Sometimes—but “made in the U.S.” alone does not determine whether a server may be sent to China. The answer depends on whether the server is subject to the Export Administration Regulations (EAR), its exact classification and configuration, the destination and parties, the intended or known end use, and whether a license or other authorization is required. Without those transaction details, no one can give a reliable yes-or-no answer.
Why a sale is not automatically an export authorization
A commercial order, a U.S.-made label, or a familiar-sounding classification is not permission to ship. Export-control review concerns the transaction and the item—not just the point where it was manufactured. Depending on the facts, the relevant activity may be an export, reexport, transfer within a country, or access or activity covered by a specific control.

A direct shipment from the United States to China, a sale to a domestic intermediary, and a transfer after an item has already been imported can present different questions. The seller must identify the actual route, consignee, ultimate end user, and end use before deciding whether authorization is needed.
What determines whether a server can go to China?
EAR jurisdiction and the server’s classification
First determine whether the item is subject to the EAR. If it is, identify its Export Control Classification Number (ECCN) and review the corresponding Commerce Control List (CCL) entry and current controls. The exact server model and installed configuration matter, including processors, accelerators, memory, interconnects, firmware, and software. A product label or informal supplier description is not conclusive classification support.

In a May 13, 2025 policy statement, the Bureau of Industry and Security (BIS) identified servers classified as ECCN 5A992.z as an example of commodities that may be relevant to advanced-computing controls. That does not mean every server under that classification is prohibited, nor that the classification alone settles whether a transaction needs authorization. Check the exact hardware against the current rules and applicable performance parameters. BIS’s 2023 FAQ also discussed certain 5A992/5D992 items meeting or exceeding specified 3A090/4A090 parameters; treat that FAQ as context, not as a substitute for current regulations.
Destination, parties, and end use
Item-based and destination controls are only part of the review. Identify all parties to the transaction, including the consignee and ultimate end user, and screen them under applicable restricted-party and end-user controls. Assess the actual use, including whether it involves a supercomputer, semiconductor activity, military-intelligence activity, or a weapons-of-mass-destruction (WMD)-related end use.

EAR Part 744 can impose additional controls for specified items when the exporter has the requisite knowledge of a covered destination, end use, or end user. BIS’s 2025 guidance also describes potential authorization triggers for certain AI-training activities involving items subject to the EAR and specified military-intelligence or WMD connections to Country Group D:5 destinations, including China, or Macau. BIS stated that access to advanced-computing integrated circuits and commodities subject to the EAR for AI-model training could enable such end uses. The details of the rule and the transaction’s facts determine whether a particular activity is covered.
How to assess a proposed server transaction
- Record the item and route. Capture the make and model, installed processors and accelerators, memory and interconnect configuration, firmware and software, quantity, ship-from point, destination, and any onward-transfer route.
- Identify the parties and intended use. Record the consignee, ultimate end user, relevant ownership or headquarters information, and the stated end use. Consider what the seller reasonably understands about the use, not only what appears on an order form.
- Establish EAR status and classification. Ask the manufacturer for classification information, then check the applicable CCL entry and current EAR text. If the classification remains uncertain, consider requesting a BIS commodity classification through SNAP-R.
- Apply current item and destination controls. Review the ECCN’s reasons for control, China-related destination rules, and any controls tied to incorporated components or advanced-computing performance parameters.
- Screen parties and evaluate end-use controls. Check the relevant parties and assess whether Part 744 or other end-user and end-use restrictions apply to the item and facts.
- Determine whether authorization is required and available. If a license is required, do not ship until the required authorization is in place. If considering a license exception, verify that it covers this item and transaction and that every condition is met.
- Preserve the decision record. Keep classification support, party-screening results, customer and end-use information, relevant approvals, and the basis for the decision. Seek qualified export-control advice for uncertain or material transactions.
Can a license exception authorize the transaction?
Possibly, but an exception is not a general authorization to ship to China. The applicable provision may limit eligible items, destinations, consignees, end uses, notifications, or certifications. Part 740 includes advanced-computing exception conditions and exclusions relevant to China, Macau, and Country Group D:5 destinations or entities. Read the exact current provision against the full transaction; do not rely on the name of an exception or assume that a classification makes it available.

What to do when the ECCN or requirements are unclear
Request classification information from the manufacturer and compare it with the current CCL entry and EAR text. If uncertainty remains, BIS provides a route through SNAP-R for commodity-classification requests as well as license applications. For complex, high-value, or otherwise material transactions, consult a qualified export-control professional or counsel before shipment. A BIS classification request or a customer’s assurance should not be treated as a substitute for reviewing the transaction’s parties, destination, and end use.
