For most U.S. paid or otherwise non-recreational small-drone work, the starting point is FAA Part 107. Before a typical job, make sure the remote pilot is qualified, the drone is registered and properly identified, the flight meets applicable operating limits, and any required controlled-airspace authorization is granted. Night flights and flights over people or moving vehicles have extra conditions; a waiver is needed for certain operations outside the rule’s limits.

Does commercial drone work fall under Part 107?

Usually, if the job uses a small unmanned aircraft for a non-recreational purpose. The FAA lists aerial photography, aerial survey, and work for hire as examples of Part 107 operations. Calling a flight a hobby or accepting no payment does not by itself make it recreational; the purpose and circumstances of the flight matter.

Part 107 covers small unmanned aircraft weighing less than 55 pounds. Aircraft weight, payload, and the type of operation can affect which rules apply. Heavier aircraft and specialized work—including package delivery, interstate carriage, agricultural dispensing, and public aircraft operations—may require additional or different FAA approvals. Confirm the governing requirements for the particular operation rather than assuming that every drone job fits the ordinary Part 107 pathway.

What are the basic Part 107 operating limits?

The FAA’s current Part 107 overview gives these baseline figures. They are not a substitute for checking airspace restrictions, authorization conditions, exceptions, or the requirements of a particular operation.

Item Baseline in FAA Part 107 guidance Practical meaning
Small-UAS scope Less than 55 pounds Weight and operation type can change which regulatory framework applies.
Altitude 400 feet above ground level (AGL) A limited structure-related allowance exists; do not treat it as a general permission to fly higher.
Speed 100 mph maximum Keep the aircraft within the applicable limit and any tighter authorization conditions.
Visibility At least 3 statute miles from the control station This is the stated minimum visibility baseline; other weather or operational factors may still make a flight unsafe.
Visual line of sight Required The remote pilot or a visual observer must be able to maintain the required visual contact; a waiver is needed to conduct an operation beyond visual line of sight when the rule requires it.

Part 107 operators must also avoid crewed aircraft and may not operate carelessly or recklessly. The remote pilot remains responsible for deciding whether the aircraft is safe to fly and for conducting a preflight inspection.

Who may operate the controls?

A person manipulating Part 107 flight controls generally needs an FAA Remote Pilot Certificate with a small UAS rating, or must be under the direct supervision of a certificate holder. For a first certificate, the usual route is to meet FAA eligibility requirements, pass the Unmanned Aircraft General—Small (UAG) knowledge test, and complete the FAA application process through IACRA. Follow the FAA’s current application instructions.

Certificate holders must complete applicable recurrent training within each 24-calendar-month period to maintain knowledge recency. The FAA provides recurrent training online at no cost. Keep the certificate accessible during operations, and make sure anyone who will manipulate the controls is qualified or properly supervised.

What registration and Remote ID does the drone need?

Register each aircraft used under Part 107, mark it with its registration number, and carry the registration certificate. FAA registration guidance lists a $5 fee per Part 107 drone and a three-year registration term; these are the figures in the guidance checked October 4, 2026, so verify the current requirements and fee before registering. A recreational registration cannot simply be used as the aircraft’s Part 107 registration.

Check Remote ID before flying. Drones that are required to be registered, or that are registered, must comply with Remote ID unless an applicable exception applies—for example, an eligible operation within a FAA-recognized identification area (FRIA). Depending on the aircraft, compliance may use built-in Remote ID or a broadcast module. Confirm that the actual aircraft and configuration meet current FAA instructions; registration alone does not establish Remote ID compliance.

When do you need airspace authorization?

Check the specific launch location, airspace class, restrictions, and planned altitude before each job. Controlled airspace may require prior FAA authorization. Depending on the location and request, authorization may be available through Low Altitude Authorization and Notification Capability (LAANC) or FAA DroneZone. FAA material says LAANC requests may be submitted up to 90 days before the planned flight.

Read the authorization’s limits and conditions and fly within them. Submitting a request is not the same as receiving approval, and an authorization does not waive unrelated Part 107 requirements.

When is a Part 107 waiver needed?

A waiver is a separate FAA approval to conduct a specified operation outside a waivable Part 107 limitation. Examples may include beyond-visual-line-of-sight flight, certain operations over people, flight above the ordinary altitude limit, or certain operations involving moving vehicles. The FAA describes a waiver as an official document approving certain operations outside regulatory limitations.

Apply for the waiver that matches the requested operation and provide the safety basis the FAA requires. Do not conduct the operation on the assumption that a pending application will be approved. If the FAA grants a waiver, follow its scope, effective dates, and conditions; it does not automatically replace any airspace authorization the flight separately needs.

What extra rules apply at night or over people?

Night operations

Routine night flight requires the relevant updated knowledge test or recurrent training, plus anti-collision lighting visible for at least 3 statute miles and flashing at a rate sufficient to avoid a collision. Controlled-airspace authorization is still required when applicable. Confirm the lighting specification for the equipment you plan to use rather than relying on a product description that does not establish the required visibility and flash characteristics.

Operations over people

Permission to fly over people depends on the aircraft’s eligible category and the restrictions attached to that category; it is not a blanket permission for commercial drones. Category 3 operations have additional constraints, including restrictions around open-air assemblies and conditions on where or how the aircraft may fly over people. Identify the aircraft’s category and verify that the planned operation satisfies every applicable condition.

Operations over moving vehicles

These operations have additional conditions and may depend on the aircraft category and the specific site and flight circumstances. Check whether the operation is permitted under the applicable rule or whether the relevant waiver is required; do not infer permission from a general over-people qualification.

Does FAA approval give permission to use the launch site?

No. Federal aviation authorization addresses airspace and aviation-safety matters; it does not itself grant access to private property or permission to take off or land at a particular site. State and local requirements may address other concerns, including privacy, zoning or land use, trespass, and conduct. Check the applicable local rules, property access conditions, and client requirements for each location. Those requirements vary by jurisdiction and site.

There is no universal FAA insurance mandate established here for ordinary Part 107 operators. A client, property owner, or permitting authority may nevertheless require aviation-specific liability coverage as a condition of the work or access, so confirm those terms before accepting the job.

What should you do before and after the flight?

  1. Confirm the regulatory path. Check the job’s purpose, aircraft weight and payload, and operation type to determine whether ordinary Part 107 applies or additional requirements may be involved.
  2. Verify pilot qualification. Confirm that the person operating the controls holds the required certificate or is under the direct supervision of a certificate holder, and that recurrent training is current.
  3. Prepare the aircraft records and configuration. Confirm Part 107 registration, required marking, registration certificate, and applicable Remote ID configuration.
  4. Review airspace and restrictions. Check the exact site and altitude. Obtain and receive any required LAANC or DroneZone authorization before relying on it.
  5. Check the flight profile. Verify the ordinary operating limits and any additional requirements for night flight, operations over people, or moving-vehicle operations. Obtain a required waiver and comply with its conditions.
  6. Confirm site and client permissions. Secure access and launch/landing permission and check any local, property, or client conditions that apply.
  7. Inspect and fly safely. Conduct the required preflight safety checks, monitor the operation, avoid crewed aircraft, and keep required records available.
  8. Report qualifying incidents. The FAA’s current Part 107 overview says certain serious injuries, loss of consciousness, or property damage of at least $500 must be reported to the FAA within 10 days. Check the FAA’s current reporting instructions to determine whether an incident meets the reporting criteria.
