Possibly—but prompting an AI does not automatically give you copyright in the design, and any rights you may have do not grant permission to use LEGO’s name, marks, imagery, instructions, or other protected material commercially. The answer depends on what a person contributed, what the design uses, where and how it is shared, and which country’s law applies. The copyright discussion below is U.S.-focused; LEGO’s cited guidance and terms should also be checked against the relevant service and region.
Can you copyright an AI-generated LEGO design?
In the United States, the U.S. Copyright Office says generative-AI output can be protected only where a human author determined sufficient expressive elements. Simply writing prompts does not, by itself, establish human authorship of the output’s expressive choices. Copyright protects qualifying human-authored expression, not an idea or prompt as such.

A person’s original text, drawings, or other expression incorporated into a design may qualify for protection. A sufficiently creative human arrangement or qualifying modifications may also be protected. Any such protection is limited to the human-authored contributions; it does not automatically extend to elements determined by the AI. The Copyright Office’s January 29, 2025 report announcement explains its position on copyrightability of generative-AI output. No. Copyright in your own contributions and permission to use LEGO’s intellectual property are separate questions. Owning bricks, generating a design, or holding copyright in a human-authored portion does not itself authorize commercial use of LEGO branding or materials.

LEGO’s U.S. Terms of Use say that its displayed marks are not licensed by implication and limit use of site materials to non-commercial personal home use absent permission. The terms also state that use of site content for AI purposes requires written consent. LEGO’s help guidance on personal projects says commercial use is not allowed for the brand names, logos, specified trademarks such as the 2×4 brick or minifigure, instructions, or pieces for commercial purposes such as marketing and PR. That is LEGO’s published guidance, not a court ruling resolving every possible use or jurisdiction; check the applicable local terms and get permission where needed.
Before putting a design up for sale or using it to promote a business, identify exactly what the buyer receives or sees. A digital rendering, downloadable instructions, physical build, and product listing can raise different issues. Check whether the material includes LEGO marks, distinctive imagery, instructions, pieces, or site content, and avoid wording or presentation that suggests LEGO sponsorship or affiliation without authorization. A particular descriptive reference to the brand depends on context and applicable law; LEGO’s terms do not grant trademark rights by implication.

Is sharing a design online different from selling it?
Sharing without charge is different from selling, but it does not automatically resolve copyright, trademark, or platform-term questions. A third-party hosting service has its own rules for uploads, removals, and licenses. If you share through a LEGO property, its rules also apply: LEGO’s Code of Conduct makes users responsible for obtaining permission for material that is not theirs and describes content-removal rules for LEGO properties.

Check the current terms of the specific service before uploading, especially if it asks for a license to submitted work. LEGO’s Terms of Use for LEGO Apps and Games say creators retain individual copyright in contributions submitted to covered services while granting the LEGO Group a broad, worldwide, royalty-free license to use and modify those contributions. That applies to the services covered by those terms; it should not be assumed to describe every LEGO service or third-party platform.

What to check before publishing
- Identify the use. Decide whether you are privately sharing, publicly promoting, or selling; whether the material is artwork, instructions, a physical build, or a product.
- Separate human and AI contributions. Record what you created or changed yourself and what the AI determined. Do not assume a prompt alone gives you copyright in the output.
- Check the material and branding. Look for LEGO names, logos, distinctive imagery, instructions, pieces, and content taken from LEGO websites or services. Check the relevant terms and obtain permission if required.
- Read the destination’s terms. Confirm what license you grant by uploading, what removal rules apply, and whether the terms differ for a LEGO service and an independent host.
- Confirm the governing location. U.S. Copyright Office guidance is not universal law, and LEGO’s personal-project help page is regional guidance. Review the rules applicable to your country and the service involved.
- Get qualified advice if the stakes warrant it. LEGO recommends asking a lawyer qualified in intellectual property law before making a conclusive decision when you remain unsure.
