What happened at the Supreme Court?
Israel’s Central Elections Committee voted in September 2026 to disqualify Balad chairman Sami Abu Shehadeh and Hadash lawmaker Ofer Cassif as individual candidates, and to disqualify the Ra’am and Joint List electoral slates. The Supreme Court heard appeals of those decisions on October 1, with a nine-justice panel.
During Abu Shehadeh’s hearing, Supreme Court President Isaac (Yitzhak) Amit said a majority appeared to favor approving the disqualification. All nine justices joined in advising Abu Shehadeh to withdraw before the court issued its decision. Amit said the justices unanimously regarded his statements as “painful, outrageous and repugnant,” while differing on the legal outcome, according to The Jerusalem Post’s October 1 report, updated October 2.
Abu Shehadeh withdrew the next day. The sources reporting the case say the court did not issue a final, reasoned ruling on his individual disqualification before the withdrawal; Reuters reported that the question became moot.

Why was Abu Shehadeh’s candidacy challenged?
The attorney-general supported disqualifying Abu Shehadeh under the ground in Section 7A of Basic Law: The Knesset concerning support for armed struggle by an enemy state or terrorist organization against Israel. The case centered on an Arabic-language article Abu Shehadeh published on October 8, 2023, during the Hamas-led attack that began the previous day.
In its submission, the attorney-general characterized the article as support for armed struggle, relying on its timing, language and discussion of the attack’s military and strategic significance. Abu Shehadeh denied endorsing the attack. He said the disputed wording was wrong, and that he intended to analyze events and argue for a political process. His lawyer argued that one article did not constitute the sustained “critical mass” of evidence required by precedent. These were opposing arguments; the reported account does not establish that the court made a final finding on the allegation.

How did the court deal with the other disqualification cases?
The related cases had different subjects and outcomes. The Supreme Court overturned the bans on both electoral lists unanimously and reinstated Cassif by a 7–2 vote, according to contemporaneous reporting.

The Jerusalem Post describes Supreme Court precedent as reserving disqualification for extreme cases, requiring clear, convincing and unequivocal evidence that the disqualifying objective is central and dominant. That demanding threshold is why the dispute was not simply whether the article’s language was objectionable: the legal question concerned whether the evidence met the statutory ground and the standard described in precedent.

The Knesset election was scheduled for October 27, 2026. The court’s reversal of the list bans left Ra’am and the Joint List able to contest it, while Cassif’s reinstatement allowed him to remain a candidate. Abu Shehadeh’s withdrawal removed his own candidacy, but Al Jazeera reported that he remained Balad’s leader.

Abu Shehadeh and the rights organization Adalah characterized the proceedings as discriminatory and harmful to Palestinian citizens’ political representation. Those are their arguments, not findings reported as established by the court. Al Jazeera estimated that Palestinian citizens of Israel make up about 20 percent of the country’s population; that figure is a news-reported estimate, not an official population statistic established in the reporting cited here.
