissal is without prejudice unless the court states otherwise. Edelman said that was the usual approach, but found this case exceptional: prosecutors had concluded no crime had occurred, the possibility of new supporting evidence was theoretical, and the public pressure to revive the case created a distinct risk of a meritless re-prosecution. The judge cited the six-year limitations period as the length of time the government could hypothetically seek a future charge if the dismissal were without prejudice.

Why the judge discussed political pressure
Edelman’s October 1 order recounted President Donald Trump’s public criticism of the decision to drop the prosecution, calls to reinstate it, personal attacks concerning Hearn and his counsel, and public discussion of possibly removing U.S. Attorney Jeanine Pirro. The judge weighed that pressure against the government’s stated reason for preserving the possibility of a later case.
“While the government wishes to hold open the possibility of the development of evidence that would support a future prosecution, its own representations make plain that such a possibility is theoretical at best, and more likely, is simply fanciful.”

Edelman said Hearn faced “the unique possibility that the government will revive this case – one that it has already announced to be meritless – based on political pressure brought by the President of the United States upon his subordinate officers.” The ruling did not hold that presidential statements always bar a future prosecution, nor did it require a finding that prosecutors acted in bad faith. It tied the remedy to the circumstances in this case: the government’s account of the evidence, its conclusion about the absence of economic harm, and the political pressure described in the order.

The ruling and what it resolves
The October 1 order in United States v. David C. Hearn, D.C. Superior Court case 2026 CF2 010237, resolved the remaining question about the effect of the earlier dismissal. It bars this charge from being refiled against Hearn; it is not a general rule that political criticism alone prevents prosecution. The court’s reasoning rested on the specific evidence and concessions in this case alongside the risk the judge identified.
