Customs Arrest vs GST Arrest in India: Powers, Procedure and Safeguards

Customs and GST officers have different statutory arrest powers. The Supreme Court’s 2025 ruling explains the legal thresholds, assessment question, written grounds and procedural safeguards.

Yes, Customs and GST officers can arrest in India, but under different statutory routes and only when the applicable legal conditions are met. In its reportable decision Radhika Agarwal v. Union of India, 2025 INSC 272, delivered on 27 February 2025, the Supreme Court upheld the constitutional validity of the arrest provisions and clarified that having the power to arrest does not make arrest automatic or routine.

How do Customs and GST arrest powers differ?

Customs arrest is principally governed by Section 104 of the Customs Act, 1962. GST arrest is governed by Section 69 of the relevant GST Acts, read with specified offences in Section 132. The decision-maker, offence test and procedural details therefore differ; the regimes should not be treated as interchangeable.

Issue Customs GST
Statutory route Section 104, Customs Act, 1962. Section 69 read with Section 132 of the GST Acts.
Who exercises the power A Customs officer exercising the statutory power, subject to the Act and applicable safeguards. The Commissioner forms the required belief and may authorize an officer of central or state tax to arrest.
What must support arrest Material and a reason to believe that the person committed an offence punishable under the Customs Act. Reasons to believe that the person committed a specified Section 132(1)(a)–(d) offence punishable under the provisions identified in Section 69. The reasons must refer to underlying material and evidence and establish the applicable non-bailable condition with sufficient certainty.
Must there be a completed tax assessment first? The GST assessment discussion in Radhika Agarwal does not establish a Customs-specific rule on prior assessment. No universal prior-assessment requirement. The evidence must still establish the specified offence and relevant threshold with sufficient certainty.
Production before a Magistrate Section 104(2) requires production as soon as may be; the judgment says written grounds must be supplied before production. Constitutional 24-hour protection also applies. For an arrest involving an offence specified in Section 132(5), Section 69(2) requires production before a Magistrate within 24 hours.

This comparison reflects the Supreme Court’s analysis in Radhika Agarwal. The precise application depends on the offence, the operative statutory text and the facts of the arrest.

Can Customs officers arrest you in India?

Yes. Under Section 104, a Customs officer may arrest when the statutory preconditions are satisfied, including a basis in material and a reason to believe the person committed a punishable Customs offence. That is a statutory power, not an unrestricted authority to arrest whenever an investigation is under way.

Customs officers are not police officers

The Supreme Court held that Customs officers are not police officers for the relevant criminal-law classification, although the Customs Act gives them analogous investigative powers, including arrest, seizure and interrogation. The Court also explained that statutory amendments made specified Customs offences cognizable and non-bailable and added conditions for arrest. It rejected reliance on the older Om Prakash position as a general requirement for prior Magistrate approval.

Grounds must be given

The person must be informed of the grounds of arrest as soon as may be. Under the Court’s reading of Section 104(1), written grounds must be provided before the person is produced before a Magistrate. Giving the grounds in writing enables the person to challenge the arrest and seek bail.

Can GST officers arrest you without an assessment?

Sometimes. The Supreme Court declined to make a completed assessment and quantified demand an absolute precondition to arrest under Section 69. Assessment ordinarily quantifies tax liability, but the Court said evidence may establish with sufficient certainty, even without a formal assessment, that a specified offence was committed and that the relevant punishment threshold is met.

What the Commissioner must establish

Section 69 concerns specified offences under Section 132(1)(a)–(d), subject to the punishments identified in Section 69. Examples discussed by the Court include supplying goods or services without an invoice with intent to evade tax; issuing an invoice without a corresponding supply that leads to wrongful input tax credit or refund; fraudulently obtaining input tax credit; and collecting tax but failing to pay it to the Government beyond three months. The applicable offence provisions and amendments should be checked against the current legislation in an individual case.

The Commissioner’s reasons to believe must be explicit, identify the evidence and material relied on, and show sufficient certainty that the offence and applicable non-bailable condition are met. The Court stated that “the reasons to believe must be explicit and refer to the material and evidence underlying such opinion.” A mere suspicion, doubt or desire to investigate does not by itself meet that standard.

Power to arrest is not a direction to arrest

Even when the legal ingredients for arrest exist, the decision must not be routine or mechanical. The Supreme Court quoted the principle: “Merely because an arrest can be made because it is lawful does not mandate that arrest must be made.” Whether arrest is justified remains a distinct question from whether the statute confers the power.

What are your rights if GST or Customs arrests you?

The judgment recognizes procedural protections across both regimes, while the precise statutory requirements differ. In a particular case, the current statute and applicable arrest instructions should be checked alongside the judgment.

Grounds, arrest memo and records

  • You must be informed of the grounds of arrest. In the Customs context, the Supreme Court says written grounds must be supplied before production before the Magistrate.
  • For GST arrests, the judgment discusses CBIC instructions requiring grounds to be explained and furnished in writing as an annexure to the arrest memo, with acknowledgement. It also refers to recording the date and time and supplying a copy of the memo.
  • Arresting officers should be clearly identifiable and maintain records of the statutory functions they perform.

Notification and access to an advocate

  • The nominated relative or friend should be informed of the arrest, and the notification should be recorded.
  • You may have access to an advocate of your choice during interrogation, but not continuously throughout it. The judgment describes the advocate’s presence within visual distance, not hearing distance, under the precedent it cites; this does not mean counsel can continuously intervene in questioning.

Magistrate production and health safeguards

Customs law requires production before a Magistrate as soon as may be, and the judgment requires written grounds before that production. For GST arrests involving an offence specified in Section 132(5), Section 69(2) sets a 24-hour production requirement. The judgment also discusses CBIC guidance on medical examination, health and safety, and procedure for arresting a woman.

Is arrest the same as tax recovery?

No. Arrest, adjudication and recovery are distinct processes. The judgment notes CBIC guidance that tax recovery during search, inspection or investigation must follow the applicable legal demand and adjudication procedures. A taxpayer may make a voluntary payment, but an officer should not coerce payment as “recovery” during an investigation. Payment does not, by itself, establish immunity from arrest or prosecution.
