Sometimes, but there is no nationwide yes-or-no rule. Whether you may take something from an apartment dumpster depends on state and local law, rules about collecting discarded waste, and whether reaching the bin requires entering a restricted area. The U.S. Supreme Court’s decision in California v. Greenwood does not give the public general permission to enter apartment property or remove items.
Why California v. Greenwood does not settle the question
In California v. Greenwood, the U.S. Supreme Court held that the Fourth Amendment did not prohibit police from searching and seizing garbage left for collection outside the home’s curtilage. The ruling concerns limits on government searches and a person’s expectation of privacy in discarded trash; it is not a general scavenging law, a ruling that title to every discarded item has transferred, or permission for members of the public to enter private property. How the dumpster’s location and access matter
A bin visible from a street and one reached only by entering a signed or otherwise restricted apartment area present different access circumstances. That distinction can matter under trespass law, although the result depends on the law where the property is located.

In State v. Sigarroa, the Wisconsin Court of Appeals described a dumpster at the rear of apartment property. Reaching it required traveling down a private driveway past a “Private Property” sign. The court considered those facts when addressing whether the defendant had an expectation of privacy in the trash for Fourth Amendment purposes. The case did not decide that every apartment dumpster is off-limits, or that taking something is lawful whenever a bin can be seen from a public street. Read State v. Sigarroa.

Discarded items may still be covered by waste rules
Putting waste out for disposal does not necessarily mean anyone may collect it. In State v. Wright, the Iowa Supreme Court discussed abandonment and quoted local ordinance language making it unlawful for a person to take or collect solid waste set out for collection unless authorized as a solid-waste collector. That is an Iowa example, not a rule that applies nationwide; a different city or state may have different rules. Read State v. Wright.

How to check the rules for a specific apartment dumpster
- Identify the location. Note the state, county, and city; those details are necessary to check the rules that may apply.
- Check local waste rules. Search the city or county code for provisions on scavenging, solid-waste collection, and use of waste containers. Look for who may collect discarded material and whether the rule covers apartment dumpsters.
- Check state trespass law and the access route. Determine whether reaching the bin involves a gated, signed, fenced, or otherwise restricted area, and consult the state’s trespass provisions for the local standard.
- Ask the property manager or owner before entering a restricted area or taking anything. Permission avoids relying on an assumption about access or whether the item is available for collection.
If you are told to leave or receive a citation
Do not treat Greenwood as a right to remain on apartment property after a property representative tells you to leave. If you have received a citation or have been warned to leave, consult a local attorney about the law and facts in that jurisdiction.
