Ask the school or district before submitting one. Its decision may depend on the image requirements for an ID or yearbook, whether the portrait must show the student’s current appearance, local AI and privacy policies, and how the image was made and handled.
What to check before submitting an AI portrait
Ask the office responsible for the specific use: the ID office for an identification card, or the yearbook adviser for publication. Check the current student handbook, yearbook instructions, photo specifications, and district AI policy. The federal guidance and district examples linked below do not establish a nationwide rule specifically approving or banning AI-generated student portraits.

- Are AI-generated, AI-edited, or composite portraits accepted for this particular use?
- Must the image accurately show the student’s current appearance? Are there requirements for dimensions, background, or clothing?
- Must the student or parent disclose that AI was used, or provide permission?
- Will the image be used only on an ID, or also in a yearbook, directory, website, or vendor system?
- If a commercial AI service was used, is it approved for student data, and can the uploaded image be deleted?
These are practical questions, not universal requirements. The school can tell you which rules apply locally.
Why an ID photo and a yearbook portrait may be treated differently
School ID
An ID image may need to match the student’s appearance closely enough for identification, but the specific requirements are set locally. Separately, FERPA privacy classification depends on context: the U.S. Department of Education says a photo or video may be an education record when it directly relates to a student and is maintained by a school or someone acting for it. The agency identifies a photo focused on a specific student, such as an ID photo, as one factor. That guidance concerns privacy—not whether a school must accept a synthetic substitute. Yearbook
A yearbook portrait is intended for publication, so ask whether the school permits AI-generated or substantially altered images and what consent or disclosure process applies. Publication and directory-information practices vary by district. For example, NYC Public Schools says photographs may be designated as directory information for school-community publications and that families are notified and given an opportunity to opt out. That describes NYCPS practice; it does not grant permission for AI-generated images at other schools, or establish that an AI portrait is acceptable there. Consider the AI service and image handling
If you upload a student photograph to an AI tool to create or edit a portrait, check whether the service is approved by the school or district and what it does with the image. Ask about access, retention, deletion, and whether uploaded material may be used to train models. Do not assume a consumer AI tool is approved for student data just because it can generate a usable-looking portrait.

Vendor arrangements matter too. The New York State Education Department says photography and yearbook vendors working under contract may perform contracted services subject to requirements for third-party contractors. That is a reason to ask how the school’s vendor handles images; it does not establish that any particular AI service or portrait is approved. See NYSED’s FAQs for data protection officers.

What school AI guidance can—and cannot—tell you
NYC Public Schools describes generative AI as producing new text, images, audio, or other content, and warns that outputs can be inaccurate or biased. That makes it sensible to check the image for inaccuracies and ask whether the school has a disclosure rule. It does not establish a universal requirement to disclose AI use, or a universal ban on AI portraits. Read NYCPS guidance on artificial intelligence and screen time.
In particular, do not treat FERPA as an image-acceptance policy: whether an image qualifies as an education record and whether it meets an ID or yearbook’s submission rules are different questions. The school or district must answer the latter for its own use.
