Sometimes, but there is no universal yes or no. The answer depends on your country, the game’s licence and technical design, and what you do after shutdown. Keeping files or using an existing offline mode is a different question from bypassing authentication, running a private server, modifying a client, or sharing files.
In the United States, a narrow federal rule permits certain circumvention to restore personal local play in qualifying games after authentication support ends. It does not generally authorize reviving online play. In the European Union, there is no general guarantee that a game will remain playable indefinitely, although consumer remedies may apply in particular cases.

First, identify what the shutdown actually disables
A server closure does not have the same effect on every game. A title may still run offline or support local play; it may need a publisher server only to authenticate a copy; or it may depend on remote systems for core gameplay, content, progression, or multiplayer. The fact that a game stops working after shutdown does not, by itself, establish which legal rules apply to a workaround.

Continuing to use an offline mode already available in the game is not the same as bypassing a technical protection, recreating an online service, or distributing a modified client. A disc or downloaded copy does not by itself settle those separate questions: the licence, copyright rules, technical measures, and any other applicable laws can still matter.

What the rules say in the United States
Under 37 C.F.R. § 201.40(b)(19), a limited exemption to the DMCA’s anti-circumvention prohibition covers certain efforts to restore personal local gameplay. It applies to a lawfully acquired complete game in physical or downloaded form when its owner or authorized representative has ended access to an external server needed for an authentication process. The permitted circumvention must be solely to restore access for personal local play on a PC or console.
Which games and shutdowns qualify?
For the personal-play part of the rule, a “complete game” must be playable without accessing or reproducing copyrightable content stored, or previously stored, on an external server. “Local gameplay” means play on a PC or console, or on locally connected PCs or consoles; it excludes play through an online service or facility.

The owner or authorized representative must have affirmatively ended support and the service must actually be unavailable. The rule also covers a case where support has been discontinued for at least six months and has not been restored. That six-month condition is not a general waiting period that makes every server workaround lawful; the other requirements still apply.

The rule is not a general right to bring an online game back. It does not generally authorize operating or accessing a private online server, obtaining server-side copyrighted content, distributing a modified game, or ignoring other applicable laws. It is an exception to a specific circumvention prohibition, not a blanket licence to use or redistribute protected material. Whether a particular workaround fits the exemption depends on its facts.

Institutional preservation is a separate, restricted route
The regulation also allows qualifying libraries, archives, and museums to access or modify games for preservation under specified conditions. This activity must be noncommercial, and the game may not be distributed or made available outside the institution’s physical premises. A separate institutional provision addresses some games that are already server-independent but no longer reasonably available commercially. These preservation rules do not create a general public entitlement to play an institution’s preserved copy remotely.
What the rules say in the European Union
The European Commission said on 16 June 2026 that it could not at that stage propose a general legal obligation to keep video games playable after they stop being provided commercially. That does not mean a publisher can ignore every consumer obligation: EU rules still address information about supply duration and termination, unfair commercial practices and terms, and remedies when digital content or a service does not conform to the contract.

In a 5 June 2024 answer about delisted or disabled games, the Commission said consumer legislation “does not set specific requirements as to the duration of the supply of products, including of online video games.” The answer described possible remedies for lack of conformity, including bringing the service into conformity or, if the supplier makes clear it will not do so, a proportionate price reduction or contract termination. For a terminated time-based digital supply, it also described reimbursement for the prepaid portion of the remaining affected period. Whether a remedy applies depends on the contract and circumstances; it is not an automatic refund for every shutdown. National courts and administrative authorities handle individual disputes.
The Commission’s 16 June 2026 response to the Stop Destroying Videogames initiative said it planned to begin an exchange with industry and consumer representatives by the end of 2026, with the aim of drawing up an industry code of conduct on game end-of-life and raising awareness of applicable consumer rights. That was a planned policy process, not an enacted universal right to continue playing a discontinued game.

How to assess a particular game
Before relying on an offline mode or workaround, establish the facts that determine which rules may apply:
- Your location and governing law: Identify the country where you are playing and check whether the game’s terms specify governing law.
- What the game needs from the server: Determine whether it uses the server for authentication alone or for gameplay, multiplayer, progression, content, anti-cheat, or other functions.
- What remains playable: Check whether the game runs without server access and whether the relevant mode is local play or depends on an online service.
- What you propose to do: Distinguish ordinary offline play from circumvention, software modification, private-server operation, or distributing files. Do not assume the rules for one activity cover another.
- What was promised: Review the terms and product information shown when you bought or licensed the game, especially statements about duration, termination, and shutdown notice.
If you are considering a consumer complaint in the EU, retain your receipt, the product page and terms shown at purchase, the shutdown notice, and any statements about how long the service would be available. Those materials can help assess whether the service conformed to the contract; they do not establish that a remedy is guaranteed.
