Usually, a DDA leasehold property can be sold or transferred before conversion to freehold, but the lease and the Delhi Development Authority’s requirements may call for permission. Mortgage is a separate question: confirm the terms of the lease, DDA’s process and the lender’s conditions for the specific property. Conversion is voluntary and does not itself grant sale or mortgage permission.
Can you sell or transfer the property before conversion?
Leasehold status alone does not rule out a sale. DDA’s published conversion documents contemplate an authorized attorney who is competent to seek sale permission, execute the sale deed and register it on behalf of the lessee, sub-lessee or allottee. That is evidence that a pre-conversion sale route exists; it is not blanket permission for every property or transaction. The lease and any required DDA approval still govern.

DDA says a transfer outside blood relations requires the lessor’s permission under the lease terms and may attract unearned increase. The applicable demand depends on the lease and DDA’s current decision for the property; there is no single fee established for every case. Ask DDA to confirm whether permission, mutation or substitution, or a charge applies before committing to a transaction. DDA FAQ

Mortgage permission is distinct from permission to transfer. DDA lists permission to mortgage as a post-allotment service, so do not assume that the leasehold title can be mortgaged without approval. Check the mortgage clause in the lease, ask DDA which permission or documents apply, and confirm the lender’s requirements before signing financing documents.

If you later seek conversion while the property is mortgaged, DDA’s published conversion guidance calls for a mortgagee no-objection certificate for conveyance-deed execution. That conversion requirement should not be mistaken for a complete statement of the rules for taking out a mortgage. DDA Land Disposal services · DDA residential conversion brochure (2014)
What conversion changes—and what it does not
Freehold conversion is a separate, voluntary process for residential units; DDA processes applications online. DDA’s current FAQ says applicable outstanding dues must be paid before conversion is allowed. It also says conversion is not allowed while a matter concerning the property is sub judice. DDA conversion guidance · DDA FAQ
Conversion does not replace any sale permission required by the lease, resolve a disputed title chain, or automatically satisfy a lender. DDA publishes different guidance for residential and commercial or industrial properties, so check the rules for the property’s actual category rather than applying a residential brochure to another type of property.

What to check before signing or registering
- Read the title and lease documents. Review the allotment letter and lease or sub-lease deed for transfer and mortgage clauses. Confirm who is recorded as lessee or allottee and whether prior transfers and mutation records are in order.
- Confirm the property category and responsible DDA office. Residential flats, residential plots, and commercial or industrial properties may follow different guidance. Use the relevant DDA process.
- Ask DDA about the proposed transfer. Confirm whether sale permission, mutation or substitution is needed and whether a fee or unearned-increase demand applies—particularly for a transfer outside blood relations.
- Coordinate mortgage approvals. For an existing mortgage or a financed purchase, check DDA’s permission requirements and the lender’s conditions before signing or registering documents. If conversion is also planned, establish how to obtain the mortgagee NOC.
- Check dues and legal issues. Ask whether applicable DDA dues remain unpaid and whether a title dispute or court matter affects the transaction or a conversion application. Also check for encroachment or use that may not comply with the lease.
- Get legal review if the record is unclear. A Delhi property lawyer can review the title chain, lease conditions and proposed sale or mortgage documents, especially where earlier transfers or ownership records are uncertain.
Which route fits your situation?
| Situation | What to verify |
|---|---|
| Sale or transfer before conversion | Lease permission clauses, DDA sale permission, the transferee relationship, and mutation or substitution requirements. |
| Transfer outside blood relations | DDA says permission is required under the lease terms and unearned increase may be charged. Obtain the property-specific requirement and demand from DDA. |
| Mortgage or financed purchase | Lease terms, DDA mortgage permission and lender conditions; if converting while mortgaged, the mortgagee NOC requirement. |
| Conversion before or after a transaction | Conversion is voluntary, but applicable dues must be cleared and DDA’s category-specific process followed. Conversion does not replace a required transfer permission. |
| Property with a dispute or unclear title history | Resolve the record and obtain legal advice. DDA says a sub-judice matter prevents conversion. |
