Yes. In India, a taxpayer may voluntarily pay an ascertained GST liability through FORM GST DRC-03 before a show-cause notice under section 73(5) or 74(5) of the CGST Act. But a payment made while officers are conducting a search is not automatically voluntary just because DRC-03 was filed: the circumstances and evidence matter.
Voluntary payment is different from recovery during a search
CBIC’s Instruction No. 01/2022-23 [GST-Investigation], dated 25 May 2022, says the law does not bar a taxpayer from voluntarily paying a tax liability that the taxpayer or tax officer has ascertained during or after proceedings. It also distinguishes that choice from an officer recovering disputed tax on the spot during search, inspection or investigation. CBIC says recovery should follow due legal process and that an investigation itself does not create a need for immediate recovery. Read the CBIC instruction.

| Situation | What it means |
|---|---|
| Taxpayer-initiated payment | The taxpayer decides to pay an ascertained liability and initiates the prescribed payment process. |
| Officer-compelled recovery during investigation | Payment is demanded or extracted as immediate recovery during search, inspection or investigation, rather than through due legal process. |
The distinction is important: the instruction permits voluntary payment, not an officer bypassing the legal process for recovery.

For a pre-notice payment, the procedure reflected in the cited materials is for the taxpayer to inform the proper officer through FORM GST DRC-03. The proper officer then issues an acknowledgment in FORM GST DRC-04. The Delhi High Court discussed this process, and GST Council material reproduces the relevant Rule 142 procedure. See the GST Council material.
Forms and portal workflows can change. Check the current notified rules and GST portal process for the relevant tax period before filing. Keep copies of the submitted form, portal confirmation, payment proof, DRC-04 acknowledgment and communications with the proper officer.
When may a payment be challenged as involuntary?
Filing DRC-03 alone does not settle whether a payment was truly voluntary. Courts have considered the surrounding facts, including when payment occurred, whether the taxpayer independently ascertained the liability, who initiated and controlled the filing, whether DRC-04 issued, what communications took place, and whether the taxpayer objected afterward.

In 2026, the Rajasthan High Court ordered a refund on the record before it, while making clear that ultimate tax, interest or penalty liability remained to be adjudicated. That decision does not establish an automatic right to a refund for every payment made during a search. Read the Rajasthan High Court decision.

What to preserve if you believe you were pressured
Keep a dated, factual record while events are still clear. Preserve:
- DRC-03, DRC-04, or evidence that an acknowledgment did not arrive;
- payment receipts, portal confirmations and bank records;
- search, inspection or investigation documents, including notices and summons;
- messages, emails and other communications about the amount or payment; and
- a timeline noting who proposed the payment, who completed the filing, and when any objection was raised.
These records may help establish what happened, but they do not guarantee a particular judicial outcome.

Check the provision and stage before paying
The 25 May 2022 CBIC instruction refers to voluntary payment before a show-cause notice under sections 73(5) and 74(5). The appropriate provision and consequences depend on the relevant tax period, alleged facts and procedural stage, including whether a notice has already been issued. Do not assume that making a payment will prevent interest, penalty or further proceedings in every case. For a material or disputed amount—or where you believe payment was compelled—seek advice from a qualified GST practitioner or tax lawyer.
