Being able to listen to a podcast on Spotify does not establish that you can rebroadcast it on YouTube Live. YouTube requires streamers to have the rights needed for their live content, including rights for music and other material within an episode. The answer for a particular episode depends on its rights and license terms.
Why Spotify playback access is not enough
Access to play an episode through Spotify is not, by itself, evidence of permission to retransmit it on another platform. YouTube’s livestream terms and conditions put responsibility on the creator to have the necessary rights for live content. Its copyright guidance also explains that using copyrighted material on YouTube requires the appropriate rights or a valid legal basis.

A podcast may involve more than one rights interest: the recording and spoken episode, plus music, clips, or other third-party material included in it. Permission from a podcast creator may not cover every embedded element. The rights holder and applicable permission can vary by episode and territory; Spotify playback availability does not settle those questions.

What can happen if you play an episode without clearance?
YouTube scans live streams for third-party content. Its live-stream copyright guidance says it may show a placeholder, warn you, interrupt the stream, or terminate it. Copyright or Community Guidelines strikes can also lead to termination.

Even if you have a license, automated enforcement may still interrupt the broadcast. YouTube advises creators to ask the rights owner to add their channel to the Content ID allowlist; YouTube warns that a stream can be interrupted if the channel is not allowlisted, even when the creator has licensed the content.
- Giving credit is not permission. YouTube says attribution does not automatically give you the rights to use copyrighted content. Writing “I do not own this” does not change that.
- A short excerpt is not automatically safe. YouTube notes that even a few seconds can lead to copyright issues.
- A claim that your use is fair use is not a platform guarantee. YouTube’s fair-use guidance explains that, in the United States, courts decide individual fair-use cases and that other jurisdictions may apply different rules.
How to check whether you can use a specific episode
- Identify the exact episode and material in it. Note the recording and any music, clips, or other third-party content that may need separate clearance. Do not assume the podcast publisher controls every element.
- Ask the relevant rights holder or holders for permission. Make clear that you want to use the recording in a YouTube Live stream. If you intend to leave the replay available, ask for permission that covers archived viewing too.
- Confirm the scope in writing. Check that the permission covers the countries where the stream will be available, how long you may use the material, whether monetization is allowed, and any attribution or other conditions. These details should be resolved for the specific episode and planned use.
- Ask about Content ID allowlisting. If you have permission, ask the rights owner whether your YouTube channel needs to be allowlisted to reduce the risk of automated interruption.
- Keep the permission and its limits available. If a stream is interrupted or questioned, you will need to know exactly what was authorized and by whom. A license does not itself guarantee that YouTube’s automated systems will recognize the authorization.
What if you want to use only a clip or rely on fair use?
A shorter excerpt may be relevant to a copyright exception, but duration alone does not decide whether a use is lawful. In the United States, YouTube describes fair use as a case-specific analysis that considers purpose and character, the nature of the work, the amount used, and the effect on the work’s market. YouTube also says only a court can decide an individual fair-use case. Rules differ by country, so do not treat a short clip or a platform’s willingness to accept a stream as legal clearance.

Does YouTube Creator Music clear a podcast for live use?
No. YouTube’s current Creator Music FAQ and usage details say licensing through Creator Music is not supported for live content. It therefore does not resolve the clearance needed to rebroadcast a Spotify podcast in a live stream.

Can you publish the podcast on YouTube another way?
YouTube provides instructions for creating a podcast in YouTube Studio and distributing podcasts on YouTube. Those publishing options do not grant rights to someone else’s episode; you still need the necessary rights for the recording and any material in it. If you are the podcast creator, check that you control or have cleared the rights for the audio and associated content before publishing.

- Are territory, duration, monetization, and attribution conditions clear?
- Has the rights holder told you whether your channel needs Content ID allowlisting?
- If relying on a copyright exception, have you assessed the law in the relevant country rather than assuming a few seconds or a credit line is enough?
